DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This DEED is entered into and executed by,

PAULINA A. MANSING-BUCOG, of legal age, Filipino, widow, and a resident of


barangay Ajong, Sibulan, Negros Oriental, hereinafter called the VENDOR, in favor of,

SPOUSES ROQUE C. CUTARAN, JR. and VIRGILIA B. CUTARAN, likewise both of


legal age, Filipinos, spouses, and residents of barangay Ajong, Sibulan, Negros Oriental,
hereinafter referred to as the VENDEES;

WITNESSETH:

That PAULINA A. MANSING-BUCOG, the vendor herein, is a co-owner of One-


Seventh(1/7) undivided share of the ONE-FOURTH (1/4) portion of a parcel of land known as
Lot No. 3792, of the Cadastral Survey of Sibulan, Negros Oriental, located in barangay Ajong,
Sibulan, Negros Oriental, covered by Tax Declaration No. 2005-16-003-1052, together with the
improvements found therein, consisting of Three Hundred Twenty Nine (329) Square meters,
more or less; and which parcel of land is more particularly described in its Original Certificate of
title No. OV-7026, as follows:

“A parcel of land (Lot No. 3792), situated in barangay Looc (now Ajong), Sibulan,
Negros Oriental. Bounded NE by Lot No. 3805; on the East by Lot 3791; on the SE., by Lot
3790; on the South West., by Lot 3786; and on the NW., Lots Nos. 3785, 4365 and 3793;
containing an area of NINE THOUSAND TWO HUDNRED AND EIGHTEEN (9,218) square
meters, more or less;

That the herein VENDOR acquired absolute ownership over that portion of the above-
described parcel of land through a Decision of the Regional Trial Court, Branch 40 dated April
20, 2005 in re: Civil Case No. 11878 which has already become final and executory;

That for and in consideration of the sum of ONE HUNDRED SEVENTY THOUSAND
PESOS (Php 170,000), Philippine Currency, in hand paid by the herein Vendees, spouses Roque
and Virgilia Cutaran, and receipt in full is hereby acknowledged by the Vendor to his entire
satisfactions and that by virtue of these presents, the Vendor does hereby SELL,TRANSFER,
and CONVEY unto the vendees, their heirs and assigns, all the vendor’s rights, interest and
participations over her undivided shares of Lot No. 3792, consisting of Three Hundred Twenty
Nine (329) square meters, more or less, including all the improvements found therein, free from
all liens and encumbrances;

That the vendor herein declares that this land is not tenanted nor worked upon by an
agricultural lessee nor covered by the Comprehensive Agrarian Reform Law because he was the
pone in possession of the said parcel of land; and that due notice has been given to all persons
affected by this transaction in compliance with the provisions of the New Civil Code of the
Philippines, pertaining to the rights of the redemptioner and preemptioner, but nobody opted to
exercise the said rights; and the vendors warrant their title and ownership over the said parcel of
land and will defend the rights of the vendee against any adverse claim whatsoever.
