LEAVE AND LICENCE AGREEMENT

THIS AGREEMENT OF LEAVE AND LICENCE is made and entered into at on this 15 st
April 20018 BETWEEN MR. Shantilal Nanalal Kothari Owner of Block 5, Opp.
Kamgar Nagar, CST Road, Chembur, Mumbai-400071 hereinafter called “The
LICENSOR” (which expression shall otherwise, repugnant to the context or meaning
thereof mean and include her/his, executors, administrators and assigns) of the ONE
PART AND Shri Prashant Devendra Kothari, aged 26 hereinafter called “The
LICENSEE” (which expression shall unless repugnant to the context or meaning thereof
shall mean and include her/his heirs, executors, administrators and assign of the OTHER
PART;
WHEREAS the Licensor is the owner of the premises lying and situated at
Block 5, Opp. Kamgar Nagar, CST Road, Chembur, Mumbai-400071 herein after for
brevity’s sake called “THE SAID PREMISES”. That the licensor is owner of said
premises and as the licensor is owner of said premises and as the licensee is in need of a
premises for the business and residence and for that reason he/she has approached the
licensor and requested him/her to give him/her the above mentioned said premises on the
following terms and condition agreed to by and between both the parties.
NOW THIS INDENTURE WITNESSETH AS UNDER:-
1. The licensor has put the licensee in possession of Block 5, Opp. Kamgar Nagar,
CST Road, Chembur, Mumbai-400071 on the date of execution of these present
for the period of 11 month beginning from 15st April 2018 and 11 months
complete on 14th March 2019.

2. The licensee shall handover the vaca nt and peaceful possession of the said
premises to the licensor on the expiry of the period of Eleven months i.e. on 14 th
March 2019.

3. It is expressly agreed by and between the parties hereto that a two months prior
notice to be given by the party choosing to rescind this agreement to the party at
his/her intention to do so.

4. The licensee shall pay monthly compensation Rs.: -3000/- (three thousand) to the
licensor for the use and occupation of the said premises.

5. The licensee shall give Rs.: - 5000/- (four thousand five hundred) by the way of
security deposit.

6. The Licensee shall occupy the said premises for residence or business purpose
only as have been agreed by and between both the parties.
7. It is hereby agreed by and between the parties that the electricity bill shall be fully
borne by the licensee and will be paid to the concerned authority or the licensor.

8. It is hereby agreed between the parties hereto the furniture, fixtures, fittings,
articles and thing more particularly described in the schedule hereto which belong
to the licensor and are lying and being in the said premises shall continue to
remain in the said premises and can be used by the licensee along with the
licensor, provided that the licensee shall here by fully and effectually indemnifies
the licensor from and against any loss, damages, pilferage or destruction all or any
of them of any reason whatsoever.

9. It is hereby agreed by the licensee that immediately on the termination of this


licensee, the licensee shall remove all goods, articles and things belonging to the
licensee which may be lying and being in any part of the said premises and also
remove themselves there from without any let or hindrance.

10. It is hereby agreed between the parties hereto that at all time the possession of the
said premises shall be of the licensor alone and the licensee shall have only the
right and occupy the said premises.

11. It is hereby agreed and declared that the licensee shall use and occupy the said
premises only as licensee shall not have any part thereof and shall not claim any
right whatsoever in respect of the said premises or any part thereof by way of
tenancy, sub-tenancy or otherwise howsoever.

12. This license is personal to the licensee and he/she shall not under any
circumstance transfer wholly or partly the benefit of this license to any other
person.

13. It is agreed that the licensee shall deposit and keeping deposit with the licensor a
sum of Rs: - 5000/- (five thousand) as security deposit without any interest for the
due and proper performance of terms of this leave and license, which amount
shall be refunded to the licensee on the termination or revocation of this license
after deducting there from such amount may be due to the licensor by way of
arrears of compensation for the sum and of occupation of the said premises and/or
for the loss and/or damage to the furniture, fixtures, fitting, articles and things
more particularly described in the schedule hereto belonging to the licensor.
IN WITNESS WHEREOF the parties hereto have hereunto set and
subscribed their respective hand and seals the day and year first hereinabove written.

lying and being in the said premises.
