ABSTRACT

THE POSITION OF A WIDOW AS HEIRESS OF HER HUSBAND’S PROPERTY

(Comparison Study According To KHI and KUHPerdata)

The problem of this research is to find out how the husband’s wealth/property in a heir, how much
will the widow ( the wife of husband who died) will get as the heiress of her husband’s wealth. I
hope this research also can give many benefits such as can give information, knowledge especially
in study of civil law in the same case as this research. The method used in this research is nomative
law research method. The conclusion is in KUHPerdata (civil regulation) if there is no agreement,
when the husband dies, all of his wealth/ properties will be given to his wife which half of the
share properties will be divided to other heiress. In KHI, the wife will get husband’s properties
also half of share properties as the heiress which ¼ of the properties if they don’t have children,
and 1/8 if they have children.
