AFFIDAVIT OF SARAH JAMES

I , SARAH JAMES, being duly sworn make oath and say as follows:-

1. I reside and have my true place of abode and postal address at _ Orchid Pathway in the
parish of St. Annas and I am a Teacher and the Claimant herein. Attached hereto marked
SJ1” is a copy of my birth certificate.
2. Edna Mae James, my sister, died in a motor car accident on _. Attached hereto marked
“SJ2” and SJ3” are copies of her birth and death certificates respectively.
3. Nestor Swaby, the son of Edna Mae James was born on August 5, 2013. Attached hereto
marked “SJ4” is a copy of his birth certificate.
4. Nestor’s father, __, died on August 5, 2013. Attached hereto marked “SJ5” is a copy of his
death certificate.
5. Since his mother’s death on __, Nestor has been living with me and I have duly cared for
him.
6. I am able to provide for Nestor through working as a teacher at the Immaculate Serena
High school in the jurisdiction. Attached hereto marked “SJ6” is a copy of my employment
verification letter from the school.
7. Taking care of Nestor and ensuring that he gets the best care, particularly during this
emotional time, is my greatest priority.
8. My living situation is stable and since his mother’s death, Nestor has been living with me
in my three-bedroom and self-owned house. This provides a comfortable and loving
environment. He has own bedroom, equipped with his own television set and his
favourite toys.
 9. I currently have no children and prior to Nestor’s arrival, I was living on my own. I am his
closest blood relative and it would therefore be emotionally detrimental to him to remove
him from me.
10. Nestor is currently enrolled in the ___Infant School where he is settled and comfortable
among his peers. He also attends the _Church with me, where he is involved in the Sunday
School and Children’s Choir. He gets along well with the other children and they have
occasional outings.
11. Nestor, like myself, enjoys nature. As such, we enjoy going to parks, fishing and gardening
on some weekends.
12. I humbly pray that this Honourable Court issues an order granting me guardianship of my
nephew, Nestor Swaby along with any further and other relief which this Honourable
Court deems fit.
