ABSTRACT

Indonesia has high child population that got special attention from Indonesia
government, especially for neglected children. One of Indonesia’s regency that have
high neglected children population and its problem is Buleleng Regency in Bali
province, in order to make a policy to protect general children and neglected children
particularly, Buleleng Regency government established Buleleng Regency Regional
Regulation Number 4 of 2016 concerning Child Protection. It is expected that the
fulfillment of neglected children's rights can be carried out well. Buleleng Regency
Social Service has role as authorized government party that responsible for social
activities to handle and resolve problems related to neglected children in Buleleng
Regency.
This research use empirical legal research with a statutory approach and a
factual approach. This research examine the problem by using facts about
implementation of regional regulations on neglected children in particular and with a
study of legislation associated with existing problems.
Social Service Office of Buleleng Regency has authorization as party in
charge in providing services for social sector, especially neglected children by
conducting routine coaching and service while guaranteeing the protection of
neglected children in Buleleng Regency. Obstacles that occur in implementing
Regional Regulation No. 4 of 2016 are due to lack of clear and synergic guidance,
direction and authority between the Office of Social Affairs and other parties that
involved in low economic condition in community, weak public awareness in
complying with Regional Regulations, neglected children which troubles community
because of legal actions, and lack of solid cooperation between the Social Service
Office and all elements of the community, especially the local custom. From
description above can be concluded that the authority of the Social Service in
implementing Regional Regulation No. 4 of 2016 concerning Child Protection in
Buleleng Regency against neglected children has not been maximally achieved
because the law does not explicitly regulate neglected children, and needs on
improving quality and quantity of Office Social workers especially in the field of
child social services so that neglected children can be guided completely.
