Scope of Work
Based upon discussion and plans provided at the recent project scoping session, it is the Community Development
Department’s understanding that a prospective property owner wishes to construct an approximately 7,000 square foot
metal agricultural building on the site for storage and processing and use approximately 5 acres of the site to cultivate
marijuana outdoors. Outdoor cultivation will be required by Commonwealth regulations to be secured from nearby
premises with two rows of fencing and other security measures. The existing house on site will remain as a single family
dwelling to be occupied by the cultivation facility manager.

Permits Required and Required Submittals


Conservation Commission
There is not yet guidance from MassDEP on the applicability of the agricultural exemptions within the wetlands
protection regulations to marijuana cultivation. However, based on the description of the cultivation operation provided,
such cultivation does seem to meet the intent of said exemptions. It is our recommendation that the applicants work as
diligently as possible to reduce all Riverfront and buffer zone wetlands impact and file for a Request for Determination of
Applicability citing the agricultural nature of the project.

Public Works Department Approvals


The project should consult with Public Works Director Tim Kaiser on any necessary or expanded curb cuts for this project
as well as the condition of the Blair Road Green River Bridge. DPW should be provided with information on the amount
of traffic and weight of trucks involved with deliveries to the cultivation site in order to determine any possible impact
upon this span.

Planning Board
There are no approvals needed from the Planning Board under the current described scope of the project.

Zoning Board Approvals


Special Permits
The Zoning Board of Appeals must grant the project the following Special Permits in order for the proposal to proceed.
• A Special Permit for a MARIJUANA PRODUCTION FACILITY, defined as, An entity licensed by the Cannabis Control
Commission or having received a final certificate of registration from the Massachusetts Department of Public
Health to cultivate and/or obtain, manufacture, process and package marijuana and marijuana products, to
deliver marijuana and marijuana products to marijuana retail establishments and to transfer marijuana and
marijuana products to other marijuana retail establishments, but not to consumers, in accordance with
applicable Massachusetts General Laws.
The submission shall require a completed Application for a Hearing before the Zoning Board of Appeals, and all plans and
narrative as required for a Development Plan Review by the Board.

Development Plan Review


Development Plan Review will be required for this project as it involves the construction of a building in excess of 2,500
square feet. The project requires a Special Permit, therefore the Development Plan will be reviewed by the Zoning Board
of Appeals.

The following submittals are required by the Zoning Board in addition to a completed Application for a Hearing.
The standard Development Plan Review documentation shall be submitted with the application. In accordance with §70-
8.2, the site plan required for development plan review must be prepared by a registered architect, landscape architect,
professional engineer or other approved design professional. The following plans are required; a locus plan as defined by
§70-8.2.C, A site plan as defined by §70-8.2.C, Building Plans defined by §70-8.2.C, Documentation defined by §70-8.2.C.

The following required submittals correspond to Section 5 of the Williamstown Zoning Bylaw, Development Standards, as
well as Section 6 Parking Standards. Evidence of compliance with these standards should be prepared by the project
design team and must be presented to the Zoning Board for Development Plan Review.

o (3) Visual Consequences: This provision requires a developer to considerately treat views from other
properties and public ways in terms of design of the project. Further this requirement calls for
minimization of parking visibility to the maximum extent practicable. The visibility of the cultivation site
is particularly well screened in the summer months but not during winter months. Consideration should
be taken to the design of the security perimeter in order to protect the winter views from Green River
Road. Please demonstrate compliance.

o (4) Access: Please provide information on the traffic that will be generated by the facility.
