MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This MEMORANDUM OF AGREEMENT is made and entered into by and


between:

BENEDICTO COLLEGE - SENIOR HIGH, with School Identification


Number 449024,with principal address A.S. Fortuna Street, Mandaue City
6014, Cebu, represented by its Principal, Abelardo S. Dayao , hereinafter referred
to as the “BC - SH”

-and-

CONVERGYS PHILIPPINES INCORPORATED, a corporation


duly organized and existing under the laws of the Philippines, with office address
at Convergys One Building, Ayala Avenue Corner Salcedo Street, Makati City 1200,
represented by its President and Country Manager, Maria Victoria P. Mueco,
hereinafter referred to as the “HOST TRAINING ESTABLISHMENT” or “HTE”

WITNESSETH:

WHEREAS, the DepEd is the primary government instrumentality


mandated to formulate, implement and coordinate policies, plans, programs and
projects in the areas of non-formal basic education; supervise all elementary and
secondary educational institutions, including alternative learning systems, both
public and private and provide for the establishment and maintenance of a
complete, adequate and integrated system of basic education relevant to the goals
of national development.

WHEREAS, the DepEd has introduced the K to 12 basic education program


that includes Senior High School, hereinafter referred to as “SHS”, with the main
objective of ensuring that graduates of basic education are ready for employment,
entrepreneurship and higher learning;

WHEREA, the SHS curriculum can be customized at the local levels to take
into consideration the needs of local industries and the labor market.

WHEREAS. DepEd believes that for the effective delivery of SHS instruction,
there is a need for school-industry partnerships that will provide the school the
necessary expertise and venue for practical, on-the job, enterprise based training for
SHS students;

WHEREAS, BC - SH is among those that will offer SHS to students in the


community to carry out DepEd’s objectives for SHS as spelled out above.

WHEREAS, the students of BC - SH are under the Technical/Vocational and


Livelihood (TVL), strands and are on their 2nd year are required to undertake work
immersion as part of the requirements for their graduation;

WHEREAS, the HTE, in its concern to enhance the knowledge, skills,


attitudes, and values of prospective professionals, is committed to support student
work immersion programs of higher education institutions and has agreed to
provide the necessary training for work immersion student of BC - SH;

WHEREAS, the DepEd designed the implementation of Enhanced Basic


Education Act of 2013 or RA 10533 for all programs with practicum subject, and the
same must be complied with by both BC – SH and the HTE;

NOW, THEREFORE, for and in consideration of the foregoing premises, BC


– SH and the HTE hereby agree on and stipulate the following:

A. RESPONSIBILITIES/OBLIGATION OF BC – SH

BC – SH under this work immersion program shall have the following


obligations and/or responsibilities:

1. Formulate local work immersion policies and guidelines on selection,


placement, monitoring, and assessment of work immersion students;

2. Pre-qualify wok immersion students in accordance with the


guidelines of the HTE in recruitment and selection and the guidelines specified in
the preceding paragraph;

3. Develop, in collaboration with the HTE, a Student Work Immersion


Training Manual which will specify the goals and objectives (desired outcomes and
how these outcomes will be achieved), knowledge, skills, attitudes and
competencies that the work immersion student should acquire in each learning
area, assignments and schedule of activities, among others;

4. Designate a Work Immersion Teacher of the work immersion course


who will be responsible for all aspects of the wok immersion program including its
implementation, monitoring and evaluation;

5. Issue an official endorsement of the pre-qualified students who may


be allowed to submit their application for work immersion to the HTE.

6. Monitor the work immersion students and attend to their needs and
concerns by coordinating with the HTE, the DepEd, and other concerned
government authorities if necessary;

7. Furnish the HTE with the evaluation system as basis for the
evaluation of the performance of wok immersion students;

8. Evaluate, through the Work Immersion Teacher and in accordance


with the Training Manual, the performance of the work immersion students jointly
with the HTE and the Work Immersion Focal;

9. Conduct general orientation for qualified work immersion students


and their parents/guardians, which include basic orientation on work values,
behavior and discipline to ensure smooth cooperation with the HTE;

10. Conduct, through the Work Immersion Teacher or the School


Principal, regular visits or inspections of the HTE to ensure safety of the work
immersion students;

11. Assume responsibility in the submission of documentation
requirements to DepEd, among others, as required by the Enhanced Basic
Education Act of 2013 or RA 10533;

12. Issue to the HTE a Certificate of Appreciation for providing training


to work immersion students upon the completion of the work immersion program.

B. RESPONSIBILITIES/OBLIGATION OF CONVERGYS

The HTE under this work immersion program shall have the following
obligations and/or responsibilities:

1. Formulate company work immersion policies and guidelines on


recruitment, selection and placement of wok immersion students;

2. Undertake the selection process of the pre-qualified work immersion


students in accordance with the guidelines specified in the preceding paragraph;

3. Facilitate the processing of the documents of the pre-qualified and


qualified work immersion students in coordination with BC – SH.

4. Provide for the Training Contract which shall be signed by the work
immersion student, the HTE, and BC – SH;

5. Assign a Program Coordinator who will be responsible in


coordinating the various activities under this program in accordance with the
Training Manual;

6. Conduct orientation of work immersion students about the HTE


Company and about their assignments, duties and responsibilities;

7. Ensure that the work immersion students are given activities and are
assigned to handle specific job assignment which are within the frame work of the
Training Manual;

8. Ensure a safe and conducive working environment for the work


immersion students;

9. Evaluate, through the Program Coordinator, the performance of work


immersion students in accordance with the evaluation system provided by BC – SH;

10. May provide or grant allowance on purely voluntary basis to work


immersion students in accordance with the HTE’s existing wok immersion policies
and guidelines;

11. Conduct a post training review and evaluation of the work


immersion program and the performance of the work immersion students as
well as BC – SH;
12. Issue a Certificate of Completion for the work immersion students
who successfully completed the training under the Training Manual two weeks
after the completion of the work immersion program.

C. DISCIPLINE AND CONDUCT OF WORK IMMERSION STUDENTS

In the maintenance of discipline and orderly conduct of work immersion


students, the following shall be enforced:

1. BC – SH shall ensure that any work immersion student found guilty of


violating any of the provisions in Enhanced Basic Education Act of 2013 or RA
10533 in relation to his enrollment and application to the work immersion program
shall be subjected to DepEd’s and BC – SH’s disciplinary policies;

2. BC – SH, through the Work Immersion Teacher, shall ensure that the
work immersion student complete the agreed scope of work in accordance with the
Training Plan within the agreed duration of the program;

3. A report of alleged misconduct or misbehavior by a work immersion


student in defiance to existing standards, rules, and regulations of the HTE must be
endorsed by the Program Coordinator to the Work Immersion Teacher. Any action
or investigation that will ensue shall mainly be the responsibility of the Work
Immersion Teacher and BC – SH;

4. BC – SH shall voluntarily withdraw a work immersion student who is


found to misbehave and/or act in defiance to existing standards, rules, and
regulations of the HTE and impose necessary disciplinary sanctions to the said wok
immersion student.

D. NO EMPLOYEE-EMPLOYER RELATIONSHIP

No employer-employee relationship exists between the HTE and the wok


immersion student. This work immersion program does not also create any
obligation on the part of the HTE to employ the work immersion student after the
completion of the training.

E. CONFIDENTIALITY

It is expressly understood by BC – SH and the wok immersion students that


all information on technology, process standards, quality assurance methodologies,
quality standards, marketing, finance, manuals, and all other business and technical
information or data that the HTE shall make available to them shall be used for the
sole purpose of work immersion students’ training under this work immersion
program. The abovementioned matters are classified as confidential information
and are properties of the HTE. BC – SH shall ensure that the work immersion
students undertake to prevent transfer of confidential information to any person.

F. WAIVER OF LIABILITY

BC – SH, the work immersion students and the latter’s parents or guardians
renounce and waive any claim against the HTE, its directors and officers, for any
and all claims or liability arising from any injury, loss or accidents, without any
fault or negligence on the part of the HTE, that work immersion students may
sustain or may suffer, whether personal or pecuniary, as a result of their

participation in the work immersion program. The waivers of work immersion
students and their parents or guardians shall be submitted to the HTEprior to the
commencement of the training.

G. DURATION, EFFECTIVITY AND TERMINATION

1. This AGREEMENT shall be valid for the duration of the Academic


School Year 2017of BC – SH, and is automatically renewable every semester, unless
otherwise revoked, cancelled, or terminated by either party for violation of any of
the conditions above set forth or any of the provisions under Enhanced Basic
Education Act of 2013 or RA 10533, effective upon notice to the other party.

2. The partiesreservetheir respective rights to withdraw their


participation in the Agreementupon written notice. The party seeking the
termination of the Agreement must give a written notice to the other party at least
30 days before the effective date of the termination. In any case, however, the work
immersion students shall be allowed to complete the work immersion program
with the HTE and the latter shall comply with its responsibilities under this
Agreement until the completion of the wok immersion student’s training.

IN WITNESS WHEREOF, the parties hereunto affixed their signatures this
