People vs. Reyes (G.R. No. 135682)

Facts: The plaintiff-appellee is the People of the Philippines. The accused-appellant is Danilo
Reyes. In the case at bar, on October 12, 1997, PO1 Eduardo C. Molato of Western Police
District, Sampaloc, Manila was on his way home on board a passenger jeepney. As he alighted at
the corner of Lapu-lapu St. and Northbay Blvd. he saw the herein victim being held up by two
persons. One of which was in front of the victim and forcibly took his wristwatch. The other one
stabbed him at the back. He then fired one warning shot which caused the three to run towards
Phase I, Lapu-lapu Avenue. He was supposed to chased them but as soon as he saw the victim,
he hailed a tricycle and asked the driver to bring the victim to the nearest hospital. He then
proceeded to chase the suspects up to Phase II until he reached Agora, but the suspects were
gone. The incident happened swiftly but PO1 Molato had a good look at the face of the one who
stabbed the victim as he was about 8 to 10 meters away from them. The trial court found the
accused guilty of the crime of Robbery with Homicide.

Issue: Is the appellant guilty of Robbery with Homicide.

Held: The Supreme Court said that the accused is guilty of Robbery with Homicide. The
robbery was consummated as they use force and intimidation upon the victim and unlawfully
taking the property of another with intent to gain. And since homicide was committed in the
occasion and by reason thereof, the crime of Robbery with Homicide is consummated.
