TOPIC A

REPERCUSSIONS OF THE IRAN DEAL

The delegation of The French Republic gives a cordial greeting to the chair, and all
the present delegates of this forum. In the name of Emmanuel Macron, the nation
recognizes the importance of the next topic: Repercussions of the Iran Deal.

In regard of the Joint Comprehensive Plan of Action adopted by resolution 2231 by


the United Nations Security Council, the 20th of July of 2015, The French Republic
endorses the full implementation and continuity of the plan of action already stated with
Iran, and strongly confirms the benefits it has brought to global peace and commitment.

During the creation of the Iran Deal, France maintained a static position in the
matter. The delegation was constantly supporting the needs of the Security Council to get to
a resolution, following a policy of “constructive firmness”. This firmness was constantly
used in the forging of the Possible Military Dimensions (PMD), and continued until
ratification of the “Joint Comprehensive Plan of Action”, which endorsed the fact of
nuclear transparency in Iran, and the continuing cooperation with the country.

One of France's main objectives with this resolution is to follow the Charter of The
United Nations. Considering by de facto being to protect the statutes mentioned and hereby,
respecting the Treaty on the Nonproliferation of Nuclear Weapons by the International
Atomic Energy Agency, France agreed to use Nuclear Technology in the means of peace
scientific advances, being the turning point on the Joint Comprehensive Plan of Action
drafted by the P-5+1.

The main projected repercussions for the JCPOA is the regulation on nuclear
matters in hand with the OIEA, and thereby to protect nearby states of possible nuclear
confrontation. As France is deeply concerned with the follow up of Ginebra conventions
agreements on human rights, will express its ideals to protect international security from a
humanitarian crisis. France seeks to avoid any kind of future violation of Charter of the
United Nations Security Council, chapter VII, being subject to future apprehension and
sanction regarding to noncompliance of both the Charter and the Resolution.

France emphasizes the sanctions stated in the JCPOA, and fully agrees for their
implementation in the case of a perpetual violation to the previously arranged treaty. The
delegation also seeks for a more consistent fulfilment of the treaty and the agreements,
being a full obligement its complement, and sanctioning in the minimal case of
nonattainment of the matter. Also invites all the delegation to pursue an implementation
against the consistent use of heavy weaponry regarding the already mentioned agreements.

TOPIC B

SENKAKU ISLANDS DISPUTE

The delegation of The French Republic gives a cordial greeting to the chair, and all
the present delegates of this forum. In the name of President Emmanuel Macron, the nation
recognizes the importance of the next topic: Senkaku islands dispute. “My real adversary
has no name, no face, no party. It will never be elected, yet it governs - the adversary is the
world of finance.”- François Hollande, President of France.

The French Republic being deeply concerned of the problematic of what the dispute
follows, will begin by defining sovereign occupation. According to the department of law
of the University of Pennsylvania sovereign occupation is when the sovereign (the ruling
power of the state), occupies a territory with demonstration to effectively occupy. By
means of effective, it can be understandable as the action to act as sovereign and to exercise
sovereign authority.

The dispute has its roots since 1971, when China argued its first protest against
Japanese occupation of the islands. China urged the United Nations and International Legal
forums to analyze the legal basis of the annexation of the islands to the state of Japan,
which legally took place in 1895. This annexation was made with an exploration to the
island, which showed “Terra nullius”, meaning there was no present sovereign occupation
on the island. Following to the second world war, with the Cairo and Potsdam declarations,
the territories of Taiwan and Pescadores Islands, were given back to their original
sovereign, China. In this declaration, the Senkaku islands were not included, as they were
not received by any means of war, but by a legal-annexation. It was not until 1968 when the
United Nations Economic commission for Asia suggested the presence of hydrocarbons
like oil and natural gases, were found beneath the Senkaku Islands, being taken as a base by
China to protest the sovereignty of these islands, because of the economic importance they
reflected.

According to the Customary International Law of Territorial Acquisition, three of


the five models of Territorial Acquisition can be applicable on this dispute, being discovery
and occupation, cession, and precipitation. Guided by these models, France acknowledges
the process of justice to be taken, and how the forum must attain to these three principles.

France emphasizes the right use of International Law in regards of the sovereign
land dispute, being taken into account the statutes of Territorial Acquisition and the Chapter
VI Of the Charter of the United Nations, to get to an end. Complementing, urges all the
present delegations the implementation of a Joint Development Zone, with a joint authority
model. For today, oil companies of both countries, have been eager to co-work in the East
China Sea, with this the joint authority model, can work as an extensive cooperation of both
countries to proportionally manage the available natural resources of the Senkaku Islands.
