CREATION OF MUNICIPAL PROJECT MONITORING COMMITTEE

WHEREAS, Executive Order No. 376 and Executive Order No. 93 as amended provide
for the creation of Project Monitoring Committee (PMC) at the provincial, city and municipal
levels;

WHEREAS, there is a need to organize the PMC to monitor and evaluate the
implementation of various local government projects funded from national government and local
government funds including foreign assisted project/s whether grant or loan;

WHEREAS, the PMC in the execution of its duties and functions shall develop an
overall Monitoring and evaluation system designed by National Economic Development
Authority (NEDA);

NOW THEREFORE, I, JOSE ANTONIO T. FELICIANO, Mayor of the Municipality of


Bamban, by virtue of the power vested in me by law do hereby order the creation of the Project
Monitoring Committee.

Section 2. Functions of PMEC

a. Provide a system for the integration, coordination, and linkage of all monitoring activities
in the municipality;
b. Process and provide up-to-date information on the overall status of project
implementation of each department for planning and decision making;
c. Identify problems/issues which impede project implementation for remedial actions and
to elevate unresolved issues and problems to the Office of the Mayor for resolution and
final action through the Office of the Mayor, as appropriate;
d. Provide information on lessons learned in project implementation for planning and
implementation of future similar projects;
e. Assess and ascertain whether projects implemented are supportive of provincial
development goals and plans as well as national development thrusts and priorities;
f. Present the consolidated Monitoring and Evaluation Report to provide the Local Chief
Executive (LCE) management information regarding the implementation of the
AURORA GEMS Development Agenda; and
g. Submit quarterly monitoring and evaluation report to the LCE for action.

Section 3. Meeting.

a. The PMC shall hold a regular quarterly meeting to discuss the problems and issues
affecting the implementation of various programs and projects and remedial actions to be
elevated to the management committee;

Section 4. Funding.

a. Funds for various PMC activities which include trainings, coordination, meetings, and
preparation of reports among others shall be allocated by the provincial government to
ensure the efficient operation of the committee.

Section 5. Effectivity. This Executive Order shall take effect immediately.

ORGANIZING THE PROJECT MONITORING COMMITTEE (PMC) TO CONFORM
WITH DILG MEMORANDUM CIRCULAR NO. 2004-78:

WHEREAS, The Department of Interior and Local Government issued Memorandum


Circular No. 2004-78 dated June 22, 204 on the Organization/Reactivation of PMCs in the Local
Government Units;
WHEREAS, Executive Order No. 376 s. 1989 as amended by EO 93 s. 1993, established
the Regional Project Monitoring System (RPMES) to facilitate project implementation and
devolve facilitation, problem-solving, monitoring and evaluation of foreign, national and locally-
funded projects to the sub-national levels;

WHEREAS, the RPMES is to be implemented by the development councils or planning


boards at the regional, provincial, city and municipal levels;

WHEREAS, the aforementioned EOs state the PMCs originally established as the
monitoring arm of the Local Government Councils under Memorandum Circular No. 175 dated
May 23, 1988 were to operationalize the RPMES at the sub-regional level;

NOW THEREFORE, I, JOSE ANTONIO T. FELICIANO, Municipal Mayor of


Bamban, by virtue of the powers vested in me by law, in consonance with the provisions of
Memorandum Circular No. 2004-78, do hereby organize the Project Monitoring Committee

RESPONSIBILITIES OF PMC:

1. Monitoring of the projects funded by the Grassroots Participatory Planning and


Budgeting (GPPB), formerly the Bottom-up budgeting, which is being undertaken by
the Poverty Reduction Action Team (PRAT);
2. Monitoring of foreign and nationally-funded projects including development projects
funded from the Internal Revenue Allotment (IRA) share of LGUs or supported by
funds released directly to the municipality and projects funded from locally-generated
resources which are implemented within their respective areas.

WHEREAS, the threat to peace and order posed by criminality, insurgency and
subversion requires the dedicated efforts of all government officials and citizens;

WHEREAS, it is the duty of local governments, the law enforcement agencies, the
prosecution services, and similar institutions of Government to assist the Chief Executive in the
proper enforcement of the laws and the administration of justice;

WHEREAS, Government efforts at peace and order need to be fully coordinated to


effectively prevent and suppress criminality and to maintain public order and safety in the land;

WHEREAS, the participation of the citizenry in peace and order is of critical importance;

DUTIES AND RESPONSIBILITIES OF MPOC:

(a) Formulate plans and recommend such measures which will improve or enhance peace
and order and public safety in their respective areas of responsibility.
(b) To monitor the implementation of peace and order programs and projects at municipal
levels and the operation of Civilian Volunteer Self-Defense Organizations and such other
counter-insurgency programs and activities.
(c) Make periodic assessments of the prevailing peace and order situation in their respective
areas of responsibility and submit a report thereon with recommendations to the
Chairman of the National Peace and Order Council.
(d) Perform all other functions assigned by law, the President, or the National Peace and
Order Council.

ESTABLISHING OF HUMAN RIGHTS ACTION CENTER (HRAC) AND CREATION


OF HUMAN RIGHTS ACTION TEAM (HRAcT) OF THE MUNICIPALITY OF
BAMBAN, PROVINCE OF TARLAC

WHEREAS, Article II, Section 11 of the 1987 Constitution of the Republic of the Philippines,
provides that the state values the dignity of every human person and guarantees full respect for
human rights;

WHEREAS, the Department of Interior and Local Government (DILG) and Commission on
Human Rights Joint Memorandum Circular No. 1 Series of 2014 with subject “Mainstreaming
Human Rights through Rule of Law and Access to Justice at the level of Provinces, Cities,
Municipalities and Barangays” mandates the establishment of Human Rights Action Center
(HRACs) in every province, city, and municipal LGU;

WHEREAS, the Municipality of Bamban , Tarlac recognizes the need for a Human Rights
Action Center that will ensure the performance of its duties to respect, protect and fulfill human
rights within jurisdiction;

NOW, THEREFORE, I, JOSE ANTONIO T. FELICIANO, Municipal Mayor of Bamban,


Tarlac, by virtue of the powers vested in me by law, do hereby order the establishment of Human
Rights Action Center (HRAC) and the creation of Human Rights Action Team (HRAcT) in the
Municipality of Bamban, with the following composition and functions:

Section 1. ESTABILISHMENT OF HUMAN RIGHTS ACTION CENTER (HRAC) – The


Human Rights Action Center is hereby established to act on human rights matters, including
human rights promotion and complaints of human rights violations.

Section 2. CREATION OF HUMAN RIGHTS ACTION TEAM (HRAcT) – the Human


Rights Action Team is hereby created to ensure that the Municipal Government of Bamban,
Tarlac operates in a human rights-based manner.

Section 3. COMPOSITION OF HRAcT- The Human Rights Action Team (HRAcT) of the
Municipality of Bamban, Tarlac shall be composed of the following:

ACTION TEAM (MHRAcT)

a. Provides technical inputs on human rights to the Municipal Human Rights


Committee;
b. Consolidates Semestral Human Rights Situationer Reports and have it published in
the Municipal website, newsletter and bulletin board.
c. Assist the BHRAcTs in referral of complaints of human rights violations to CHR
Regional Offices and other appropriate agencies and monitors their status thereof; and
d. Conducts of human rights advocacy, information and education activities.

Section 5. The Secretariat shall be composed of representative from the office of the Mayor,
Municipal Planning and Development Office and Municipal Social Welfare and Development
Office.

Section 6. DUTIES AND RESPONSIBILITIES OF SECRETARIAT.

a. Receives, consolidates and prepares Annual Human Rights Situationer/Report


submitted by the BHRAcTs;
b. Prepares minutes of the meeting;
c. Assist in coordinating Human Rights matters with concerned agencies;
d. Establish and maintain database of Human Rights Reports;
e. Maintain and update a directory of HRAcTs within its jurisdiction;
f. Facilitates the Administrative concerns of the HRAcTs; and
g. Prepare updates of the complaints, received and referred by BHRAcTs.

Section 7. EFFECTIVITY, this order shall be effective immediately.

RECONSTITUTING THE LOCAL GOVERNMENT PERFORMANCE MANAGEMENT


SYSTEM (LGPMS) TEAM AND ITS TECHNICAL WORKING GROUP (TWG)

WHEREAS, the Department of the Interior and Local Government (DILG) developed the Local
Government Performance Management System (LGPMS), a web-based system that has the
ability to produce information on the state of local governance performance, and the state of
local development, using governance and development indicators;

WHEREAS, the LGPMS, for berivity, serves as a robust on-line national information system on
local government; and is a self-assessment, management and development tool that enable local
governments to determine their capabilities and limitations in the delivery of essential public
services;

WHEREAS, data on the five (5) areas of governance name: Administrative Governance; Social
Governance; Economic Governance; Environmental Governance and Valuing Fundamentals of
Good Governance is to be collected by the Municipal Planning and Development Office
(MPDO) from various line agencies of the local government using the Data Capture Forms
designed by the DILG and to be encoded on-line at the DILG-LGPMS website by the said office;

WHEREAS, DILG Memorandum Circular No. 2012-23, series of 2012, sets up the process for
the full implementation of LGPMS

AN ORDER ESTABLISHING THE BUSINESS ONE STOP SHOP (BOSS)


IN THE MUNICIPALITY OF BAMBAN

WHEREAS, pursuant to DILG-DBM Joint Memorandum Circular No. 1 Series of 2010,


providing for guideline in the implementation of standards in processing business permits and
licenses in all cities and municipalities, the direction to conform to standard forms, patterns and
procedures befalls this Local Government Unit in the above-indicated undertaking;

WHEREAS, Section 6.1 of the above memorandum circular vests on Local Chief
Executives the burden of implementation of Business Permits and Licensing (BPLS) in their
respective areas of concern;

WHEREAS, this Local Government Unit is committed towards efficiency and the
elimination of bureaucratic red tape, and the yearly undertaking of renewal of business licenses
and permits plays a significant role in the economic well-being of the municipality;

amended, or repealed by subsequent issuance.

SECTION 4. REPEALING CLAUSE

Orders and regulations and other issuances or parts hereof which are inconsistent with this order
is hereby repealed or modified accordingly.

RE-ORGANIZING THE MUNICIPAL DISASTER RISK REDUCTION AND


MANAGEMENT COUNCIL

WHEREAS, in order to uphold the people’s constitutional rights to life and property,
there is a need to address the root causes of vulnerabilities to disasters, strengthening the
country’s institutional capacity for disaster risk reduction and management and building the
resilience of local communities to disasters including climate change impacts,

WHEREAS, in order to provide the maximum care, assistance and services to


individuals and families affected by disasters, implement emergency rehabilitation projects to
lessen the impact of disaster, and facilitate resumption of normal social and economic activities,
the local Government of Bamban under the leadership of Mayor JOSE ANTONIO T.
FELICIANO has adopted a disaster risk reduction and management approach that is holistic,
comprehensive, integrated and proactive in lessening the socioeconomic and environmental
impacts of disasters including climate change, promote the involvement and participation of all
sectors and all stakeholders concerned, at all level, especially the local community.

WHEREAS, pursuant to Section 11 of REPUBLIC ACT NO. 10121 otherwise known at


the Philippine Disaster Risk Reduction and Management Act of 2010, provides that:

SECTION 11. Organization at the Local Government Level. The existing Provincial, City, and
Municipal Disaster Coordinating Council shall henceforth be known as the Provincial, City, and
Municipal Disaster Risk Reduction and Management Councils. The Barangay Disaster
Coordinating Councils shall cease to exist and its power functions shall henceforth be assumed
by the Barangay Development Councils (BDCs) which shall serve as LDRRMCs in every
barangay.

NOW, THEREFORE, I, JOSE ANTONIO T. FELICIANO Mayor of the


Municipality of Bamban, Province of Tarlac, pursuant to the pertinent provisions of REPUBLIC
ACT NO. 10121 otherwise known as the Philippine Disaster Risk Reduction and Management
Act. Of 2010 and by virtue of the powers vested in me by the law do hereby order;

SECTION 1. establishment of the Municipal Risk Reduction and Management Council.


Henceforth, the Municipal Disaster Coordinating Council of Bamban, Tarlac shall henceforth be
known as the Municipal Disaster Risk Reduction and Management Council (MDRRMC-
Bamban, Tarlac). The MDRRMC shall coordinate, integrate, supervise, and evaluate all local
policies, programs and other activities related to disaster reduction. It shall be responsible in
ensuring disaster sensitive municipal and barangay development plans, and in case of
emergencies shall convene the different municipal line agencies and concerned institutions and
authorities.

WHEREAS, the new RA 10121 IRR Rule 7 (h) “Philippine Disaster Risk Reduction and
Management Act of 2010” provided for the establishment of an Incident Command System
(ICS) as part of the country’s institutional capacity for disaster risk reduction and management
and building the resilience of local communities to disasters including climate change impacts,

WHEREAS, the new law mandates the provision of emergency services and public assistance
during or immediately after a disaster in order to save lives, reduce health impacts, ensure public
safety and meet the basic subsistence needs of the people affected;

WHEREAS, the new law has restructured the roles of key players during disaster giving local
government units the capacity to manage disaster as “first responders and manage the adverse the
effects of emergencies and carry out recovery activities”;

WHEREAS, in the implementation of such roles requires the structuring of an incidence


command system that will govern responses and appropriate actions for pre-disaster, during
disaster and post disaster responses;

NOW THEREFORE, I, JOSE ANTONIO T. FELICIANO, Municipal Mayor of Bamban by


virtue of the powers vested in me by law do hereby order the CREATION OF THE
MUNICIPAL INCIDENT COMMAND SYSTEM (MICS) STRUCTURE, ITS

THE OPERATIONAL PLANNING CYCLE – The Incident Command System will follow the
standard operational planning cycle from incident/event, notification, initial response and

Purpose : Ensure safety and security of the affected families including personal
properties and belongings and maintain peace and order situation at the site.

WHEREAS, Republic Act No. 9208 declares that the state shall give highest priority to the
enactment of measures and development of programs that will promote human dignity, protect
the people from violence and exploitation, eliminate trafficking in persons and mitigate pressures
for involuntary migration and servitude of persons to ensure their recovery, rehabilitation, and
reintegration.

WHEREAS, Republic Act No. 9262, underscores the commitment of the State on safeguarding
the dignity of women and children while guaranteeing full respect of their human rights to
protect them from violence and threats to their personal safety and security.

WHEREAS, Joint Memorandum Circular No. 2010-1 seeks to provide the basic standards for
establishing the local committees on anti-trafficking and VAWC.

CREATING LGU MECHANISM IN HANDLING VIOLENCE AGAINST WOMEN


(VAW)
CASES FILED IN BARANGAYS

WHEREAS, the State condemns discrimination against women in all its forms and pursues by all
appropriate means and without delay the policy of eliminating discrimination against women in
keeping with the Convention of the Elimination of all Forms of Discrimination Against Women
(CEDAW) and other international instruments consistent with Philippine law.

WHEREAS, Joint Memorandum Circular No. 2010-2 is jointly issued by the Department of
Interior and Local Government (DILG), the Department of Social Welfare and Development
(DSWD), the Department of Health (DOH), the Department of Education (DepEd) and the
Philippine Commission on Women (PCW), pursuant to Section 12 D.2 of the Implementing
Rules and Regulations of RA9710.

NOW THEREFORE, I, JOSE ANTONIO T. FELICIANO, Municipal Mayor of Bamban, by


virtue of the powers vested in me by law, do hereby create the mechanism in handling violence
against women cases filed in barangays, as follows:

Section 1. All Punong Barangay shall designate an area within the barangay hall for the
VAW desk. The Punong Barangay shall provide for the necessary furniture and fixtures such as,
but not limited to , table, chairs, separate filing cabinet and log book for record-keeping of cases.
Likewise, the Punong Barangay shall ensure the confidentiality of the case and privacy and
safety of the victim-survivor.

Section 2. The Punong Barangay should designate a VAW Desk Person who is trained in
gender-sensitive handling of cases; preferably a woman barangay kagawad or woman barangay
tanod.

Section 3. The VAW Desk shall perform the following tasks:

3.1 respond to gender-based violence cases brought to the barangay;


3.2 record the number of gender-based violence handled by the barangay and submit a
quarterly report on all cases of VAW to the DILG Municipal Field Office and the
Municipal Social Welfare Development Office;
3.3 Keep VAW case records confidential and secured, and ensure that only authorized
personnel can access it;
3.4 Assist victims of VAW in securing Barangay Protection Order (BPO) and access
necessary services;
3.5 Develop the barangay’s gender-responsive plan in addressing gender-based violence,
including support services, capacity building and referral system;
3.6 Coordinate with and refer cases to government agencies, non-government
organizations (NGOs), institutions and other service providers as necessary;
3.7 Address other forms of abuse committed against women, specially senior citizens,
women with disabilities and other marginalized groups;
3.8 Lead advocacies on the elimination of VAW in the community; and
3.9 Perform other related functions as may be assigned.

Section 4. Protocol in Handling VAW Cases at the Barangay Level

4.1 A VAWC (RA 9262) victim-survivor is accompanied by someone to the barangay or


the victim herself goes to the barangay.
4.1.1 Make the woman (and children, if applicable) comfortable in a safe and
private room giving her water and other immediate needs, if any;
4.1.2 Assess the situation and get initial information to determine the risks on hand
and if immediate medical attention is needed. If so, facilitate referral to the
nearest medical facility;
4.1.3 After the victim-survivor has stabilized, assist the Punong barangay/kagawad
in the conduct of an investigation in a gender-sensitive and non-judgmental
manner in a language understood by her;
4.1.4 Inform her of her rights and the remedies available and the processes involved
particularly in relation to the BPO. Assist her to file application, if she
decided to have a BPO;
4.1.5 Record the incident using the National VAW Documentation System
Barangay Form;
4.1.6 If victim-survivor desires to be in a safe shelter, seek the assistance of the
other barangay officials, barangay tanod or the police in getting her
belongings and refer to a shelter/women’s center or to the MSWDO;
4.1.7 Assist the victim-survivor to file for a temporary protection order (TPO) or
permanent protection order (PPO) with the nearest Family Court within 24
hours after issuance of the BPO, if the victim-survivor so desires or she
applies directly for a TPO/PPO instead of a BPO.
4.1.8 Report the incident within four hours to the PNP and the MSWDO.

4.2 A victim-survivor of VAWC is reported by a community member.


4.2.1 Verify the information and if needed, seek assistance from the PNP;
4.2.2 Assess the situation and facilitate the rescue of the victim-survivor when
necessary to ensure her safety, and when applicable the safety of her children;
4.2.3 Inform the victim-survivor about her rights and remedies available
particularly the BPO and its processes. Assist her to apply for a BPO, if she
so desires;
4.2.4 Refer victim-survivor for medical care and temporary shelter and other needs
when needed based on the assessment done;
4.2.5 Record the incident using the National VAW Documentation System
barangay form.
4.2.6 If not done earlier, report the incident within 4 hours to the PNP and the
MSWDO.
4.3 For rape, trafficking in persons and other cases which do not fall under the
jurisdiction of the barangay, assist the victim-survivor to file a complaint at the PNP
Women and Children Protection Center or the National Bureau of Investigation
(NBI).

5. Effectivity. This Executive Order shall take effect immediately.

formulation of their local tourism development plans to give due regard to the conservation of
natural endowments and preservation of cultural heritage while according opportunity for local
communities to achieve a better quality of life;

WHEREAS, in order to uphold the people’s constitutional rights to life and property,

sectors and all stakeholders concerned, at all level, especially the local community.

WHEREAS, pursuant to Section 11 of REPUBLIC ACT NO. 10121 otherwise known at


the Philippine Disaster Risk Reduction and Management Act of 2010, provides that:

SECTION 11. Organization at the Local Government Level. The existing Provincial, City, and
Municipal Disaster Coordinating Council shall henceforth be known as the Provincial, City, and
Municipal Disaster Risk Reduction and Management Councils. The Barangay Disaster
Coordinating Councils shall cease to exist and its power functions shall henceforth be assumed
by the Barangay Development Councils (BDCs) which shall serve as LDRRMCs in every
barangay.

WHEREAS, pursuant to the Joint Memorandum Circular No. 2014-1 dated April 4,
2014 known as the Implementing Guideline for the Establishment of Local DRRM Offices
(LDRRMOs) or Barangay DRRM Committees (BDRRMCs) in Local Government Units (LGUs)

NOW, THEREFORE, I, JOSE ANTONIO T. FELICIANO Mayor of the


Municipality of Bamban, Province of Tarlac, pursuant to the pertinent provisions of REPUBLIC
ACT NO. 10121 otherwise known as the Philippine Disaster Risk Reduction and Management
Act. Of 2010 and by virtue of the powers vested in me by the law do hereby order that RET.
PCI ELENO MANGROBANG is hereby designated as MUNICIPAL DISASTER RISK
REDUCTION AND MANAGEMENT OFFICER of the Municipality of Bamban.

Bamban, Tarlac). The MDRRMC shall coordinate, integrate, supervise, and evaluate all local
policies, programs and other activities related to disaster reduction. It shall be responsible in
ensuring disaster sensitive municipal and barangay development plans, and in case of
emergencies shall convene the different municipal line agencies and concerned institutions and
authorities.

SECTION 2. Composition- the MDRRMC of Bamban, Tarlac shall be composed of, but not

WHEREAS, the new RA 10121 IRR Rule 7 (h) “Philippine Disaster Risk Reduction and
Management Act of 2010” provided for the establishment of an Incident Command System

and building the resilience of local communities to disasters including climate change impacts,

WHEREAS, the new law mandates the provision of emergency services and public assistance
during or immediately after a disaster in order to save lives, reduce health impacts, ensure public
safety and meet the basic subsistence needs of the people affected;

WHEREAS, the new law has restructured the roles of key players during disaster giving local
government units the capacity to manage disaster as “first responders and manage the adverse
effects of emergencies and carry out recovery activities”;

WHEREAS, the implementation of such roles requires the structuring of an incidence


command system that will govern responses and appropriate actions for pre-disaster, during
disaster and post disaster responses;

WHEREAS, Republic Act No. 9208 declares that the state shall give highest priority to
the enactment of measures and development of programs that will promote human dignity,
protect the people from violence and exploitation, eliminate trafficking in persons and mitigate
pressures for involuntary migration and servitude of persons to ensure their recovery,
rehabilitation, and reintegration.

WHEREAS, Republic Act No. 9262, underscores the commitment of the State on
safeguarding the dignity of women and children while guaranteeing full respect of their human
rights to protect them from violence and threats to their personal safety and security.

WHEREAS, Joint Memorandum Circular No. 2010-1 seeks to provide the basic
standards for establishing the local committees on anti-trafficking and VAWC.

AN EXECUTIVE ORDER MANDATING THE USE OF PRE-EMPTIVE


AND FORCED EVACUATION GUIDELINES DURING EMERGERCY
SITUATIONS CAUSED BY NATURAL OR MAN-MADE DISASTERS
AND PROVIDING GUIDELINES THEREOF.

WHEREAS, the Municipality Government of Bamban has been subjected to and


affected by the adverse impacts of recurrent natural disaster brought about by climate change, as
well as, man-made disasters and emergencies.

WHEREAS, the geographical location of the Municipality makes it vulnerable to flood,


tropical cyclones, extreme rainfall, fire, earthquake and other hazards which bring havoc to life
and property, causing disruption to the normal lives of its inhabitants;

WHEREAS, said natural disasters have always posed real danger to lives and well-being
of the residents of Bamban and their properties;

WHEREAS, pursuant to Republic Act No. 10121, the LDRRMC, is tasked to develop
policies and plans, and the implementation of actions and measures pertaining to all aspects of
disaster risk reduction and management, which includes good governance, risk assessment and
early warning, knowledge building and awareness raising, reducing underlying risk factors, and
preparedness for effective response and early recovery; and perform such duties and functions
for the general welfare of the city and its inhabitants;

WHEREAS, in order to safeguard, preserve and protect the lives, well-being and health
of the inhabitants of the Municipality as well as their properties and minimize the adverse
impacts of hazard and related disasters, the necessary mitigating measures should be employed;

WHEREAS, it is highly recognized that a guideline on pre-emptive and forced


evacuation should be implemented within the municipality, to better facilitate, mitigate and
ensure maximum safety and survival before and during the occurrence of an emergency or
disaster;

NOW, THEREFORE, I , JOSE ANTONIO T. FELICIANO, Mayor of the


Municipality of Bamban, by the virtue of the powers vested in me by law and the Constitution,
and concurrent chairman of the Municipal Disaster Risk Reduction and Management Council
hereby order the implementation of the Pre-Emptive and Forced Evacuation Guidelines of
Bamban, to wit:

SECTION 1. IMPLEMENTATION OF EVACUATION GUIDELINE.

This executive order establishes the guidelines as to when, where, how and who will be
evacuated, as well as, who will carry out the evacuation operation.
SECTION 2. DEFINITION OF TERMS.

a. Disaster

Shall mean a sudden event that seriously disrupts the functioning of a related events; or man-
made events such as but not limited to fire, hazardous material-related incidents, public
protests, acts of terrorism and other peace and order concerns; that cause human, material,
economic or environmental losses that exceed the community’s or society’s ability to cope
using its own resources;

b. Imminent danger

Shall mean the existence of an immediate threat which could reasonably be expected to cause
death or serious physical harm;

c. Evacuation

Temporary but rapid removal of all or part of particular population from building or certain
area wherein a disaster or emergency has been declared and is considered dangerous for
health or safety of the public, whether individually or in an organized manner, as a rescue or
precautionary measure;

d. Evacuation sites/centers

Shall mean all pre-identified public elementary and high school buildings, sports facilities
such as covered courts and auditoriums, barangay halls and other public or private facilities;

e. Forced evacuation

Shall mean an evacuation ordered as a resort when a disaster or emergency has been declared
and danger of loss of life is imminent, and conditions exist that critically imperil or endanger
the lives of those in a defined area;

f. Response team

Shall mean any concerted effort by two (2) or more agencies, public subsistence needs of
those people affected and in the restoration of public activities and facilities.

g. Vulnerable or marginalized groups

Shall mean individuals or group of people that face higher exposure to disaster risk and
poverty including but not limited to women, especially pregnant women, youth, children,
elderly, differently-able people, indigenous people, the disadvantaged families and
individuals living in high risk areas and danger zones.
SECTION 3. GUIDELINES ON DISASTER PREPAREDNESS AND MITIGATION.

3.1. Bamban Municipal Risk Reduction Management Council shall ensure that community-
based disaster risk reduction and management trainings to orient every resident on the
possible natural hazards, vulnerabilities, and climate change risk as well as knowledge
management activities on disaster risk reduction and information dissemination regarding
calamities and disasters, either natural or man-made, are conducted down to the barangay
and community levels.

3.2. Trainings, orientations and activities shall be discussed in a language understood by the
local residents.

3.3. The Bamban Municipal Risk Reduction Management Council and its counterpart in the
barangay levels shall also cause the posting of posters of trainings, orientations, activities
and information at the dissemination through other platforms of advertisement and social
media.

3.4. The time during the dry season as declared by the Philippine Atmospheric Geophysical
and Astronomical Services Administration (PAGASA), shall be maximized for the
conduct of these trainings, orientations, activities and information dissemination and shall
be made a regular basis, especially in the areas that are vulnerable to flooding, landslides
and other natural disasters or calamities.

SECTION 4. GUIDELINED OR PRE-EMPTIVE EVACUATION

4.1. The Municipal Mayor shall be the one to declare/approve the implementation of pre-
emptive evacuation. However, it shall be done only upon the recommendation of the
Municipal Disaster Risk Reduction and Management Officer and subsequent
concurrence and approval of the Municipal Disaster Risk Reduction Management
Council after due consultation/coordination/reference with the different government
agencies, such as but not limited to dam administrators, PAGASA, PHILVOCS,
NDRRMC, MMDRRMC, OCD and DILG when a disaster or emergency has been
declared or forecasted and the danger of loss of lives is imminent within the area of
jurisdiction of the Municipality of Bamban;

4.2. If possible, order for the pre-emptive evacuation must be thoroughly evaluated after
consultation with different government before the commencement of the pre-emptive
evacuation operation to give the affected individuals or groups to prepare their necessary
needs or belongings;
4.3. Vulnerable or marginalized groups in the identified danger-zones or areas that are to be
affected by the incoming typhoon or any other identified situation or event that may
cause a disaster shall be temporarily relocated to evacuation sites or centers;

4.4. Assistance from the private sector such as private school shall be secured if the situation
warrants. Particularly, temporary use of their sports facilities or auditorium may be
requested if the need arises and if the shortage of evaluation sites exists;

4.5. Barangay halls, 3S Centers, and outpost shall be designated as the pick-up point area in
areas far from a designated evacuation center. VCDRRMO shall take the lead in
preparing for, responding to, and recovering from the effects of any disaster based on the
criteria provided under rule 11, Section 1 of the Implementing Rules and Regulations of
REPUBLIC ACT 10121.

4.6. Transport Team vehicles to be used in transporting affected residents to evacuation sites
or centers shall have the necessary banners or signs/logos for immediate identification.

4.7. Enlist the assistance of the Municipal Chief of Police, Municipal Fire Marshall,
Municipal DRRMO-Rescue Team, AFP/Coastguard Reserve Groups or any Accredited
and enforcement of pre-emptive evacuation before

4.8. The Municipal Government of Bamban may mobilize individuals or organized volunteers
to augment their respective personnel and logistical requirements in the delivery of
disaster risk reduction programs and activities.

4.9. Strict enforcement of the pre-emptive measure shall be done in the area/s affected or to
be affected by the man-made or natural disaster. The barangay chief executive or any of
the barangay officials, who are more oriented to the affected or target area, as much as
possible, shall be responsible in guiding the response team composed of VCDRRMO
team, the PNP or any enforcement agency, local rescue teams or volunteers. The response
team shall make sure that no person has been left unaccounted in the area or allowed to
return in the affected area without an order issued to this effect.

4.10. Once the pre-emptive evacuation has commenced, priorities shall be given to the following;

a. the sick and elderly people;

b. differently-abled people

c. pregnant women and children, especially the orphan and unaccompanied children

d. indigenous people

4.11. Camp Management teams shall be on standby in the designated evacuation centers/sites
to monitor and provide services and necessary materials such as but not limited to
beddings, blankets, clothing, foods and medicines, to the evacuees in times of disasters
persons that needs immediate medical attention. In the aftermath of the calamity and/ or
man-made or natural disaster, the Municipal Government of Bamban shall extend any
assistance that can provide to victims for their rapid recovery.

4.12. Search and Rescue team must be equipped with proper trainings and other necessary
equipment suitable for a particular situation. The Municipal Government of Bamban may
provide additional equipments and paraphernalia to the response team as may be needed
to properly and effectively respond to the needs of those affected by the calamity and/or
man-made or natural disaster.
The Municipal Government of Bamban shall take full responsibilities for the
enhancement of volunteers and shall submit the list to the Office of the Civil Defense
through VCDRRMO for accreditation and inclusion in the database of community
disaster volunteers.

The Municipal Government of Bamban shall be responsible for providing insurance and
necessary benefits to any volunteers who dies or sustain injury while engaged in the any
activities defined in Republic Act. 10121 otherwise known as the Philippine Risk
Reduction Management Act 2010.

4.13. Residents shall only be allowed to return or go back to their homes upon the order of the
Municipal Mayor through recommendation by the VCDRRMC in consultation with
different government agencies concerned and field personnel, after it has been
determined that the danger no longer exist therein.

SECTION 5. GUIDELINES IN IMPLEMENTING FORCED EVACUATION

5.1. Forced Evacuation procedure will be restored to in cases where the forecasted impact of
disaster in within less than 4 hours or in any disaster incidents that have already
occurred.

5.2. If anyone from the vulnerable or marginalized groups does not adhere to the order of pre-
emptive evacuation and found within the danger or target area within the danger of target
area within the time frame (refer to no. 1) he/she may be forcibly taken over even
arrested if the situation warrants as a means of ensuring his/her safety.

5.3. Forced evacuation shall be carried out in a manner that is humane, respectful of the
dignity of a person, not using disproportionate force, without discrimination and with
conscious attention to the needs of vulnerable sectors such as children, women, the
elderly and person with disabilities;

5.4. Personnel and volunteers carrying out the forced evacuation shall make sure that all
measures are taken to inform the evacuees, in a manner and language that they can
understand, of the need for the evacuation, the lack of other alternative for their
evacuation;

5.5. Personnel and volunteers carrying out the force evacuation shall comply with other rules
being promulgated by the Commission on Human Rights (CHR) for the protection of
human rights of all persons is hereby adopted.
SECTION 6. PNP AND BFP

6.1. Bamban, as member of the Evacuation Response Team, shall maximize their resources in
assisting the members of Bamban Municipal Risk Reduction Management group,
barangay officials, rescue teams and community disaster volunteers during the
implementation of pre-emptive and forced evacuation, with the end view of maintaining
order and safety of the local residents throughout the process of evacuation operation.

6.2. They shall also take appropriate measures in safeguarding the belongings left behind and
brought along by the evacuated residents of the Municipality of Bamban.

SECTION 7. COORDINATION.

7.1. All emergency measures adopted shall be coordinative and collaborative effort between
the concerned Municipal Officials of Bamban, Bureau of Fire Protection (BFP) and
Philippine Police (PNP).

7.2. The VCDMRRMC shall take the lead in preparing for, responding to, and recovering
from the effects of any disaster, based on the criteria provided in Rule 11, Section 1 of
R.A 10121 Implementing Rules and Regulations.

7.3. The Evacuation Sector guidelines and flow of operation stated in the Contingency Plans
for Flood and Earthquake shall be followed.

SECTION 8. ADMINISTRATIVE SANCTIONS.

Any non-compliance of this Executive Order shall be dealt with in accordance with DILG
Memorandum Circular No. 2012-35, which is made an integral part hereof as Annex “A”.

SECTION 9. EFFECTIVITY.

This executive Order shall take effect immediately upon signing.

1. Implement policies on peace and order, develop a viable program to counter causes of
public disorder, and evaluate the effectiveness of these efforts.
2. Monitor the implementation of peace and order projects at the Municipal Level and the
operation of the Civilian Volunteer Self-Defenses Organizations and such other counter
insurgency programs and activities.
3. Make periodic assessment of the prevailing peace and order situation on their area of
responsibility and submit a report thereon with recommendation to the Chairman of the
National Peace and Order Committee (NPOC).
4. Receive complaints against government personnel, civilian or military and endorse the
same to the agency concerned and demand such agency to submit reports an action taken
thereof.

There shall be a Peace and Order Council Secretariat that will handle the administrative,
operational and technical activities of the MPOC. Specifically, the secretariat shall prepare plans
and programs for consideration of the councils, supervise, direct, monitor for the council on the
implementation of approved policies, programs and plans; undertakes liaising and coordination
of activities with appropriate agencies of the government and provide a forum for
interdisciplinary dialogue and deliberation of major issues and problems affecting peace and
order.

The Secretariat shall be assisted by the staff of the MPOC Chairperson.

WHEREAS, Republic Act 9710 (The Magna Carta of Women) affirms the role of women in
nation-building, promotes gender equality and identifies the various areas and concerns wherein
the right women should be upheld and protected;

WHEREAS, concerned government agencies such as the DILG, NEDA and DBM has come out
with institutional mechanisms to localize the implementation of RA 9710;

WHEREAS, PCW-DILG-DBM-NEDA Joint Memorandum Circular 2013-1 provides the


guidelines for localizing the pertinent provision of RA 9710;

WHEREAS, one of the mechanisms contained in Joint Memorandum Circular 2013-01 is the
establishment of the Gender and Development Focal Point System (GFPS) in the LGU’s;

WHEREAS, corollary to the institutionalization of the Gender and Development Focal Point
System (GFPD) is the creation of the GFPS Executive Committee and the GFPS Technical
Working Group and the Secretariat in the LGU’s;

NOW THEREFORE, I, JOSE ANTONIO T. FELICIANO, Municipal Mayor of Bamban,


Tarlac, by the virtue of the powers vested in me by law do hereby order the following:

Section 1. The Gender and Development Focal Point System (GFPS) is hereby established in the

Section 3. Functions and Duties of the GFPS Executive Committee

The GFPS Executive Committee shall have the following duties and functions:
1. Appoint and convene the GFPS Technical Working Group and the Secretariat
2. Lead in mainstream ADG perspective in LGU policies, plan and programs. In the
process, ensure the assessment of the gender-responsiveness of systems, structure,
policies, program, processes and procedure of the LGU based on the priority needs and
concerns of constituencies and employees, and the formulation of recommendation
including their implementation.
3. Assist in the formulation of new policies such as the GAD Code in advancing women’s
empowerment and gender equality;
4. Lead in setting up appropriate system and mechanisms to ensure the generation,
processing, review and uploading of sex performance-based and gender-responsive
planning and budgeting;
5. Coordination efforts of different division/offices/units of the LGU and advocate for the
integration of GAD perspective in all their and processes;

Section 4. Meetings

The GFPS Executive Committee shall convene at least once a month

Section 5. Effectively

RE-ORGANIZATION OF LOCAL AIDS COUNCIL OF THE MUNICIPALITY OF


BAMBAN

WHEREAS, Section 16, RA 7160 “General Welfare” states that every Local Government Unit
shall exercise the powers expressly granted to them for the general welfare of their inhabitants
like in the promotion of health and safety, preserve the comfort and convenience of their
inhabitants;

WHEREAS, Section 17, par. A.2. iii, RA 7160, “Basic Service” states that it shall provide
health services, which include the implementation of programs and projects on communicable
and non communicable disease control services, access to secondary and tertiary health services;
purchase of medicines, medical supplies, and equipment needed to carry out the services herein
enumerated;

WHEREAS, the disease, Human Immune Deficiency Virus/Acquired Immune Deficiency


Syndrome (HIV/AIDS) recognizes no territorial social, political and economic boundaries for
which there is no known cure;

WHEREAS, in support to the prevention and control of HIV/AIDS, RA 8504, entitled, The
Philippine AIDS Prevention and Control Act of 1998” was enacted to counter the threat of
HIV/AIDS epidemic by promulgating related necessary policies and strategies and to monitor the
implementation of this Act down to the local level;

WHEREAS, Local Government Units as front liners in the delivery of basic services shall also
create an organization which aims to prevent, mitigate and eradicate the conditions that fuel the
spread of HIV/AIDS;

shall be the central Advisory, Planning and Policy-Making Body for the comprehensive and
integrated HIV/AIDS prevention and control program of the Municipality of Bamban.

WHEREAS, as set in the 1987 Philippine Constitution and in the Local Government Code of
1991, it is the states policy to ensure that the territorial and political subdivisions of the State
enjoy genuine and meaningful local autonomy to enable them to attain their fullest development
as self-reliant community and make them more effective partners in the attainment of national
goals.

WHEREAS, Public Financial Management is an integral part of an organization structure and


operating mechanism as it provides the general framework for generating revenues, allocating
resources and managing expenditures, which are all necessarily entailed in the fulfillment of the
LGU’s mandates.

WHEREAS, Public Financial Management seeks to address the key challenges of controlling
government spending and making agencies operate efficiently and effectively.

WHEREAS, the Local Government of Bamban has no existing Public Financial Management
team. Thus the need to establish a PFM team to conduct a periodic evaluation of the LGU PFM
system.

NOW THEREFORE, I, JOSE ANTONIO T. FELICIANO, Municipal Mayor, by virtue of the


powers vested in me under existing laws, promulgate an Order Creating the LGU Public
Financial Management Team.

SECTION 2. FUNCTIONS AND DUTIES OF THE ELA TEAM.

a. Review available plans and documents, and gather data required in the development of
the ELA;
b. Assist the LCE in public hearings and other consultation sessions with the various LGU
Stakeholders and affected sectors like the LGU offices, LDC, Sanggunian and other
sectoral organizations;
c. Assist the LCE and the LDC in drafting and finalizing the ELA to include the three (3)
year LDIP, current year Executive Budget and AIP;
d. Assist the LCE in his presentation of the ELA to various stakeholders; and
e. Do other tasks required by the Local Chief Executive in order to produce the desired
outputs.

SECTION 3. RELATIONSHIP WITH THE LDC AND OTHER UNITS

The ELA team shall work closely with the LDC as soon as it is reconstituted. The MDC
shall act as the reference group for the ELA Team and shall participate actively, through its
representative, in all stages of the ELA process.

SECTION 4. SUPPORT REQUIREMENTS

The team may call upon the assistance of relevant units and/or LGU personnel, through
the respective department/unit heads, in the implementation of various activities. Everyone is
enjoined to participate in the various activities of the ELA.

SECTION 5. EFFECTIVITY

The ELA Team shall exercise its functions and duties effective immediately and until the
project closes.
