TERMS AND CONDITIONS


A. SMDC Leasing shall be the non exclusive accredited leasing broker for the unit/s stated in the PROPERTY INFORMATION list.
B. For every closed/transacted lease, SMDC Leasing shall be entitled to receive a service fee based on the rate sheet below (all rates are 12%
VAT inclusive), payable in full, 15 working days after the signing of the Contract of Lease between the lessor and lessee.

TERM COMMISION AMOUNT
1 to 5 months Php 3,000
6 to 11 months equivalent to half month rent
12 months equivalent to 1 month rent

For closed lease on Parking Space, service fee will be based on the same rate sheet, with minimum of Php 3,000 net amount.

Please note that SMDC is entitled to the aforesaid service fee for every closed/transacted lease and/ or lease renewal.

C. In case of pre-termination of Lease Contract, Service Fee is not refundable.


D. Payments for lease rentals and SMDC Leasing Service Fees shall be through Post Dated Checks (PDC’s), unless otherwise approved by unit
owner (for residential lease rentals only).

DUTIES & RESPONSIBILITIES


A. LESSOR
a. To deliver the unit/s in tenantable condition.
b. To provide SMDC Leasing with a list of all the furniture to be provided if the said unit/s will be leased out with furniture. It is
understood, however, that the ownership, proper maintenance of the unit/s and its furnishings, if any, shall be the sole
responsibility of the lessor. The lessor holds SMDC free and harmless from any form
of liability arising from the lease, including any breach thereof, non-maintenance of the unit/s and any misrepresentation of the
lessor and/ or lessee with respect to the unit/s.
c. To inform the lessee and SMDC Leasing of the true state of the unit/s for leasing and address any concerns by the tenant in
connection with the unit/s.

d. To provide all supporting legal documents needed for the processing of the Lease Contract
e. To pay for all related charges including charges for Notarization.

B. SMDC
a. To duly inspect unit/s for lease, to ensure that the unit/s is in tenantable condition, prior to offering unit/s for lease.
b. To assist in providing standard lease contract, if necessary, between Lessor and Lessee.
c. To assist the lessor in finding a suitable tenant for the aforementioned unit/s.
d. To exert efforts in marketing the unit.

OTHER PROVISIONS
A. During the effectivity of this Service Agreement and / or termination thereof, SMDC Leasing agrees to actively protect proprietary
data/documentation/information by not disclosing to anyone confidential data/documentation/information belonging to the lessor.

B. No alterations and variations of the terms and conditions hereof shall be binding against SMDC Leasing unless the same have been reduced
in writing and signed by the lessor and the duly authorized representative of SMDC Leasing.
