מיום 03 לאפריל ,2019 ,כדלהלן:
בראש בקשת העיון ,אומר מבקש העיון ,סעיף ג( ,(2) ביחס ל”הסכם/הסכמים עם .1
מדינה/מדינות שלישית/שלישיות” ,שהם נשוא בקשת העיון:
ככל שמסמכים אלה אינם קיימים כלל בתיק ,בית המשפט מתבקש לומר כך
בפירוש בהחלטתו על בקשת עיון זאת .
תגובת המשיבים ע"י פרקליטות המדינה אומרת בסעיף ,6 ביחס לאמור לעיל: .2
.6לבסוף ,ובאשר לבקשת המבקש כי" ככל שמסמכים אלה אינם קיימים כלל
בתיק ,בית המשפט מתבקש לומר כך בפירוש בהחלטתו על בקשת עיון זאת",
מופנה בית המשפט הנכבד לפסק הדין המפורט שניתן בהליך שבכותרת
) ,(8101/15במותב מורחב ,לרבות האמור בסעיפים 8488 לפסק דינה של
הנשיאה) בדימוס( נאור.
המשיבים אינם מפרשים את טענתם בסעיף ,.6 הנ”ל .אולם ניתן לשער שכוונתם
לטעון ,שהעתק ההסכם אכן מצוי בתיק בית המשפט העליון.(8101/15)
דא עקא ,סעיפים 8486 לפסק הדין בתיק זה ,אינם תומכים בטענה זאת של המשיבים. .3
פסק הדין בתיק זה ,סעיף ,84 אומר:
נוסחו של ההסכם צורף לחומר החסוי שהוגש לבית המשפט לעניינים מנהליים,
ואשר הוצג גם בפנינו…] קו תחתון הוסף יצ[
אמירה זאת ,כפשוטה ,אומרת שהעתק ההסכם הוגש [WAS FILED] בבית המשפט
לעניינים מנהליים ,ולא הוגש בתיק בית המשפט העליון .למועט – אמירה זאת מותירה
את השאלה ללא מענה ברור :האם העתק ההסכם מצוי בכלל בתיק זה ?(8101/15)
לפיכך ,מן הראוי שבית המשפט זה יקבע קודם לכל קביעה עובדתית :האם העתק .4
ההסכם מצוי בכלל בתיק זה ?(8101/15) ככל שאין העתק ההסכם מצוי בתיק זה ,שאר
בקשת העיון מתייתר ,שכן מקומן של בקשת העיון ו/או כל בקשה אחרת בעניין החיסיון
אינן בבית משפט זה.

Requester of Inspection’s Request for Leave to File Reply and Reply
Requester of Inspection, Joseph Zernik, PhD, files herein his request for leave to file
reply and reply to the April 03, 2019 Respondents’ response, as follows:
1. At the head of the Request to Inspect, Requester of Inspection says in c) (2),
pertaining to the “Agreement/s with third nation/s”, which are the subject of
the Request to Inspect:
In case such records do not exist in instant court file at all, the Court is
requested to explicitly state so in its decision on instant request.
2. Respondents’ response by the State Attorney says in paragraph 6, relative to the
above:
6. Finally, relative to the Requester’s request that “in case such records do
not exist in instant court file at all, the Court is requested to explicitly state
so in its decision on instant request”, the Hon Court is referred to the
detailed Judgment in instant court process(8101/15), in an expanded panel,
including statements in paragraphs 8486 to the Presiding Justice (ret)
Naor.
The Respondents fail to explicitly state their claim in the above cited paragraph
6. However, one can surmise that they intended to claim that a copy of the
Agreement indeed exists in instant Supreme Court file (8101/15).
3. However, paragraphs 8486 to the Judgment in instant court file do not support
such claim by the Respondents. The Judgment in instant court file states in
Article 84 the following:
A text of the Agreement was attached to the sealed materials that were filed
with the Administrative Court, and which was displayed to us...” [underline
added jz]

Such statement, simply interpreted, says that the Agreement was filed in the
Administrative Court, and was not filed in the Supreme Court. At least – such
statement leaves the question with no clear answer: Is there a copy of the
Agreement in instant court file (8101/15)?
4. Therefore, the Court should first determine a matter of fact: Is there at all a copy
of the Agreement in instant court file (8101/15)? In case there is no copy of the
Agreement in instant court file, the rest of the Request to Inspect is moot, since
the Request to Inspect and/or any other request, pertaining to the sealing, do
not belong in this Court.
