PENDING ISSUED IN JANAPRIYA METROPOLIS, ERRAGADDA


IN COMPLETION OF BASIC SERVICES (WATER, POWER, DRAINAGE, GREENARY),
CLUB HOUSE, AMENITIES, VISITORS CAR PARKING ETC.
PROJECT WAS STARTED IN THE YEAR 2007/2008

It is submitted that M/s.Janapriya Engineers Syndicate Pvt Ltd. is the Real Estate Developer, represented
by its Managing Director Mr. K. Ravinder Reddy entered into an agreement with the M/s. S. P. Real
Estate Developers Pvt. Ltd. represented by its Directors 1).Mr. Samir Jain & 2).Mr. Pradeep Menon, (who
are the Developers and G.P.A Holders of M/s. A. P. Electrical Equipment Corporation, owned by M/s.
ECE Industries Ltd., for the land admeasuring 24,425.80 Sq. Yds out of 67,824.50 Sq. Yds in Sy.No. 74/P &
75/P, situated at ward No. 8, Block No.4, Fathenagar Village, Hyderabad, vide Doc. No. 3268/2007,
dated 21.09.2007, Regd. at the SRO, Banjara Hills) for development of land for construction of
residential apartment complexes therein in Fathenagar, Erragadda, Hyderabad in the name of Janapriya
Metropolis.

The Builders projected a rosy picture of the project that they are constructing multistoried apartments
in the name and style of “JANAPRIYA METROPOLIS” consisting of 8 Blocks and each block consisting
stilt+5 floors at Motinagar, near Erragadda, Hyderabad and they are using technology acquired from a
German company by show-casing glossy brochures vide publicity in electronic, print media
advertisement and also placing its salient features of the project such as 1500 flats gated community
with well planned 2 BHK and 3BHK apartments with Club House, Gymnasium, Swimming pool, Children’s
park, Indoor Games, Outdoor Games, Community banquet hall, Amphitheatre, Cable TV connection,
Internet Provision, ATM, Primary Health Care centre, Intercom System, Creche, Elevators, Excellent
water and sanitation facilities, Ample parking space & 24x7 Security etc. and they have shown that they
obtained approved the said layout of Development Plan which is issued by the Commissioner, M.C.H,
Hyderabad, vide Permit No. 144/45, File No. 8453/TPS/MCH/HO/09, dated 31.03.2007.

We the flat owners of Janapriya Metropolis were purchased the flats with various dates from the
Builders. In spite of the Builder’s promise to complete the flats within 18 months in all respects from the
date of agreement with a grace period of 3 months, but the Builders have failed to complete the same
and delayed the project of Janapriya Metropolis in spite of several demands and reminders made by the
flat owners. Actually the said project was started in the year 2007/2008 and in the span of 10 / 11 years
the Builders were unable to completed the construction of all flats. Still 2nd Block is under construction
stage and some of flats in 1st 5th & 6th blocks are in finishing stages.

Hereunder I am mentioning the following unfinished basic facilities even after the projected was started
in the year 2007/2008.

1) DRINKING WATER CRISIS: There are total around 1500 flats in our Janapriya Metropolis. 500
liters of water is required for each flat as per GHMC norm. Total required amount of water is
1500x500 = 750 KLD. But the Builders have applied and taken 240 KLD of water in the year 2012
for around 400 flats constructed at that time. Presently all most of all flat owners except
construction stage flats, are occupied in Janapriya Metropolis. As per the agreement it is the
duty of the Builder/Developer to provide sufficient water to the Society. Present available
water sources either from GHMC and also from the Bores at our Premises is not sufficient of our
daily usage and now we are depending on Water tankers for extra water, resulting huge
expenses to our residents.

EXTRA AMOUNTS COLLECTED: The Builders have started collecting additional amounts ranging
from Rs.25,000/- to Rs.70,000/- from the year 2010 onwards from each flat owner of Janapriya
Metropolis. It amounts nearly Rs.8,00,00,000/- (Rupees eight crores only) and simple interest
on the collected amount calculated in diminishing method is around Rs.5,00,00,000/- (five
crores only). The buildes have not taken any interest till now and not applied for additional
quantity of water of 500 KLD, even though, they have additionally collected a huge amount
around Rs.13,00,00,000/- (Thirteen crores only). We are facing water problem regularly and
many troubles especially in summer.
PROVISION OF BOOSTER PUMPS: The Builder are not provided booster pumps for lifting water
for 4th & 5th blocks. This is resulting heavy burden on other two boosters attached to 7th and 8th
blocks and frequent break downs.

WATER CARRYING PIPES: To carry Manjeera water from GHMC water point to inside Janapriya,
the builders have laid low quality polyethylene pipe instead of strong cast iron pipe. The water
carrying polyethylene pipes bursts many times due to high GHMC water pressure. This is also
giving additional problems to the residents.

2) CLUB HOUSE: The Builders have collected an amount of Rs.35,000/- from each flat owner for
Club House Construction. The total amount collected from around 1500 flat owners is around
Rs.5,25,00,000/-. They have collected the amount since 2009 year onwards. If we calculate 15%
simple interest on the collected amount in diminishing method the interest amounts to around
Rs.7,00,00,000/-. So the total Club House amount with the Builders is around Rs.12,25,00,000/-.
Till now the Builders have not provided CLUB House to the Janapriya Metropolis flat owners.

3) AMENITIES: The Builders have collected an amount of Rs.88,000/- from each flat owner for
providing amenities. The total amount collected from around 1500 flat owner is around
Rs.8,80,00,000/-. They are collecting the amount since 2009 year onwards. If we calculate 15%
simple interest on the collected amount in diminishing method, the interest amounts to around
Rs.11,88,00,000/-. So the total Amenities amount with you is around Rs.20,68,00,000/-. As per
the GHMC approval Plan, you should construct 5 floors amenities building. The construction
work of flats in our society is almost at completion stage. As per the GHMC plan the Builders
should provide 5162.94 Sq. Mts. of area for amenities. But till now they have completed slab
work up to two floors and stopped to construct the amenities Building thereafter.

Hereunder I am mentioning the following are the not provided amenities since the projected
was started 2007/2008.

a) No Gymnasium
b) No Swimming Pool
c) No facility of Indoor Games
d) No facility of Outdoor Games
e) No Community Banquet hall (We are celebrating the festivals/functions in open drive ways)
f) No Amphitheatre
g) No Shopping complex
h) No ATM facility
i) No Creche
j) No Primary Health Centre
k) No Association Office

4) TOT-LOT AREA: The tot-lot area 2285.13 Sq. Mts. as per the GHMC plan comes among 1st 2nd &
3rd Blocks. Now there are unauthorized constructions of office rooms, waste material dumping
halls etc., in the tot-lot area. But there should be greenery, swimming pool and other facilities.
But no such facilities available till date.

5) POWER: Presently the Builders are providing illegal construction power to some of the 1st 2nd 5th
& 6th Block flats and are also not provided power meters.

6) LIFTS & SERVICE LIFTS: As per the agreement the Builders have to provide Lifts and Service Lifts
to all block wings. Till date the builders have not provided Lifts to 5th Block 1A Wing and 6th
Block 3rd wing, which is causing lot of inconvenience to the Senior Citizens and also the flat
owners. They have also not erected six Service Lifts to 5th & 6th Blocks.

7) SANITATION & DRINAGE: Very poor drainage facilities were provided in the Janapriya
Metropolis. Drains are over flowing and the dirty water is floating on roads and also on the car
parking space especially in rainy season, instead of moving through drain pipes. In the mornings
the main gateway and drive ways are filled with dirty water coming from the flats. Sanitation
workers unable to trace the routes of under drainage pipe lines to do repairs. Manjeera
drinking water sumps are not cleaned even after many years. The drive ways of 5th & 6th Block
are not yet washed till date.

8) VISITORS CAR & SCOOTER PARKING: As per the GHMC approval plan Builders should provide
visitors 185 cars & 370 scooters parking. Till date you have not provided / earmarked visitors’
parking space. Because of non availability of parking space, the visitors are parking their
vehicles on the drive ways, which is causing of lot of problems and inconvenience to the visitors
as well as residents of Janayapriya Metropolis.

9) ENTRANCE GATES & SECURITY: As per the GHMC, our Janapriya Metropolis should have two (in
and out) security gates at North side of our gated community. Presently the Builders have
illegally provided fully functional South gate and there is only one unstructured gate at North
side. Outsiders / Private persons and their vehicles are always going from one gate to other
gate of our Society and are threatening even the Security Guards if they object them. This is
causing lot of inconvenience to our residents and traffic pressure at Main Gates. Only 6 six feet
height compound wall was erected at East side of our premises. Stray Dogs are climbing the
walls and come into the premises and are freely roaming.

10) GREENARY / PLANTATION: There is very small portion of greenery even since majority of the
construction has already been completed and residents have already occupied. Finishing of a
small park work between 4th & 5th Blocks is pending for a long time. Builders have arranged
the sitting row towards drive way instead of facing towards park side. Which may cause
accidents in the drive way.

11) LEAKAGES IN FLATS: With poor quality of work carried by the builders, many of our flats are
facing leakages. Seepage water is flowing into the bed rooms / kitchens / bath rooms in many
flats in Janapriya Metropolis, thereby damaging entire walls. With many of our requests to
arrest the leakages, the builders have not taken any concrete work in this regard

12) OCCUPANCY CERTIFICATE: In the absence of occupancy certificate from GHMC, around 25 to
30% penalty is being collected on property tax from residents for the negligence of Builders.

13) OPEN DRAINAGE : There is a very big open GHMC drainage going through the north side
compound wall of 6th & 7th Blocks of our Janapriya Metropolis. 6th & 7th Block residents are
getting bad smell through out the day due to the open drainage. Till now the Builders have not
taken any steps to contact GHMC authorities to rectify the open drainage problem even after
our so many requests.

14) OUTSIDE PUBLIC PARK : Builders have utilised most of the space with the constructions, and left
small portion of land for roads and parks in our Janapriya Metropolis. Our Builders have
surrendered a big piece of adjoining land to GHMC at the time of approval of building
construction. GHMC officials have already identified some portion of the land as Public Park.
But till now the Builders have not taken up any initiative to contact GHMC officials for the
development of park. Daily huge number of residents are going out for walking purpose to
nearby areas / parks as there is no provision for walking track in our area.

We shall be thankful to you Sir/Madam, if you please visit our complex and see the problems and actual
facts faced by our residents and do justice.
