Upon arrival, Demeko Robinson, was found to be holding an injured child (Avion Weaver) with a towel wrapped around the child's head, Robinson told the responding officers that Weaver was injured after he ran into a table. The officers observed that the injuries to Weaver didn't appear consistent with what Robinson was stating. EMS personnel confirmed these suspicions when they advised the officers that the injury appeared to be a gunshot wound. Weaver was flown by helicopter to Arnold Palmer Children's Hospital in Orlando where he was pronounced deceased at 2326 hours. I responded to the scene of the shooting after being contacted by the patrol supervisor. Upon my arrival, I conducted a short interview with the Weaver's mother, Deja Perry. Perry stated she did not know what happened to her child and that there were no weapons in the apartment that she knew of. [then conducted an interview with Robinson who was caring for Weaver at the time that he was injured. Robison initially told me that he had stepped outside the apartment for a few seconds and returned to find Weaver injured, but that he idn't know how Weaver was injured. I asked Robinson if there were any weapons inside the residence and he denied multiple times that there were any firearms inside the apartment. I confronted Robinson with the fact that Weaver suffered a gunshot wound to the face and again he denied that any firearms had been located in the apartment. Robison finally admitted that a 9mm handgun had been located inside the apartment after I pointed ‘out that Weaver could not have shot himself in the face if there was no gun inside the apartment. Robinson stated that kept the handgun in a “lock box" and that it was normally kept next to the sofa where Weaver shot himself, Robinson told me that the "lock box" is usually locked, but that he might have unlocked It that night. 1 then asked Robinson where the handgun was located, because it had been removed from the area where Weaver shot himself, Robinson admitted to seeing the handgun on the floor of the living room when he found Weaver, but denied moving the handgun or knowing what happened to the handgun after that. Robinson claimed that there were multiple people (9) inside the apartment after he found Weaver and implied that one of those people must have removed the handgun. When pressed for names of people that were inside the apartment, Robinson stated that he could only say that they were "neighborhood people”. Robinson continued to deny knowledge of the handgun's location even after I advised him that other children might find it and another tragedy might occur. ‘While, I was preparing a search warrant for the apartment where Weaver was injured, I was advised that handgun had been located behind the A/C unit located at 202 Lakeside Hills Loop. I learned that Deputy Chief Ray had spoken to Robinson about the missing handgun and he stated that he could take them to where it was located at. Robinson was informed that was not an option and stated that it was located in the alley behind the apartment. Officers searched the alley and located a black Hi-Point 9mm Model C9 handgun behind 202 Lakeside Hills Loop. The apartment at 202 Lakeside Hills Loop is the apartment immediately west of 198 Lakeside Hills Loop. After obtaining a search warrant for the apartment, I returned to the scene and read the search warrant to Robinson. After the search warrant was read, I went to the alley where the handgun had been located. After the handgun hhad been documented by erime scene, I picked the weapon up and began the process of making it safe. I removed the magazine from the handgun and observed that four rounds were still located in the magazine. I observed that the safety mechanism on the handgun was engaged and I had fo deactivate it prior (o being able to clear the chamber, When I pulled the slide back to empty the chamber, I discovered that the chamber was empty. This indicated that someone had cleared the handgun, put the safety back on, and hid the handgun behind the apartment next door after Weaver discharged the handgun. A single metal projectile was observed on the sofa in the living room where Weaver had been siting when he accidentally shot himself. began to search the living room area for a shell casing and the "lock box" Robinson stated the handgun had been secured in. A thorough search of the living room revealed that no shell casing or "lock box" were present. A second interview with Robinson took place with myself and Sergeant Spell. During the interview Robinson was asked about the "lock box" and the cireumstances of how Weaver was able to obtain the handgun. Robinson stated in the interview that the "lock box" is normally kept on the shelf above the washer/dryer. He stated that he was cooking in the kitchen earlier in the night and had to open the front and back doors due to smoke from the oven, Robinson advised that he removed the "lock box" from the shelf above the washer/dryer and placed it on the countertop in the kitchen. Robinson confirmed that the "lock box" was unlocked and open on the countertop with the handgun inside it. Robinson left Weaver inside the apartment with unsecured firearm while he stepped outside to visit with a neighbor. Robinson admitted during this interview that he heard the gun discharge and went back into the apartment to find Weaver injured. Robinson again claimed that he was only outside the apartment for a few seconds, but an interview with the neighbor (Ellis Horace) indicated that Robinson left Weaver alone inside the apartment for approximately thirty minutes. I asked Robinson where the Key to the "lock box" was located at which time he disclosed that there was not a key lock on the box. He stated that the "lock box" only had clasps which closed the box. When asked about the missing "lock box" and shell casing, Robinson again claimed that nine people were inside the apartment after the shooting and that one of them must have removed the handgun, "lock box", and shell casing. Interviews with officers, neighbors, and witnesses confirmed that no one, but Robinson entered the apartment until first responders arrived on scene. After the second interview with Robinson, I returned to the interior of the apartment to assist with the search. Upon entering the residence, I observed Detective Graham unloading a small rifle. Detective Graham advised me that he had located a camouflage soft gun case when he opened the doors to the wooden armoire in the living room. The armoire was located a few feet away from the sofa where Weaver shot himself. Detective Graham advised me that he was unable to locate a serial number on the rifle. I examined the rifle and observed that rifle had been modified from its original design. I noted that the stock had been cut to remove the shoulder portion. and make a pistol style grip which was wrapped in black tape. It was also noted that the barrel of the weapon hhad been cut and was clearly less than 16" in length which is in violation of F.S.S. 790.221. I examined the rifle in an attempt to locate the serial number so that the rifle could be run through FCIC/NCIC. The area where the serial number should have been located showed obvious signs of alteration to the point that the serial number hhad been removed whic! lation of F-S.S. 790.27(2). On 01-26-17, | conducted an interview with Deja Perry at the Auburndale Police Department. During the interview Perry again stated that she did not have any knowledge of firearms being present in the apartment, Perry further stated that she has been in trouble in the past (convicted felon) and knew that she was not allowed to possess firearms. I asked Perry about "lock box" Robinson claimed that the handgun had been stored in, Perry stated that she never observed any boxes like the one described by Robinson as being the "lock box’ Perry stated that she had talked to Robinson about the handgun after the shooting and that Robinson ad to throwing the handgun to get it out of the apartment after Weaver shot himself. ted After reviewing the evidence in this ease there is probable cause to believe that Robinson was acting in the role of ‘a guardian/caregiver when Weaver was left in his care. Robinson was negligent in his duties as a ‘guardian/caregiver by leaving Weaver unattended in the apartment with a loaded and unsecured handgun. Due to this negligence Weaver was able to obtain the handgun and fatally injured himself with it. In an effort to conceal how Weaver was actually injured, Robinson removed the handgun from the crime scene and hid it behind a neighbor's apartment. Robinson proceeded to lie to officers and detectives about how Weaver was injured and the location of the handgun that was removed from the crime scene. Robinson's lies impeded the felony investigation by misleading officers as to how Weaver was injured and how evidence was removed from the erime scene. Robinson's lies also caused a threat to public safety. Robinson removed the handgun from the apartment after the shooting and hid it behind a neighbor's apartment where any of the other neighborhood children could have found the handgun and injured or killed themselves with it.
