May Be Convicted Solely On The Testimony Of The Victim.. “In the crime of Qualified Rape, the relationship of the victim with the offender must be established with particularity. If the accused is not married to the mother of the victim, there is no stepfather-stepdaughter relationship, hence accused can only be convicted for simple rape.” The girl was a 16-year old minor who together with her mother and siblings lived together with their mother’s live-in partner, Antonio, whose intentions, contrary to his surname (Dalisay) was not pure. One night, while the girl was playing cards, and her sibling were watching tv in the ground floor of their rented house, Antonio entered the room to change his shirt, laid beside hER, and in short and simple language, bombarded the gate of chastity with his bestial toughness. After his dastardly act, Antonio warned the girl not to report the matter to anyone lest he kill her entire family. Out of fear, the girl did not report the matter. One day, she and her sister quarrelled, forcing the girl to leave home and go to her aunt. There she recounted everything that Antonio did to her, including the fact that he had been abusing her since she was 13 years old. The aunt promptly reported the matter to the authorities, who immediately arrested the accused. In his defense, the accused denied the allegations and argued that the charges were instigated by the aunt, who held a grudge against him. After trial, the Regional Trial Court convicted the accused for the crime of Qualified Rape. May Antonio be convicted for Qualified Rape? “Three principles guide the courts in resolving rape cases: (1) an accusation for rape can be made with facility; it is difficult to prove but more difficult for the accused, though innocent, to disprove; (2) in view of the intrinsic nature of the crime of rape in which only two persons are usually involved, the testimony of the complainant must be scrutinized with extreme caution; and (3) the evidence for the prosecution must stand or fall on its own merits, and cannot be allowed to draw strength from the weakness of the evidence for the defense. In a determination of guilt for the crime of rape, primordial is the credibility of the complainant’s testimony, because, in rape cases, the accused may be convicted solely on the testimony of the victim, provided it is credible, natural, convincing and consistent with human nature and the normal course of things. Here, the victim, in the painstaking and well- nigh degrading public trial, related her painful ordeal that she was raped by appellant. Her testimony was found by the trial court, which had the undisputed vantage in the evaluation and appreciation of testimonial evidence, to have been made in “a simple, straightforward and spontaneous manner.” xxx “The Court, therefore, finds appellant guilty beyond reasonable doubt of the crime of simple rape. While it has been proven that appellant was the common-law spouse of the parent of the victim and the child was a minor at the time of the incident, the Court cannot convict appellant of qualified rape26 because the special qualifying circumstances of minority and relationship were not sufficiently alleged in the information. To recall, the information here erroneously alleged that appellant was the stepfather of the victim. Proven during the trial, however, was that appellant was not married to the victim’s mother, but was only the common-law spouse of the latter. Following settled jurisprudence, appellant is liable only of simple rape punishable by reclusion perpetual.” G.R.
