27th, 2017, Council meeting with EPP
Motion to approve requests to be ex-
cused. Motion by William Long, III, sec-
ond by C. Steve Brave, question by Kath-

Chairman Kindle – Last storm depleted
our wood supply, bills are tied up, a try-
ing time for us.
Concerns & Solutions:
• Activating EPP – need a change
of leadership, it is a thankless job, lots of
criticism increased by social media, field-
ing lot of calls and text messages, lot of
people have been preparing since august,
its these super cold spells, we need to
come up with a plan
• All these programs who stock-
pile wood, EPP should be able to access
that wood supply for the households who
burn wood, wood burns faster in the cold,
propane burns faster.
• When EPP is declared, we need
to make sure all the bills are paid to all
propane vendors so when we have an
emergency, we can have access to all
vendors not just Sicangu Propane.
• Some programs sell wood, when
EPP is activated, EPP should have access
to the wood to help the people.
• When administrative leave is
granted, the staff should still be available
to provide the needed services to the peo-
ple.
REDCO – Wizipan Little Elk
• Sicangu Propane is not a part of
EPP. They ask to be a part of EPP so they
can set one of their people in the com-
mand center to get the emergencies taken
care of along with their regular deliveries.
Having a staff member in the command
center will help them coordinate their
efforts with the Tribe.
• Drivers – Drivers of propane
tanks need CDL, tanker endorsement, haz
mat. Haz mat is a more difficult test and
requires a Department of Transportation

background check.
• Hiring of emergency drivers –
offer $250 bonus to any tribal employee
who has a CDL and is able to obtain their
tanker and haz mat certification and hire
them on a part-time emergency basis
when EPP is declared. At the end of the
propane season, spring time, give them
another bonus just for being on call.
• Drivers – federal regulations
require drivers take a break after ten
hours behind the wheel.
Concerns & Solutions continue:
• Central command center – It
should be here at the tribal building be-
cause the phone system is already set up
where people can call in, this will address
the main complaint of not being able to
get ahold of anyone.
• Program employees who answer
phones will be paid.
• Programs need to deploy their
vehicles to haul wood.
• Deploy some employees to cut and
gather wood.•
• Sicangu Propane Company belongs
to the people not Wizipan, not RED-
CO. They have three trucks so they
should not be behind but they need
drivers who meet certain criteria.
• When EPP is declared, it is our
emergency, the Rosebud Sioux Tribe, not
the state, not the federal government, it is
ours and we need to take ownership.
• We need to have a better coordi-
nated effort with all our tribal programs,
we have all the resources, we need coor-
dination to pull people and resources to-
gether when the Chairman declares EPP.
The programs need to become active as
soon as he issues a proclamation and kick
in with their resources.
• Need to include the community
chairman – that they check on their own
individual community, to see the need
and to be able to coordinate their re-
sponse.
• Thanks Cindy and Brooke from
the Chairman’s Office working with her
throughout the weekend.
• After she talked to Willie and he
declared EPP, she put it on facebook.
• Communication – biggest need
• LIHEAP cannot order from
CENEX Propane because SWA did not
complete their report of tank readings so
CENEX cut us off. Other people can get
propane from CENEX but not LIHEAP.
• When we are in an emergency
situation, all hands should be on deck
• When EPP is declared, all pro-
grams should come together, we are very
disorganized in responding to an emer-
gency situation
• We need a point person. Bob
Oliver volunteered and said winter is
down time for his program and his pro-
gram could be cutting wood, preparing
for times like this. Robert Long and Bill
Giroux have been involved for many
years but they both have health problems.
• Need to do more than declaring
EPP and putting it on the radio. We need
to be ready to respond.
• There is an EPP plan in place,
needs to be disbursed, no one follows it.
• Communication is important,
have two or three people answering the
phones.
• Programs need to be willing to
work together, not be territorial.
• Robert Long, Bill Long, Lonzo
Bordeaux, Curtis Giroux, Cleve Neiss,
Floyd Reynolds – these guys were head
of EPP, they had dedication, compassion,
leadership skills. They had command of
lot of resources, snowmobiles, snow caps,
front end loaders, four-wheel drives. We
had problems back then but not like to-
day. Today we lose that element, today
first question is “how are we going to be
paid”. Human life is more important than
the dollar sign.
• BIA should be part of this as
they once were.
• When an emergency is declared,
regulations should be suspended such as
requiring a wood vendor to have a busi-
ness license.
• Declare emergency early
• No correction action plan
• List of all program directors and
the resources, responsibilities they have
to provide in an emergency situation.
• Programs who stepped up need
to be acknowledged such as Solid Waste.
• Calling EPP but no one answers
the phone or passes the buck.
• Suggestion that Bill Giroux, Bob
Long, etc., be co-coordinators along with
anyone else who wants to help out.
• Majority of the calls were for
wood or propane; a good number of these
people probably had wood and propane
and just want to take advantage of the
opportunity to get more. In the past, re-
quests were checked out and if their tanks
read a certain percentage, their request
was not granted. We need to find out
where the real need is because people are
out there risking their lives, we need to
watch out for the safety of who we send
out and how we send them out.

Chair – We all know how it was this last
time and how we can improve this. Chair
announces in the future when EPP is
needed, the command center will be here
at the Council chambers.
Concerns and solutions continue:
• Selection of a coordinator is
very important as this person is the per-
son who will call the Chairman and ad-
vise him to activate EPP. It is more than
one person can handle; it takes a team.
Teamwork. Now we know when a storm
will move in and how long it will be here.
• In selecting an EPP Coordinator,
if there are more than person interested,
let them come forward and present their
plans for EPP, to the Council.
• Volunteers – let employees and
the public know they can volunteer. PSA
• Lack of communication, people
in the east didn’t hear the EPP was acti-
vated.
• Should set guidelines which
would bring about declaration of EPP
• An EPP Committee- establish a
committee because it takes more than one
person to coordinate EPP efforts.
• Need to develop a plan, then we
will know who, what, and where will be
providing what service. We need to have
this in black and white, a written plan that
we are all going to follow.
• Importance of communication
and proactive planning.
• We need an incident command-
er.
• Need to get more people in-
volved, employees, community chairman,
community workers, all tribal programs
• We need individuals who can be
sent out immediately after getting their
call to check if the request for assistance
is valid…if they really do need the pro-
pane, wood, etc.
Motion to allow Robert Oliver be in
charge of the RST Emergency Prepared-
ness Program and that he work with Rob-
ert Long and Bill Giroux in developing an
EPP Plan to present to the Council next

Treasurer – A step that has been missing
is that the Council would approve a budg-
et for EPP and when EPP was activated,
that budget would be spent and an ex-
pense report was submitted to the Coun-
cil. Then the Council would approve add-
ing more funds to that line item.
We ask community chairmen to be in-
volved. Recommendations:
• communities to develop their
own plan
• get a list of elders
• make sure the community chair-
men have a phone number
• should set some of their commu-
nity allocation aside to help out.
CHRs used to check on the elders, the
program direct
Question – who will refund money to
people who prepaid when ordering pro-
pane from Sicangu Propane. They will
refund, they need to come in to the office
and request their refund.
Robert Oliver says he will tweak the plan
and develop a flow chart.
Command Center will be set up in the
chambers. Chairman says he will be
around.
Motion to approve $15,150 from the Mis-
cellaneous Holding line item to purchase
jackets, bibs, hoodies, gloves, socks,
boots from Scheels for EPP personnel.

Rosebud, and any other community the
cost of food, security, etc., incurred in
opening up their community buildings to
provide a place for people to go who ran
out of heat, food, etc., during the recent
winter storm and extreme cold, to be paid

Office of the Special Trustee – James
Cordry, Trust Officer
The grazing permit season is nearly over
so the income of money is slowing down
into the Tribe’s proceeds of labor ac-
count. As of the beginning of the fiscal
year, so far, $341,160.00 has come into
the Tribe’s proceeds of labor account
which has been drawn down and used by
the Tribe. Balance as of today is a little
over $35,000. Next influx of funds will
be just before March, the farm and pas-
ture season. Reports the balance of the
proceeds of labor account every Monday
to the Tribe and once it builds up, the
Tribe draws it down.
ILCA Recoup Monies – The one account,
as of yesterday, has $2,151,000.00 in it
plus what is in the larger acquisition fund
so it is getting to a large value there. Has
been trying to get some kind of status on
that.
When he hears something about that, he
will let the Tribe know. The people in DC
who Mr. Cordry has been working with
on this were people who worked on the
SCS but were transferred to other posi-
tions within the federal government. Jim

Cason is the individual who has the most
input into that.
Update on the Salazar funds which were
invested. The market has been very
healthy, markets were up 25% in the past
twelve months. This can change quickly.
So far it has been good. It is up to the
Council when to draw down the profits.
Land By-Back program will be coming
back to Rosebud later on this year. They
are looking for a point of contact with
Rosebud. Once those funds are gone,
there will no longer be a Cobell Land Buy
Back Program.
Update on moving funds from one T-
account to another. Still working with the
bureaucracy to get this done. Needs a
copy of the resolution passed about three
months ago. Will get from secretary’s
office.
Treasurer – All the difficulties we’ve
been having with collecting these leases,
can we start collecting that money here
without going to through the Bureau?
Concerned about the loss of ILCA mon-
ey.
Dean Wilson, BIA:
• Option - Tribe can contract op-
tion
• Option - 100% owned tracts can
be direct pay to the Tribe
• Option - ILCA tracts – suppos-
edly forgiven but need to find out status
of lien – can explore a direct pay route on
those
Any direct payment on the tribal land will
be made directly to the Tribe not TLE.
Treasurer will sit down with In-House
Attorney and draft up a letter of intent to
contract.
Bureau of Indian Affairs – Leann Beardt,
Superintendent
Leann advises sending the letter of intent
because this will then show what is all
available to the Tribe.
No report from the BIA last month due to
the Superintendent being sick.
We received a printout from our Budget
Office where OJS for CR2 and three have
been made available to the Tribe. We are
working to get it obligated and put into
the system so it will be available to the
Tribe by Friday.
The TPA money is being loaded as well
for the CR2 and 3 and those are on the
printout for 2018. This is just our TPA
money does not include other recurring
funding such as social services, welfare
assistance, OJS funding, this is only TPA
funding. Balances as of today and doesn’t
show new allocations for 2 & 3. Will
show up tomorrow once it is entered into
our system.
Still some small balances left in 2017
which the Regional Office will be rolling
up. Some of our accounts were in the red
so we had to use some of our other fund-
ing, salary savings to help with the fund-
ing for fire management and facilities.
OJS funding up to CR3 is being loaded
this morning and will then notify RST
Finance to draw it down. Funding is
slowly trickling in; we still haven’t re-
ceived any welfare assistance funding yet.
Still holding $47,000 worth of burials so
far this year from our last CR. Don’t
have any funds yet they haven’t distribut-
ed the wealth yet. Welfare assistance is
the one that historically been piece
mealed out to us and has never been at
100%. Owe about $22,000 on burials.
Burial assistance is being approved for
those who qualify and the bill will be paid
once BIA receives its funding. Advises
the tribes ask at the welfare assistance be
allocated when the budget is approved
with the rest of the money.
Regional Fire Management Officer is
doing program review on the fire man-
agement program. A Fuels person from
Aberdeen is down looking at our fuels
program. They are also doing an assess-
ment and after action review on the crew
who went out to California. Rosebud was
the only one able to send out a crew when
the order came down. A few guys from
Pine Ridge joined in and helped us make
up our crew.
February 1 & 2, 2018, the Deputy Re-
gional Director will be here to provide
training on tribal government and our
Budget Officer will also be present to
give a presentation on the budget.
Secretarial Process – If the Tribe would
call for a secretarial election amending
the RST Constitution removing the ap-
proval of the Secretary of Interior from
the approval process, the Tribe thereafter
can amend its constitution for its own
final approval by the Council.
First time, we have 100% Indian opera-
tors for all of our range unit allocations.
Some operators are young and new to the
field so we are putting a workshop to-
gether, will be working with the tribal
Land & Natural Resources Committee,
setting an agenda and a tentative date of
April 18 and a location. Biggest issue is
the conservation and preservation of the
land use.
Drought assistance under the USDA Dis-
aster Relief Fund. How does the Tribe
and allottee fit into this, are we collecting
any funds from this? Is the Tribe, TLE,
the allottee taking an active part in this?
This is not under the BIA so they are not
involved in this. Normally, the permittee
is the recipient of funds.
Question - why the permittee is the one
who is receiving the Disaster Relief funds
when it is the land owner who is bearing
the damage overgrazing does to the land.
BIA is failing in monitoring our land,
when you have a drought and you have
over grazing on top of that, it is the BIA’s
responsibility. Why are the permittees
receiving money when it is the Tribe and
allottee who are the land owners and not
receiving any of these funds? BIA, TLE,
Land Office are failing the allottee by not
monitoring the overgrazing that is going
on in the range units.
Direct our tribal attorney look into this
and bring us a report on where the Tribe
and individual landowner sit in this situa-
tion because the Tribe and allottees
should be the ones receiving something
off of this, whether it is a percentage be-
cause it is our land. This is where BIA,
TLE and the Land Office need to step in
to go out and take a look at these lands
and see if they can be utilized next year
because some are so overgrazed. It is
those who sublease who let the land be-
come so damaged.
Wendy Wells, BIA Range Specialist, we
do have a lot of range units and leases. If
you see land that looks abused, please call
me with a location or tract number and if
it is a range unit, it will be addressed. No
one has turned in any tracts to me that are
a part of a range unit. Has looked into any
complaints that did come in.
Motion that our tribal attorney look into
the USDA Disaster Relief Fund on behalf
of the Tribe and the individual Allottees
and bring a report back to the Tribal
Council by a deadline of 30 days. Motion

We put this land into the permittees care,
trusting them to take care of the land
when we lease it to them. We have been
taken advantage of far too long.
We may need to begin our discussion
with USDA, FSA, State USDA Board.
24th Council meeting have the person
involved here.
Schedule the land forum within a 30-day
timeframe with TLE, BIA, SOLO regard-
ing the use of our land, the damage done
by overgrazing. Overgrazing begins the
destruction of the land. We need to start

implementing a process to address com-
pliance, how to best utilize our land, how
to best take care our land. Change the
language in the grazing resolution that
needs to be changed. Take a look at what
we have and move forward.
We have about a million acres with half
being farm/pasture leases and the other
half being range units. They fall under
different rules. Range unit permittees
have to pay different fees, required to
have a plan. Farm/pasture don’t have
such requirements, you can just rent it.
No $3/head foreign fee, etc. Compliance
needs to be enforced. USDA Drought
Relief program is through USDA, FSA,
and regulations were brought from the
Farm Bill.
Semi-Annual BIA meeting on range
units, pasteurizing authorization is what
the permittee is taking to USDA and it is
what USDA is accepting as the permit-
tee’s authority to graze that amount of
cattle on that land. In the past, this was
not accepted. Question is who authorized
USDA to begin accepting this. To address
the range units, the tribe needs to change
the language of the pasteurizing authori-
zation that the permittee is not eligible for
any USDA program. It comes down to
the language in the tribal documents and
enforcement of compliance.

Terry Pechota served as the Hearing Of-
ficer. Mr. Pechota stated he has spoken
with both parties and they were both in
agreement that a public apology would

followed by a verbal statement by Valerie
Crazy Bull which was recorded.
In-House Attorney advises nothing in
black and white to prevent him from be-
ing sworn in, no record that he was found
guilty of violating an ordinance.

to all Council representatives. Areas cov-
ered in the court assessment are then
funded such as the court recording sys-
tem. There are space and infrastructure
issues with the court which can be ad-
dressed in the future.

season and income is beginning to come
in.
2017 – Proceeds of Labor Account in-
coming $2,559,931.00 of which
$1,573,128 is a one-time WAPA fund.
$986,803.00 is lease income, range per-
mit, all other income.
2018 – Proceeds of Labor Account is at
$492,795 and drawn down $432,090
As of today, over 60,000 in Proceeds of
Labor Account – expecting more before
fiscal year is over.
Land Buy Back coming back end of this
year into 2019 so more income will be
coming back into the Tribe’s Proceeds of
Labor Account.
Work has resumed on the ILCA Recoup
monies.
No response from TLE or SOLO with
information on the three accounts he has
been working on, no record of certificates
transferred, no record of transfer for man-
agement of the land. The nature of these
three accounts, there may not have been
any transfer. Reserve lands during the
settlement days within the boundaries of
the Rosebud Sioux Tribe, land that was
not settled. Question – who manages
them? In the absence of any documenta-
tion showing any entity, its tribal land.
Russell – what do we, as a body, do to
make these things happen? (reference to
information requested from TLE and/or
SOLO)
Treasurer Wayne Boyd – first time at-
tending TLE meeting, thought since it is
an old organization which has been in
existence for a long time, thought they
knew how to do things properly and it
was all automatic. It’s not that way. The
whole process they go through is not a
good process. Sat down and helped them
with their budget, it is now where you can
hold someone accountable for it Spent a
lot of time verifying their income, the
income they had in their budget was not
accurate – income projection that it is
realistic. They needed someone to help
them get them on track.
The problem with this account and not
knowing anything about the assignment
holders, the record of TLE certificates
and who their assigned to are far apart,

from what information they have on file
and what information they have on their
certificates are far apart so they can’t an-
swer Russell’s question. What has to hap-
pen hopefully, they can take some of this
money and advertise a for someone to
come sit down with them and go through
a long, slow process to identify who these
certificates belong to. Not only were they
not issuing when they were supposed to
but also a lot of board actions taken that
transferred, bought these certificates but
no follow up. So, board action, resolu-
tions but the actual work either selling or
acquiring these certificates was never
done which compounds the problem.
They go by board action so they transfer
money to different parties but the actual
legal documents that allow that to happen
never took place. So, a lot of work that
has to be done there. Hoping to sit down
with the BIA to set some of this money
aside to begin that process.
Six months ago, this information about
these t-accounts was requested. The tribe
should not have to expend more funds to
hire someone do this work which needs to
be done since TLE staff members have
been hired and are working to perform
these duties.
Transfer of certificates – Any land that
came into the name of the Rosebud Sioux
Tribe, TLE was to issue certificates for
the management of those tribal land.
Question – Were certificates issued for
every tract of land that came under the
Rosebud Sioux Tribe? These are the cer-
tificates the tribe (council) votes every
shareholders meeting.
Lois Antoine, tribal elder, addresses the

tribal programs, hiring process, monthly
reports, need for organization. LIHEAP
continues not paying electricity bills
causing additional expenses with the late
charges.

Shirley Big Eagle, RST ICWA coordina-
tor, will schedule and coordinate a meet-
ing with Dana Hanna, ICWA Program,
Sicangu Child & Family Services and the
Spotted Tail Crisis Center to address the
need to respond and placement of tribal
children. How can we help these children
who are falling through the cracks and
being lost to the non-tribal welfare sys-
tem? How to maximize the resources we
have.
One solution to consider is to work out of
the Attorney General’s Office as there is
a secretary who can assist in answering
calls.

Take a look at programs that are sup-
posed to be generating money for the
tribe, are they actually bringing in money
or costing the tribe money?
Chute II – are they generating money, if it
is, where is the money going?
Tribal Ranch – is it generating money or
is it costing the tribe money?
Community funds – need to be accounta-
ble for the funds they receive and how
they are spending it.
Considering the revenue of the casino,
why are we looking at putting up a casino
at Winner? Where is the money coming
from to build a casino in Winner?
Ambulance Service – in the deficit
Casino revenue screen – programs funded
with casino revenue have been keeping
their expenses down.
Need to stabilize the casino income. Casi-
no needs to pay its own bills before send-
ing money to the tribe. Always a month
behind in their accounting. Don’t want to
get too far behind. How much we can
take out of the casino reserve account, put
it under the general account. Right now,
general account is good. When we re-
ceive our casino dividend, we need it to
fund LIHEAP.

days to govern the spending of casino
revenue funds budgeted to the communi-

Treasurer Wayne Boyd informs Council:
Council approved monies under Indirect
Cost to hire a person to perform audits,
forensic audits in-house internal audits
and this position will be employed by the
Tribe. Will be coming aboard first of
April.
Recommends on an interim basis, allow
Freda to access monies from the General
Account up to $250,000.00. Last year we
appropriated $600,000 from the Appro-
priations Account and $250,000 is left
and recommends we use those monies for
shortfalls with the Casino Account so we
can make payroll and communities.
Programs funded by casino revenue need
to seriously consider finding other fund-
ing sources for their programs.
Discussion -
Suggestion - we can use Special Appro-
priations or Salazar funds set aside for
communities.
Suggestion – using our land to generate
revenue

lize Salazar funds not to exceed
$250,000.00 to supplement the Casino

LIHEAP Director –
Under the supervision of the Tribal Presi-
dent, the Program Director is responsible
for direct supervision of the RST LI-
HEAP Program including operation of
assigned grant, assurance of delivery of
services to LIHEAP eligible households,
office infrastructure, events/outreach co-
ordination and other administrative tasks.
This individual is responsible –
Plan and supervise implementation of
LIHEAP grant which involves direct as-
sistance to LIHEAP eligible households.
Supervise staff to ensure competent deliv-
ery of services to LIHEAP eligible house-
holds.
Develop program budget and maintain
program expenditures within budgeted
parameter.
Establish and adhere to policies and pro-

were agreed upon with Council and
$150,000 was agreed upon settlement
payment.
