appropriats where is can be demonstrated, clearly and convincingly, that a party has sentiently
set in motion some unconscionable scheme caleulated to interfere with the judicial system’s
ability impartially to adjudicate a matter improperly influencing the trier of fect or unfairly
hampering the presentation of the opposing party’s claim or defense.” Id.
It is therefore:
ORDERED and ADJUDGED:
1, The Defendant’s Motion to Dismiss with Prejudice is granted for fraud on the Court;
2. The Order Dismissing Complaint with Prejudice dated February 10, 2010 is
incorporated herein;
3. Defendant's counsel shall have thirty (30) days within which to amend their motion
for attorney's fees and costs;
4, The Plaintiff(s) are ordered to go forth without day.
