ABSTRACT

Under Article 333 and 334 of the Revised Penal Code of the Philippines it is
provided that to be convicted of adultery, all that a married woman has to do is to have
sexual intercourse with a man other than her husband.To be convicted of concubinage,
on the other hand, the man’s act of sexual infidelity is not enough. The other elements
must be satisfied: it must be under scandalous circumstances.

However, under our existing laws, criminal charges for same-sex affairs involving

married individuals are non-existent. This fact leaves the offended party no recourse in

order to punish their offending spouse. Thus, the measure seeking to broaden the

definition of of adultery and concubinage through the inclusion of same sex extra-marital

affairs may be one of the ways in order for the the offending party to be held liable.
