ANNEX “A”

REAL ESTATE MORTGAGE


KNOW ALL MEN BY THESE PRESENTS:
This Real Estate Mortgage made and executed by and between: ROLDAN MALLA REYES and
ARCHELIE ALFEREZ REYES both of legal age, Filipino, with residence at P-6 Kahapunan, Valenica
City Bukidnon hereinafter referred to as the “MORTGAGORS”,
-and-
MEDIDAS MEDICAL CENTER, INC., a duly registered corporation under Philippine laws with
office address at Poblacion, Valencia City Bukidnon herein represented by
____________________________________ and
hereinafter referred to as the “MORTGAGEE”.
WITNESSETH: That –
WHEREAS, the MORTGAGORS are the absolute owner of a portion of parcel of land
situated at Kuya, Maramag Bukidnon, as evidenced by Original Certificate of Title No. P-5217;
WHEREAS, the MORTGAGOR is indebted to the MORTGAGEE in the principal sum of
TWENTY FOUR THOUSAND SIX HUNDRED NINETY TWO PESOS AND FIFTY CENTAVOS (Php
27,233.81), Philippine currency, under and by virtue of a Promissory Note (“Note”) attached
herewith and made an integral part hereof as Annex “A”;
WHEREAS, the MORTGAGORS has agreed to secure the payment of the Note to the
MORTGAGEE by means of a good and valid mortgage upon the property herein described
below;
NOW, THEREFORE, for and in consideration of the foregoing premises and as security
for payment of the aforesaid obligation, the MORTGAGOR has transferred and conveyed, and
by these presents transfer and convey by way of MORTGAGE, unto the MORTGAGEE, his/her
heirs, successors or assigns the aforesaid a portion of a parcel of home lot with improvements
situated at Kuya, Maramag Bukidnon particularly described as:
“Lot 352, Pls-506-D Bounded on the NW., points 3-4 by lot 353; on the NE., points 4-1 by
Lot 360; on the SE., points 1-2 by Lot 351 and on the SW., points 2-3 by Road; all of the
subdivision plan. Beginning at a point marked “1” on plan being N. 84 deg. 15’W., 14018.61 m.
from B.L.L.M. No.1, Pls-506-0; containing an area of SIXTY THOUSAND (60,000) square meters.
All points are indicated on the plan and are marked on the ground by Pls. Cyl. Conc. Mons.15 x
60 cm. Bearings trua.”
It is agreed and understood that if at any time the MORTGAGOR fails to comply with
any of the conditions and stipulations herein agreed or in the separate instruments evidencing
the obligations hereby secured or shall, during the time this mortgage is in force, writ of
garnishment and/or attachment be issued against any of the assets or income of the
MORTGAGOR, then all the obligations of the MORTGAGOR secured by this Mortgage shall
immediately become due and payable and defaulted and the MORTGAGEE may immediately
foreclose this mortgage judicially, or extra-judicially pursuant to Act No. 3135, as amended. The
MORTGAGEE is hereby appointed attorney-in-fact of the MORTGAGOR, with full power and
authority to take actual possession of the mortgaged property at once, and to forthwith
foreclose this mortgage judicially, or to sell the above-described properties extra-judicially in
accordance with Act No. 3135, as amended, and to take such other action(s) as he may be
deem necessary to recover the amount due; and in the event of such judicial or extra-judicial

foreclosure or other legal action, the MORTGAGEE shall be entitled to compensation for
expenses, attorney’s fees and costs of collection, which is stipulated to be twenty thirty percent
(30%) of the indebtedness then unpaid but not less than Php1,000.00.
The condition of this mortgage is such that if the MORTGAGOR shall well and truly pay
or cause to be paid to the MORTGAGEE the obligation in the principal sum with accrued
interest, according to the terms and tenor hereof, then this mortgage shall thereby fully
discharged and without further effect; OTHERWISE, it shall remain in full force and effect and
shall be enforceable in the manner provided by law.
IN WITNESS WHEREOF, the parties have caused these presents to be signed on May
27, 2019 at Valencia City, Bukidnon.

Mortgage and they acknowledged to me that the same is their free and voluntary act and deed.
This contract relates to the mortgage of a parcel of land situated in Kuya, Maramag,
Bukidnon, consisting of four (4) pages, including this where the Acknowledgement is stated,
and was signed by the parties on the left margin hereof on each and every page of the
document.

ANNEX “A”

PROMISSORY NOTE

For value and services received in the hospitalization of our mother LOLITA DELA CRUZ
FONTANILLA, We promised to pay, jointly and severally to Medidas Medical Center Inc. – Valencia City
or order at its office at Valencia City, the sum of TWENTY FOUR THOUSAND SIX HUNDRED NINETY TWO
PESOS AND FIFTY CENTAVOS (Php 24,692.50), to be paid the full amount within One Month from now,
on June 27, 2019.

1. At the option of Medidas Medical Center Inc., interest due on this notice which is unpaid on
due date shall be added to the principal and it shall be subject to the same rate and penalties as the
principal.

2. Time is declared of the essence and upon default of payment as scheduled, the entire
obligation shall automatically be due and demandable together with the following interest;

3. In case of default in payment, I shall pay ten (10%) percent of the principal of the total unpaid
obligation as penalty plus costs and expenses of the collection, provided however, that in any case it is
necessary to collect this note through an attorney, I shall pay thirty (30%) of the amount due and unpaid
obligation as attorney’s fees, provided further that the same shall not be less than P 1,000.00.

4. The outstanding obligation shall be subject as well to a fixed amount of eight (8%) percent
service charge notwithstanding of any agreed terms of payment other than the interest stipulated in the
note.

5. The extension of the term of the obligation shall not be presumed to be an automatic
extension of the period of the obligation in the absence of any express stipulation. In the event of non-
payment of the obligation and/or the interest and penalty charges applicable, the total amount
outstanding shall continue to bear interest and penalty charges as herein above indicated.

6. I/we furthermore declare that any action which may arise out of or in connection with this
note shall be instituted exclusively in Valencia City, before any court of competent jurisdiction, to the
exclusion of other courts.
