CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE made and executed by and between:

MARITES L. ALAM, of legal age, Filipino, married and a resident of


Canlas Subdvision, Dumaguete City, hereinafter called the LESSOR, and

JAY ROLFE SOBREVIÑAS, of legal age, Filipino, single and a


resident of Calindagan, Dumaguete City, Negros Oriental hereinafter called the
LESSEE.

WITNESSETH:

WHEREAS the LESSOR is the owner of a four (6) door apartment units
located at Canlas Subdivision located in Dumaguete City, known as Marites
Alam Apartment. The LESSOR offers to lease each of the doors of Marites
Alam Apartment to any interested party;

WHEREAS, the LESSEE has expressed to the LESSOR his desire to


lease one of the units giving this new contract its effectivity on June 21, 2017;

NOW THEREFORE, the parties agree to enter into this contract of lease,
subject to the following terms and conditions:

a. TERM OF LEASE - This lease is for a period of six (6) months, to begin on
June 21, 2017 to December 21, 2017, subject to renewal upon the mutual
consent of the herein parties. Upon the expiration of the contract, if no
new contract of lease shall have been executed by them, the provisions of
the New Civil Code of the Philippines on Lease shall apply;

b. DEPOSIT and RENT – Upon execution of this contract, the LESSEE shall
deliver to the LESSOR One (1) Month advance rent and a deposit
equivalent to One (1) Month. Monthly rent shall be Fifteen Thousand
PESOS (PhP 15,000.00) in Philippine Currency, and shall be paid every
Twentieth (21st) of each month;

c. PROHIBITIONS

c.1. The LESSEE is prohibited from subleasing the leased premises during
the period of this Contract without the written consent of the LESSOR.
The LESSEE shall not store in the leased premises any dangerous,
obnoxious or hazardous substance. The LESSEE shall not bring any pet
animal inside the house;

c.2 The LESSEE cannot introduce improvements on the building that will
destroy the structure without a written consent of the LESSOR. Any
damage caused to the wall or any part thereof through the act or
negligence of LESSEE shall be for the account of the LESSEE;
d. UTILITIES – that LESSEE shall pay for all utility bills and shall pay them on
time. The One (1) month deposit shall be used to be paid for any
unsatisfied utility bills. Only the balance thereof shall be returned to the
LESSEE;

e. DILIGENCE – The LESSEE shall take care of the unit with a diligence of a
good father of a family and shall maintain it in a habitable condition at all
times. The LESSEE shall maintain security within the premises of the
compound, by ensuring that the gate is always closed whenever he or his
household enters and leaves the premises;

f. PRE-TERMINATION – In the event that LESSEE shall pre-terminate the


contract, he shall notify the LESSOR Two (2) Months before intended date,
otherwise, he shall forfeit One (1) Month deposit, without prejudice to the
right of the LESSOR to claim for any deficiency for unpaid utilities or
repairs;

g. BREACH OR DEFAULT - If said premises are used by the LESSEE in


violation of the terms and conditions of this contract, the LESSOR shall
have the right to rescind this contract. Same right of the LESSOR shall
be available if the LESSEE will not pay any monthly rental described
above.

ACKNOWLEDGMENT

BEFORE ME, appeared with their respective proof of identity, the parties known
to me to be the same persons who executed the foregoing instrument consisting of two
pages including this page where the acknowledgment is written, signed by them and
their instrumental witnesses on every page, and they acknowledge to me that the same
is their own free act and voluntary deed.
