Dombrowski Case No. 96 D 217 LETTER DECISION Dear Ms. Dombrowski, Ms. Dykes and Mr. Hoffinan: The Court is in receipt of the letter from Ms. Dombrwski dated August 12, 2004. Currently, there is an order requiring supervised parenting #ine at YMCA Safe Visits in place. Likewise, there is still a Case Management Otder infplace. ‘Thus, the ease management procedure should be followed regarding the isue of whether the supervision requirement should be lifted or modified. . As the Court has repeatedly stated, it is not prohibitifg the Respondent from. having parenting time with her child. Rather, the Court en take advantage of this opportunity to see her daughter. As (i) procedure in place to address the concems relating to the si the GAL appointed to represent the child should also have ffput into this issue. Richardson v. Dombrowski Case No. 96 D217 Itshould be noted once again that the Court rarely to be a long-term solution. In this case, neither the parties for the District Attorney's Office have filed an action in juvenile court to challenge thf fitness of the Respondent to parent. As such, for the purposes of this divorce action, thf Court continues to presume that both parents are capable of caring for their child. See froxille v. Granville, 530 US. 50, 147 LEd, 2d 49, 210 S.Ct. 2054 (2000); In re Osborne 1 Kan. App. 2d 374, 901 P.2d 12 (1995); K.S.A. 60-1610 (a)(3)-(5); and K.S.A. 60-5 16(a). Thus, the parties, the GAL and the Case Manager should focus on getting a p Which is in the best interests of the cbild. This letter shall serve as an order of the Court.
