The name of the Project is: RAPDRP “PART-B”.

ITB 4.1 The individuals or firms in a Joint Venture, Consortium or Association shall be jointly and
severally liable. A copy of Joint Venture/ Consortium Agreement or the Letter of Intent to
enter into a Joint Venture/ Consortium/ Association, indicating joint and several liability
among the parties to the Joint Venture/ Consortium/ Association, should be provided with
the bid. Joint Venture/ Consortium/Association may be formed of a maximum of not more
than THREE partners.

B. BIDDING DOCUMENT

C. PREPARATION OF BIDS

ITB 10.1 (j) The Bidder shall submit with its Bid the following additional documents:
1. Commercial questionnaires duly filled in as per Volume II
2. Technical Questionnaire duly filled in as per Volume II
3. Set of contract drawings as per Volume II

ITB 14.1(b) The Bidder shall submit along with the Bid, the guaranteed technical particulars, technical
drawings, calculations sheets, if any, and any other information that is required to be
submitted as given in the detailed technical specification for each item as given in Volume
II of the Bidding Document.

The type test certificates for all the items shall be required to be submitted within twenty
eight (28) days of the date of Notification of Award to the successful bidder. Failure to
submit the type tests shall constitute sufficient grounds for the annulment of contract as per
sub-clause 40.2 of Section 1.

The type test of any item shall not be more than three (3) years old from the date of
submission of Bid.

ITB 16.3 Bidders shall note that the plants and equipments included in Schedule No. 1 above
exclude materials used for civil, building and other construction works. All such materials
shall be included and priced under Schedule No. 2, Survey, installation and other services.

Schedule no. 3 is for the Annual maintenance of the Facility covered under the scope of the
Bid for a period of five (5) year after commissioning of the Facility or part thereof and
includes cost of repairs/ replacement of the damaged/ defective plant beyond the period of
Defect liability, as specified in Section 6 and Bid form.

If the bidder is submitting bids for more than one lot, Schedules No. 1 to 4 are required to
be filled up and submitted separately for each lot.

ITB 16.4(b) Word ‘survey’ is added before the words ‘local transportation’.
The words ‘the provision of operation and maintenance manuals, training,’ are deleted.

ITB 16.5 The prices shall be firm for all items except power transformers, distribution transformers,
AAA conductor, PVC cable, AB cable and H Beams.

ITB18.1 The bid validity period shall be 180 days.

ITB 19.2 The bid security shall be a demand guarantee, and shall be submitted by way of an
irrevocable bank guarantee in the form included in the section 4 (Bidding Form). The form
will include the complete name of Bid. Bid security shall be valid for 28 days (twenty eight)
beyond the original validated period of the bid, or beyond any period of extension, if
requested under ITB 18.2.
The demand guarantee shall be an unconditional and irrevocable Bank Guarantee for the
equivalent amount of advance from Scheduled Commercial Bank excluding Cooperative
Bank and Regional Rural Banks, having paid up capital (net of any cumulative losses) of
Rs. 100 Crore or above (the latest annual report of the Bank should support compliance of
capital adequacy ratio requirement).

ITB 19.7 The bid security declaration shall not be acceptable

ITB 21.1 The Bidders shall prepare one original of the documents comprising of the bid as
prescribed in ITB 11 and clearly mark it ‘ORIGINAL’. In addition the Bidders shall submit
one more copy of the bid and clearly mark it as ‘COPY’. In the event of any discrepancy
between the ‘ORIGINAL’ and the ‘COPY’, the ‘ORIGINAL’ shall prevail.

ITB 20.2 The written confirmation of Authorization to sign on behalf of the Bidder shall consist of:
a. Notarized Power of Attorney: If the Bidder is from a country where this practice is
not in use then a similar legal instrument of authorization as applicable under the
home country laws of Bidder must be provided.
b. Bids submitted by an existing or intended Joint Venture or Consortium shall include
an undertaking signed by all parties
(i) stating that all parties shall be jointly or severally liable, and
(ii) nominating a Representative who shall have the authority to conduct all business
for and on behalf of any and all the parties of the Joint Venture or Consortium or
Association during the bidding process and, in the event the Joint Venture/
Consortium/ Association is awarded the contract, during the contract execution.

D. SUBMISSION AND OPENING OF BIDS

i) Part I : shall contain bid security in accordance with ITB 19 and following
documents:
(a) Written confirmation authorizing the signature of the Bidder to commit the bid in
accordance with ITB 20.2
(b) Documentary evidence in accordance with ITB 13 establishing the bidder’s eligibility
and qualification to perform the contract if its bid is accepted.
(c) Technical proposal in accordance with ITB 15
(d) Documentary evidence establishing in accordance with ITB 14 that the plant and
services offered by the bidder conform to the bidding document
(e) In the case of the bid submitted by JV, JV agreement, or letter of intent into a JV
including a draft agreement indicating at least the parts of the plant to be executed
by the respective partners
(f) List of sub-contractors, in accordance with ITB 15.2
(g) Technical and commercial questionnaire duly filled in
(h) Any other documents required in the BDS
(ii) Part II: Shall contain (a) letter of bid complete duly filled in and (b)complete schedules
as required including price schedules in accordance with ITB 11 & ITB 16.

ITB 21.2 A. Both the parts of the bid shall be submitted in two envelopes and these envelopes
shall be super scribed clearly as Part I & Part II .Both envelopes duly sealed and
super scribed as given in 21.2(B) are to be kept again in one envelope and sealed
and super scribed as given in 21.2(B)
B. The inner and outer envelopes shall:
(a) bear the name and address of the Bidder;
(b) be addressed to the Employer in accordance with ITB 22.1;
(c) bear the specific identification of this bidding process indicated in the BDS 1.1; and
(d) bear a warning not to open before the time and date for bid opening.

ITB 25.2 The following clause is added

There after the envelope containing Part I of the Bid shall be opened to establish eligibility
& qualifying criteria of the Bidders. The Part II of the Bids of the Bidders, who meet the
eligibility & qualifying criteria, shall be opened at the time & date to be intimated in writing
later on.
ITB 25.3 Existing clause is replaced by following:-
At the time and date intimated to the Bidders, Part II of the bid containing Price Schedule
shall be opened; reading out name of the Bidder and whether there is a modification; rates
quoted, any discount offered and other details as Employer may consider appropriate.
Price Schedule and discounts if any, read out at bid opening shall be considered for
evaluation. Unless otherwise specified in the BDS, all pages of the original Letter of Bid
and Price Schedules are to be initialed by at least three representatives of the Employer
attending bid opening. No bid shall be rejected at bid opening except for late bids, in
accordance with ITB 23.1.

F. AWARD OF CONTRACT

ITB 39.3 The successful Bidder shall submit the Manufacturer’s authorization within twenty-eight
(28) days of the notification of the award. Failure of the successful Bidder to submit the
Manufacturer’s authorization of all major items within the specified period shall constitute
sufficient ground for the annulment of Contract as per sub-clause 41.2 of Section 1.

ITB 40.1 The Bank guarantee will be from the Bank as described in ITB 19.2 above.
