Dear Representative Stearns,

Americans have lived under a Constitution dedicated to individual liberty for two
centuries. When contrasted with the experience of other nations our Constitution
has promoted American freedom and exceptionalism until now. Since 1935, this
country has been on a long trek towards socialism ruled by politicians who play
Americans against each other thus creating division and dependency that makes
the current State of the Union suck.

This sucking sound began at the turn of the20th century when elites dismissed
American values preferring instead British Utilitarianism that denigrates the
American concept of natural rights. Subscribing to the German schools of “good
government“ that promotes social engineering, domestic democracy and advocates
government as the engine to solve all manner of social and economic problems.
America’s government slowly transformed itself from smaller Constitutional form1 to
the oversized, bloated, bureaucratized, and unconstitutional federal government we
see today.

In 1935, members of all three branches of government fraudulently conspired to

emulate and impose European socialism on the American people. President Franklin
D. Roosevelt and progressives of both parties brought Americans New Deal
legislation. FDR

➢ Tried to pack the court to enact his New Deal programs and failing wrote to
the Chairman of the House Ways and Means Committee, saying, “I hope you
will not permit doubts as to the constitutionality, however reasonable, to
block the suggested legislation.”2

The Supreme Court administered the Constitutional coup de grâce

 ➢ In U.S. v. Butler, Helvering v. Davis, and NLRB v. Jones and Laughlin Steel
Corp. Justice Cordozo’s flexible interpretation of the general welfare3 and
commerce clause 4in Halvering v. Davis held “The power of Congress to
authorize expenditure of public money for public purposes is not limited by
the direct grants of legislative power found in the Constitution.” He used the
1788 dictionary definition on taxes saying, “There have been statesmen in
our history who have stood for other views…We will not resurrect the
content. It is now settled by decision. The conception of the spending power
advocated by Hamilton …has prevailed over that of Madison.”

President Johnson and Democrats gave Americans the Great Society and Medicare
both of which are unconstitutional absent amending 1 § 8. The election of Barak
Hussein Obama, a man whose formal education, grounding, cultural, and ideological
views are not American in origin brings FDR’s socialist vision full circle. Obama

➢ Announced his entry into politics in the living room of Saul Alinsky and
Bernadine Dohrn. Both are communists whose ties to the communist party
are well known.
➢ Believes the “Constitution is a negative document “because it commands
what government cannot do.
➢ Wants to change America. By action and deed, he and his fellow travelers
have tried to impose European communism/socialism by nationalizing
healthcare, and using the law to impose central economic planning on
American business and the economy.

America is in trouble today because politicians in both parties ignored the

Constitution’s limits on federal political power. They refused to acknowledge, “That
the powers authorized by the Constitution are few and defined5” as enumerated in
Article 1§ 8. Two weeks ago, NBC’s Brian Williams asked Speaker Boehner, “Name a
program right now that we could do without.” Speaker Boehner replied “I don’t
think I have one off the top of my head” His reply does not generate confidence this
Constitutional Republic will be restored by this or any Congress.

To their credit, Speaker Boehner and House Republicans put teeth in the rewritten
house rule that has been in existence since 1997. However, all this rule does is
remind congress the Constitution authorizes 18 federal powers. Enforcement is
required. Furthermore, requiring Congress to cite specific authority will not work if
Congress continues to follow the old pattern of treating the commerce clause as a
federal power that ignores the 10th Amendment.6 Since most of what Congress
legislates is unconstitutional I will be watching to see what they do to undo
programs and agencies that are unconstitutional. Symbolic gestures alone will not
restore constitutional governance.

With the old guard hanging on to the status quo, I hope the incoming freshmen are
more representative of Republicans like Michelle Bachman, Sara Palin, and Jim

DeMint who are defenders of the Constitution. It takes morals, principles, ethics,
and cojones to stay the course and do what it takes to reinstate the Constitution to
its lawful and preeminent status. Restoration requires guts and principles that are
not politically expedient or for sale. Without Constitutional governance and the rule
of law, the state of our Union will continue to suck.
