who bring trucks to East Hampton Town

The markers, which would delineate
the eruv and be attached to utility poles,
have been the focus of controversy since
the boundary was first suggested.
One of the suits sets members of the
East End Eruv Association against the
Town of Southampton, as well as Quogue
and Westhampton Beach villages. EEEA
supports the eruv and seeks damages
for, according to the complaint,
actions that “constitute intentional
deprivation of and interference with”
their Constitutional rights.
For two years, EEEA has tried to
establish an eruv in Westhampton Beach,
part of Quogue and part of Southampton
Town. Without one, according to
the court documents, mothers with
children in strollers, as well as people
in wheelchairs, could not attend
Sabbath service. The municipalities
have taken “insupportable and incorrect
positions” that local laws prohibit the
establishment of the eruv, the complaint
states. The petitioners have asked the
courts to determine there’s no basis for
the prohibition of the eruv.
A second suit, filed by Verizon
and LIPA, asked the courts to order
municipalities not to block the
installation of the markers, which are
known as lechis, on their utility poles.
According to the complaint, officials
have said the installation of the lechis
is either not permitted at all or requires
approval under local laws regulating
signs.
The board voted last Friday to retain
the firm of Jaspan Schlesinger, LLP at a
cost of $15,000. One community member
asked whether the board thought
$15,000 would be enough to cover a
federal case and whether the attorney
was experienced in such litigation.
Councilwoman Bridget Fleming said she
was confident counsel could handle the
entirety of the task. Councilman Chris
Nuzzi said the initial fee was simply a
retainer to get started.

Police Chief
To Retire

One of the East End’s longest- serving
police chiefs will retire come April
16. Chief James Overton advised the
town board of his intentions during a
February work session, according to a
release from the Southampton Town
Police.
Overton started with STPD in January
of 1968. He made his way up the ranks
and was declared Chief in 1990.
“His only purpose during his entire
career was to serve the people of
Southampton Town to the best of his
ability,” the retirement announcement
prepared by Captain Anthony Tenaglia
states. “He would not bend to any
political pressure and maintained the
integrity of his position throughout his
entire career.”
The chief was quoted stating “It has
been a great run of 43 years.” He called
Southampton “a great town to work for.”
Overton will be missed, Tenaglia
continued. “He has been an inspirational,
dynamic, honest and sincere leader, and
a true friend to many of us,” the captain
concluded.
In other Southampton news, the
town board discussed getting green
and getting properties during its work
session last Friday.
Located on Vail Avenue in Riverside,
the properties in question were seized
by Suffolk County for non-payment of
taxes. The county’s 72H program allows
Suffolk to transfer the lands to the town
for use as affordable housing. Described

Public Access Television – LTV
We think it is high time East Hampton Town take a good look at
its arrangement with its local television station, LTV. As Cablevision
gobbled up local cable providers one by one, it agreed to allow for
local programming as a condition of sale. Many communities don’t
take advantage of it. In East Hampton under Frazer Dougherty, a true
visionary, locals were treated to a smorgasbord of unique features –
many, yes, were decidedly amateurish, but many more were quirky and
injected with small town charm.
Of late, though, the programming has remained amateurish, and the
broadcasts often dreadful. Unfortunately, LTV has become politicized
under a director who was openly rooting for local Democrats. Seth
Redlus not only did voice-over for campaign ads, but he even screened
for an opportunity to run for office on the Democratic ticket. He allowed
disgraced former town supervisor Bill McGintee to host a show, even
as he was running for office. McGintee often featured guests like
Democratic Town Councilman Pete Hammerle – a review of those shows
reveals a lie fest, as host and guest rattled off one whopper after another.
The town funnels over $600,000 to LTV, which can’t even get broadcasts
of town board meetings up on time in viewable condition. We’d be the last
to suggest censorship of any kind, but we suggest a committee comprised
and his former wife, Bonnie Grice, exorbitant salaries twice as high as
the industry norm. In doing so, a lot of good local people lost their jobs.
We were especially critical of the devious campaign to “Save Public
Radio” that is still ongoing at the station, which touted itself as Long
Island’s only local NPR affiliate. As we predicted last year, the channel
has drastically curtailed NPR programming, and continues to represent
itself as something it is not. There are more than a half-dozen signals
on the local airways that offer a steady stream of NPR programming.
The Number One-rated channel on the East End has a rich offering
of NPR syndicated shows. WLIU doesn’t even show up on the ratings
charts, by the way.
The point is, the public outcry to save the station –orchestrated by
Smith and carried out with the same fervor reserved for victims of the
Haitian earthquake, was little more than a self-serving stunt. All of the
local people who worked there were let go, and all that is left now is for
Smith to save himself. How ironic that the station announced with much
fanfare it was bringing Brice’s Saturday morning show back.
WLIU was just another local business that collapsed because of the
greed of the people in charge. One ad pleaded “save our local radio
station.” It’s not ours, though we have some wonderful locally owned
radio stations here on the East End that offer gainful employment to

Nevertheless there are still those that feel we are

not expected to. Fortunately they are limited to the

finally been overwhelmed by common sense.

small step for man, one giant step for mankind.”

This newspaper often criticizes WLIU –– now Peconic Public
Broadcasting -- drawing the ire of some bloggers that accused us of
picking on the beleaguered company or having some kind of agenda. We
submit it’s not that The Independent has been overly critical – it’s that
other local newspapers have steadfastly avoided the unmistakable proof
– that the greed of director Wally Smith forced Long Island University and
its successor, Stony Brook University to divest itself from the channel
because Smith was hemorroghing money—especially by paying himself
local people. WLIU/PPB is Wally Smith’s, and he’s gotten rich off the
backs of underpaid employees, grants, money from LIU, and donations
from hapless but well-meaning individuals who think they are saving
something meaningful. They are not. Some say the demise of the station
is inevitable; the days Smith can pull the wool over the public’s eyes
by claiming he offers a critical NPR outlet are already gone. It’s not
even public radio – it’s Smith’s privately owned company. And if he put
back some of the money he put in – it’s been said his salary was over
$150,000 – the station wouldn’t be in the mess it’s in. Certainly giving
money to Smith is a wasted gesture – the station as we knew it is dead,
and all of the co-signers of the bank loan used to purchase it must be
wondering when the final nail will be hammered.

and totally irrational decisions of the NCAA. As
my email address would indicate, I am a proud
alumnus of USC and for months Trojan fans have
been waiting for an article like this.
After reading every page of both the NCAA
COI report and USC’s response, it is clear that
the NCAA had an outcome already in mind before
they embarked upon their witch hunt. Evidence
was cobbled together that would literally get
laughed out of court and time lines were adjusted
contradicting the direct testimony of witnesses so
the COI could justify the over-the-top sanctions
they placed on USC.
The NCAA totally disregarded precedent
and came up with new rulings, standards and
punishments specifically for this case (USC
should have known). Most of the members of the
COI have a legal background (as do I) and it is mind
boggling that someone with a law degree or any
educated person, could sign off on that report.
The lack of both a logical evidentiary path and of
due process is utterly ludicrous. Equally appalling
is the lack of interest or just pure laziness that
the L.A. area media have shown in this matter.
Seemingly every week, a new scandal surfaces
involving college football and agents. Will the NCAA
spend 4 years investigating these schools like they
did with USC.? I highly doubt it. After four years at
USC, the NCAA found a football player’s family in San
Diego (150 miles from USC) received money and other
benefits from pseudo-agents (Lake & Michaels these
clowns never were, nor could they ever be, certified
as agents), a basketball player who took payment
from a street agent (whom the NCAA had already
investigated and cleared prior to his recruitment
by USC) and a women’s tennis player, who made
unauthorized phone calls from a USC phone.
And for this, it was determined to be a lack of
institutional control. Contrast this to the issues at
North Carolina, the” Agent-Gate” party that involved
players from most of the SEC schools, the never
ending torrent of secondary violations at Ohio State
and not to mention, the Auburn situation, which the
FBI is all over.
I don’t think any logical USC fan would deny that
Reggie Bush and his family received extra benefits.
But anything they received was from people with
no connection to USC. As you pointed out, the
“evidence” the NCAA used to tie Todd McNair is so
ridiculous and doesn’t even come close to meeting
the most basic evidentiary standards.
I’ll leave you with this tidbit from NCAA
President Mark Emmert. In a recent interview
with Dan Weber, formerly of the Riverside Press
Enterprise and now columnist for USCFootball.

equity program, which strives to help

healthy food. “When I saw what they were
doing, I thought it would be perfect for
Flanders, Riverside and Northampton,”
Fleming related. “Here we are, with
some of the best agricultural land in the
state, and we have a community with
no access to fresh produce, much less a
grocery store.” Access to fresh food, she
said, “is an overwhelming concern in the
community.”

Theatre Formation Forum
An open forum will be held at LTV Studios in Wainscott next Wednesday
at 4 PM to discuss the formation of a community theatre for East Hampton.
The community theatre, to be called Studio 3 Playhouse, will be a wing of
LTV. All rehearsals and performances will be held at LTV digs located at 75
Industrial Road.
According to a release announcing the forum, “A community theatre is
defined as a company of volunteers – from director to cast and crew - who
are not remunerated; usually sustained entirely by a community with no
outside help, or a collaboration between community members and occasional
professional artists. A community theatre generally resembles professional
theatre in all ways except in the unpaid nature of the artists. All ages and all
levels of experience are welcome to join.”
In addition to actors for the productions, the group will need costumers,

set designers, carpenters, musicians, singers, make-up artists, non-speaking

actors, assistants and gofers.
Anita Sorel, a long-time resident of East Hampton and a professional
theatre person with an impressive resume, will be the theater director and
US Coast Guard Auxiliary guiding spirit.

God Help Me
I’m not one of those people who pray
a lot – I assume that god, being, well, god,
is probably all up in his own thing and
has difficulty handling all the demands
humans (and other beings) put on him.
I mean, people cling to god because,
let’s face it, he’s god. I went to Catholic
school for 12 years, so basically I have
nothing to worry about – I’M IN.
The problem is our God is actually
three – the Father, the Son, and the Holy
Ghost. For our purposes, let’s assume
the managing partner for the god trilogy
is Jesus. The father, like Don Corleone
in his later years, is retired. He walks
around heaven spraying tomato plants.
As St. Peter says, “The God is semi-
retired and Jesus is in charge of the Fam-
ily business now. If you have anything
to say, say it to Jesus.”
The Holy Ghost? The guy is a fruit
cake. Even Jesus says so: “Ho-Go? Well,
he’s got a good heart but he’s weak, and
he’s stupid. And this is life and death.”
I envision Jesus hanging out in
heaven. He’s probably with the apostles
(NOT Judas, though: “Judas? You won’t
be seein’ him no more. Take the can-
noli”). I mean, he wouldn’t be hanging
with a dude like Jimi Hendrix, who is
like 1000 years younger.
“Hey Jesus, Let’s play some music, man.”
“Cool. I’ll get my harp and slip into
a toga. Want some wine?”
“Umm, Ok. Do you know “Foxy Lady?”
Jesus’s eyes lit up.
“Do I know Mary Magadalene? Do I
know Mary Magadalene? Madon!”
Let’s say Jesus and his friends hang
out in a barbershop in heaven, or a pool
hall. People, I imagine, are like gnats
to them. They hear us buzzing around,
but it’s very difficult to ascertain who
exactly is making the noise.
“Jesus Christ in heaven!” Someone
on earth will exclaim. That person will
assume Jesus knows exactly who he or
she is. Not so.
“Did you hear something?” Jesus will

in the sky, and can’t tell one gnat from
another. Plus she’s got her own problems.
First of all, she is the only female in exis-
tence over the age of 21 who is still a virgin
– except, of course, women in Utah. You
don’t think Mary Magdalene and the other
girls want to hang out with that frumpy
old thing, do you? “You should have gotten
some action from that carpenter when
you had the chance!” they hiss at her.
The point of all this – and there is
always a point in this column – is don’t
automatically assume the good lord is

Marking Mecox
A pilot program that involves sinking color-coded, numbered markers into
the sand to enhance safety at town beaches has begun in Southampton Town
at Mecox Beach in Bridgehampton. If the pilot is a success, markers will be
placed along the shoreline every tenth of a mile, and linked to the town’s
GPS system to help responders in the event of an emergency. Sometimes,
Councilwoman Nancy Graboski, whose spearheading the measure noted,
tourists can’t describe exactly where they are when they call 911. The marker
system could assuage that problem.
