NOTICE INVITING TENDER

On behalf of Bharat Sanchar Nigam Ltd., sealed tenders are
invited by the General Manager, Telecom District, BSNL, Visakhapatnam
for "Repair of Faulty Electronic Push Button Telephone
instruments(approx.6200 instruments)" of different makes One way CLIP,
Two Way CLIP and normal type of EPBTs from the interested and
experienced firms and electronic repairing companies, for one year
from the date of entering into an agreement with the BSNL
after the acceptance of the tender.
The tender form containing the terms and conditions can be

obtained from the SDE-MM, O/o GMTD, 2nd FLOOR, DABAGARDENS,
VISAKHAPATNAM-530020 on payment of Rs.573/-(Rupees Five Hundred and
Seventy Three only) a non refundable amount in cash counter of this
office or thro' demand draft drawn in favour of Accounts
Officer(Cash), BSNL, % G.M.Telecom District, Visakhapatnam for the same
amount on any nationalized bank.
Cost of the tender schedule : Rs.573/-(Rupees Five Hundred and Seventy

Three only).
Earnest Money Deposit : Rs.6,200/-(Rupees Six thousand and

two hundred only).
Security Deposit : Rs.31,000/-(Rupees Thirty one thou-
sand only).

TENDER SCHEDULE
On behalf of Bharat Sanchar Nigam Ltd.,sealed

tenders are invited by the G.M.Telecom District,BSNL, Visakhapatnam
from the interested and experienced firms and electronic repairing
companies, for "Repair of Faulty Electronic Push Button Telephone
Instruments" of different makes both normal and plan type.
The following are the tender schedule
clauses which required to be followed and all pages are to be signed
by each tenderer before submitting the tender documents to the
undersigned. The approximate quantity of PBT instruments to be
repaired is about 6200 nos. The number of instruments may vary by +/-
25%.
Nature of Work:
In Visakhapatnam Telecom District, the faulty push

button telephones of different makes both normal& plan type, and Clip
instrument present in various stations are to be collected, repaired and
returned. The work of repair of the faulty PBTs includes the charges for
repalcement of spares (including Rosette, LJU's and hand set, rosette
card and PSUs for plan type), cost of spares, transportation and
handling charges and repaired telephones should be guaranteed for 6
months.
01. Rates : Rates should be quoted for each item in the

annexure "Schedule of Rates".Tender offers are
liable for rejection if the supplier do not
quote for all the items in the annexure.
01.(a) : Rates quoted for each item should be inclusive

of all expenses and including all taxes. The
contract will be rate running contract for one
year.
02.Delivery : The approved contractor should approach and

collect the faulty instruments every week on a
specific day from the unit concerned and
return within 7(seven) days of receipt of the
instruments.
03.Penalty : If the instruments are not repaired and re-

turned within 7days from the date of receipt of
the faulty instrument a penalty of Rs.5/- per
day per each instrument will be imposed subject to
maximum of Rs.50/-
04. Quality of the

spares : The quality of the spares replaced are subject

to approval of the General Manager,

Telecom District, BSNL, VM or any other
officer nominated by him. If quality is not
good, penalty of 5% will be imposed at the
discretion of the unit officer who placed the
order or his superior subject to a maximum

of 20% of cost of spares.
05. E.M.D. : Each tender must be accompanied by the EMD for

Rs.6,200/- (Rupees Six thousand& two hundred
only). The amount shall be paid thro'
DD drawn in favour of A.O.(cash),BSNL,%G.M.T.D.
Visakhapatnam from any nationalised Bank.
TENDERS WITHOUT EMD WILL BE REJECTED
05.(a) Refund of EMD : EMDs of unsuccessful tenderers will be

returned after finalization of the
tender. The EMD of the successful
tenderer will be refunded on furnishing
the prescribed security deposit.
05.(b) Forfeiture of the EMD: EMD is liable to be forfeited in case

the tenderer withdraws his tender after
opening of the tender or if successful
tenderer fails to furnish the security
deposit within specified time and enter
into agreement.
05(c) Interest on EMD : EMD will not carry any interest and no
interest will be paid on EMD.
06. Security Deposit : The successful tenderer has to pay

an amount equivalent to 10% of total con
-tract value as security deposit in the
shape of Bank Guarantee from any na
tionalied bank to cover upto six months
beyond the end of the contract period and
submit the same to the G.M.Telecom
District,Viskhapatnam
within 7 (seven) days of receipt of the
communication. The successful tenderer
can also pay the amount in cash at
cash counter 0f this office or thro'
D.D. drawn in favour of A.O.(cash),BSNL,
% G.M.Telecom District,Visakhapatnam
for the same amount if so they desire.
07.(a) Amount of security : 10% of total contract value or

deposit Rs.31,000/- (Rupees Thirty one thousand
only). Which ever is higher.
(b) Interest on SD : No interest will be paid on security

deposit.
08. Arbitration : In the event of any dispute arising out

of the contract, the same will be
referred to the arbitration of G.M.
Telecom District, BSNL, Visakhapatnam

or some other officer nominated by him.
\ The award of the arbitrator shall be

final and binding on the parties to the
contract.
09.Engage more than one : The BSNL reserves the right to

contractor engage more than one contractor.
10.Acceptance & Rejection : The GMTD, BSNL will be at liberty to

bound to accept lowest tendrer.

placed in this office. If sent by post
the BSNL is not responsible for any
possible loss or delay in transit.
All relevant enclosures are to be
submitted along with tender.
The date for receipt of tenders is 1500 Hrs.of 22-3-2011. The tenders
will be opened at 1600 Hrs. of the same day in the presence of ten
derers or their representatives who may like to attend.
If the date for receipt and opening of tender happens to be a

holiday, the same will be extended to the next working day to the
respective timings.
Each tender should accompany the following:

i. Demand Draft in original towards Earnest money Deposit.
ii. Proof of Registration(for Firms &Companies).
iii. Sales Tax clearance certificates.
iv. Experience Certificate in the field of repairing EPBTs(certificate
issued by an officer not below the rank of DE,BSNL).
v. Latest solvency certificate from the revenue authorities/Nationa-
lised Bank for Rs.60,000/-
vi.Clause by clause compliance for terms&conditions,and deviations
from it,if any.

12. Evaluation: The L1 tenderer will be decided on each individual item

basis. The L1 will be decided on the net cost to the BSNL i.e exclusive
of cenvatable taxes if any.

TERMS & CONDITIONS
The tenderer is advised to go through the

following terms and conditions carefully before filling up the tender
application.
01. Rates should be quoted, item wise, including all taxes and other
expenses, in the annexed " Schedule of Rates." The rates quoted in
own pro-forma, typed or xerox copies will not be accepted.
02. Rates should be quoted in figures and words. Wherever there

is a difference between the rates quoted in the figures and words,
the rates in the words will be taken as correct.
03. Any provisional clause, included in the tender as for example,

subject to percentage of duties and taxes, market fluctuations, which
may affect the price of the above item, shall result in rejection
of the tender.
04. The tenders with unworkable rates or tenders with same rates
quoted by a group of tederers are liable for rejection.
05. Any attempt to negotiate directly or indirectly on the part of

the tenderer with the authority competent to finally accept it or
endeavour to influence by any reasons for acceptance of the tender
will result in rejection of the tender.
06. The person signing the tender or other documents shall indicate
his full name below his signature and must specify whether he has
signed as sole proprieter, partner in case of partnership firm, karta
in case of HUF and Director in case of a company incorporated under
companies act duly authorised by the board of directors for the tender.
07. If the last date for receipt and opening of tender happens to be a
holiday, the same will be extended to the next working day to the
respective timings.
08. As per BSNL guidelines it has been decided that the near relative
of all BSNL Employees either directly recruited or on deputation are
prohibited from participation in tenders and execution of works in the
different units of BSNL. The details are as follows.
The near relative for this purpose are defined as:
a). Members of a Hindu Undivided family.
b). They are husband and wife.
c). The one is related to the other in the manner as

father,mother,son(s) & son's wife(daughter-in-law). Daughter(s) &
daughter's husband(son-in-law),brother(s) & brother's wife,sister(s) &
sister's husband(brother-in-law).
A certificate is required to this effect.
The format of the certificate to be given is "I_____________________

S/o_____________________r/o________________hereby certify that none of
my relative(s) as defined in the tender document is/are employed in

BSNL unit as per details given tender document. In case at any stage,
it is found that the information given by me is false/incorrect, BSNL
shall have the absolute right to take any action as deemed fit/without
any prior intimation to me".
09.Experience:- At least 2 years experience in the field of repairs of

instruments is required.
10. The successful tenderer has to pay an amount equivalent to 10% of

total contract value as security deposit in the shape of Bank
Guarantee from any nationalied bank to cover upto the end of the
contract period or to pay a sum of Rs.31,000/-(Rupees Thirty one
thousand only) whichever is higher,towards Security Deposit in
the cash counter of this office or through Demand Draft drawn in
favour of A.O.(cash), BSNL, % G.M.Telecom District, Visakhapatnam.
In case the tenderer fails to remit the Security deposit within
seven days of receipt of communication from this office,the EMD paid
by such tenderer shall be forfeited, and the tender submitted by such
tenderer shall be rejected.
11. If the approved tenderer fails to pay the security deposit within
the seven days of receipt of communication, the EMD paid by such
tenderer shall be forfeited in favour of BSNL, and next tenderer
shall be offered with the tender work.
12. No cash advance shall be allowed to the approved tenderer for the
reapir jobs.
13.Electronic components to be replaced should be procured from the

approved list of components manufactures for BSNL.
14. No sub-contracting is permissible by BSNL.
15. All the faulty telephone instruments are to be collected from the
Telecom Store Godown. at Visakhapatnam or from the unit officers in
Visakhapatnam SSA that would be specified in the work orders, and all
the telephone instruments after due repairs are to be returned at their
original places.The transport charges, labour charges, and repairing
charges including the cost of the spares if any are to be borne by the
tenderer by himself. The approved tenderer should approach and collect
the faulty instruments every week on a specific day from the unit
concerned and return within 7(seven) days of receipt of the
instruments and under no circumstances, no instrument is to be labeled
"IRREPAIRABLE". If the instruments are not repaired and returned
within this time frame a penalty of Rs.5/- per day per each instrument
will be imposed subject to a maximum of Rs.50/-. All the instruments are
to be verified by the approved tenderer before taking them for repairs.
They can refuse taking such instruments for whose case is broken/with
cracks and whose components are missing. The details of faults
attended should be indicated in writing while handing over back the
repaired instruments. A copy of the same is to be marked to SDE(MM).
16. It is essential that the firm should have a collection and service
centre at Visakhapatnam if their Headquarters is located at a place
other than Visakhapatnam.
17. If the quality of spares replaced is not good, the spares will be
rejected and penalty will be imposed at the discretion of the officer
who placed the order or his superior @5% subject to a maximum of 20% of
cost of spares.

18. The instruments/material, if any rejected by BSNL, for the reasons

already explained above, the rejected material should be taken
back by the tenderer at his own cost.
19. The tenderer should submit a list along with the bill for payment.
The list should have the sl.no.of instrument, make, nature of fault,
components replaced/details of faults attended S.D.E.wise.
20. In the event of any dispute arising out of the contract, the same
will be referred to the arbitration of The Chief General Manager
Telecom, Hyderabad or some other officer appointed by him. The award
of the arbitrator shall be final and binding on the parties to the
contract.
21. Force Majeure:- If any time, during the continuance of this con-
tract, the performance in whole or in part by either party of any
obligation under this contract is pervented by reason of any war,or
hostility,acts of the public enemy, civil
demmotion,sabotage,fires,floods,explosions,epidemics,quarantine re-
strictions,strikes,lockouts or act of God(Herein after referred to as
events)provided notice of happenings,of any such eventuality is given
by either party to the other within 21 days from the date of occur
rence thereof, neither party shall by reason of such events be entitled
to terminate this contract nor shall either party have claim for
damages against the other in respect of such on performance or delay
in performance under the contract shall be resumed as soon as prac-
ticable after such an event may come to an end or cease to exist,and
the decision of BSNL as to whether the supplies have been so resumed
or not shall be final and conclusive, provided further that if the
performance in whole or part of any obligation under this contract is
prevented or delayed by reason of any such events for a period exceed
ing 60 days either party may at his option terminate the contract.
22.Set Off:- Any sum of money due and payable to the contractor(include-
ing security deposit refunded to him) under this contract may be
appropriated by BSNL and set off the same against any claim of BSNL
for payment of a sum of money arising out of this contract or under
any other contract made by contractor with BSNL.
23. Sales Tax/Turn over Tax or any other taxes applicable from time
to time during the period of contract will be deducted at the time of
settlement of bills/SD at source.

And whereas the contractor has paid/ submitted demand draft/ bank

District,BSNL, Visakhapatnam as Security Deposit, as per the terms &
conditions of the tender

Now this indenture witnessth that in consideration of the promise, it

is mutually agreed and declared between parties hereto as follows.
01. The contractor agrees to undertake to repair EPBTs

as per the requirement as per the approval/acceptance by the
General Manager, Telecom District,BSNL, Visakhapatnam vide his
letter dated. at the rates quoted by him/them.
The rates are inclusive of all the taxes and charges like replace
ment of spares(including LJUs,Rosettes,PSUs) handling charges and
charges for transportation to the places as specified by the BSNL.
02. The contractor agrees to undertake to REPAIR OF FAULTY EPBTs as

per requirement as agreed in their tender and letter dtd. at the
rates quoted in annexure "schedule of rates"
03. This contract shall be effective from „ - -2011 to - -2012
04.The contractor shall repair the faulty EPBTs as per requirement and
wihin the time specified as per the work orders issued by the
G.M.Telecom District,BSNL, Visakhapatnam or any other officer autho-
rised for this purpose with great promptness and satisfaction to BSNL.
Otherwise it may result in termination or imposition of suitable
penalty as per the discretion of the G.M.Telecom District,BSNL,
Visakhapatnam.
05. If the instruments are not repaired and returned within the time
frame a penalty of Rs.5/- per day per each instrument will be imposed
subject to a maximum of Rs.50/- per instrument.

06. If the quality of spares replaced is not good, the spares will be
rejected and penalty will be imposed at the descretion of the offi-
cer, who placed the order or his superior @5% subject to a maximum of 20%
of cost of spares.
07. The security deposit paid by the contractor shall be for due and
faithfull performance of the contract by the contractor of all and
several convenents, herein contained of his part to be observed with
full power to the G.M. Telecom District,BSNL, Visakhapatnam on behalf
of BSNL to appropriate the said sum or any damage, penalities and
other sums which the contractor may be required to pay in
case the contractor fails to perform, fulfill or to keep
and observe all or any of the said conditions of the agreement
on his part herein after contained.
08. The security deposit shall be released after six months after
successful completion of the work after completion of contract period
including guarantee period from the last batch of instruments repaired.
09. The Security Deposit is to be forfeited to the Bharat Sanchar

Nigam Limited., or his successors without any prejudice to any other
rights and remidies of BSNL, in case the contractor fails to undertake
the contract work, as per the work orders and as per the terms and
conditions of given in tender schedule during the currency of the
contract.
10. That all disputes arising out of this contract will be referred
to the arbitration of the C.G.M. Telecom,A.P.Circle or some other
officer appointed by him. The award of arbitrator shall be final
and binding on the parties to this contract and provisions of the
Indian Arbitration Act 1940 and any statutory
modification/enactments thereto and the rules made there under
from time to time shall apply to such arbitration.
11. That the tender schedule and terms and conditions shall also form
part of the agreement.
12. That the contractor acknowledge that he is himself fully

acquainted with all the conditions of the contract and he shall not
plead ignorance of any of them.
In withness whereof, the contractor has set his

hand and BSNL has caused the G.M. Telecom District,BSNL, Visakhapatnam
for and on his behalf to set his hand, the day and the year first
