FURTHERMORE, Applicant and registrant have entered into a consent agreement whereby Registrant
agrees that the marks are not likely to be confused and registrant consent to registration of the
Applicant's mark. See attached Consent Agreement at Paragraph 9.

A signed Power of Attorney is also attached.

Wherefore, Applicant requests the Examining Attorney withdraw the refusal and approve the mark for
publication.
