Meanwhile, the prime
minister announced that his
government will be appoint-
ing independent Commis-
sions of Inquiry (COI) that
will look into outstand-
ing issues that include that
of NISCOL, threats to press
freedom, and the copra sub-
sidy.

ther amended urgent Consti-
tutional application lodged
by the Opposition bloc,
applying in essence that
the decisions of the First
Respondent (Speaker of
Parliament) and Second
respondent (Republic of

removing the First applicant
(MP Sato Kilman) as Prime
Minister of Vanuatu dated
April 24, 2011 as ‘unconstitu-
tional and of no legal effect.’
The Appellant’s legal
counsel Thursday afternoon
agreed that the first Consti-
tutional application was not
valid after the lodging of
the amended constitutional
application filed on Wednes-
day April 27, and asked that
the court intervene and inter-
pret the question of absolute
majority.
Chief Justice Vincent Lun-
abek reflected that there two
different scenarios here- fun-
damental rights and breach
of constitutional rights.
In consideration of the
Prime Minister’s fundamen-
tal rights and provisions
in the constitution Oppo-
sition leader MP Kilman is
maintaining infringement of
seven sections in the Con-
stitution, these are section
39(1), 49 (1), 43(2 and 3)
and 5(1) d which in response
the respondent’s legal coun-
sel said that in light of the
urgency of the case time
is needed to get detailed
extractions from the Speak-
er of Parliament.
In deliberating the proc-
ess and relevance of the 12
Opposition MPs who are
the second applicants, the
infringement of constitution-
al rights and that they were
appointed by the Prime Min-
ister, they were removed
as second applicants in the
case.

Motalava implements its Disaster Action plan
The communities of
Motalava in Torba province
have realised the importance
of natural disaster preven-
tion, preparedness and miti-
gation.
The community disaster
action work was taken place
during the second week of
April in the village of Neren-
ingman and in Rah Island.
The activities carried out
were: the replant of trees on
the coastal line, the digging
of drainage in flood prone
areas and the creation of rub-
bish disposal.
Chief Laurent Jean, chair-
man of Motalava council of
chiefs, said that Vanuatu Red
Cross engagement with his
people in Motalava is crucial
as it helps educate the com-
munity to not only focus on
development but also to con-
sider disaster risk that the
community is exposed to as
part of their own develop-
ment. The community disas-
ter action plan are integrated
into the chief’s 10 years work
plan and thus much focus is
now put in place to ensure
full completion of the action
plan implementation.
The three targeted com-
munities in Motalava have
inserted the action plan into
the chief yearly plan. The
days allocated to the chiefs
are Monday and Friday.
However, the chiefs have
agreed that the action plan
be implemented as soon as
possible to increase the com-
munity resilience. The com-

VP trial adjourned to May 16

…10 witnesses likely to be cross examine in VP case

Chief Justice Vincent
Lunabek has adjourned the
Vanua’aku Pati (VP) trial to
May 16-23.
Day three of the VP trial
Thursday morning heard the
defence counsel in the VP case
indicating that there is a likeli-
hood that it will be cross exam-
ining only 10 of the 12 existing
witnesses presented by the
Claimant’s counsel.
Defence lawyer Silas Hakwa
told the Supreme Court that ‘it
is likely’ that there are two who
will not be cross examined,
they are: Finance Minister and
Efate MP Bakoa Kaltongga and
MP for Maewo constituency
Philip Boedero.
From the claimant’s counsel,
Edward Nalyal will be filing in
three sworn statements by May
5, 2011, specifically:
•Reply to sworn statement
of Isabelle Kalo which was filed
on April 27, 2011.
•Statement of Jessy Dick in
relation to the drafting of the
VP Congress resolutions on
Ifira and;
•Statement of Christina W
ilson in relation to the events
surrounding the drafting of the
Ifira Congress resolutions and
new sub committees at the Ifira
congress.
The Supreme Court heard
that the defendants will file
and serve the sworn statements
of Jessy Dick and Christina
Wilson by May 12,2011.And
the claimant will file and serve
a sworn statement in reply (if
any) by May 13.
The defence legal coun-
sel had no objection to the
adjournment and indicated that
it will be filing a reply to sworn
statements (II) and (III).
Chief Justice Lunabek has
indicated that the Court sees
that the case must be sorted
out as soon as possible thus
the trial adjournment to May
16-23 while other matters on
that date are put aside; hence
the legal counsels are expected
to be “on top of things”.

Sunday is Labour Day there-
fore the Office of the Pres-
ident of the Republic has
declared that according to
Public Holiday Act Cap 114
Section 3, Monday the 2nd
will be observed as public
holiday.
This year’s Labour Day will
be celebrated with the official
launching of the first ever Tri-
partite Labour Advisory Coun-
cil since Independence.
Labour Commissioner,
Lionel Kalwat is inviting all
public servants who are work-
ers themselves with their pri-
vate sector colleagues to join
the celebration and witness
the official launching of the
Tripartite Labour Advisory
Council.
To commemorate the day
there will be a march at
8am led by the VMF Band
from Trader Vic’s to Saralana
Stage. Invitations have been
sent out to all private com-
panies to participate with
their company banners and
uniforms.   All government
departments are also asked
to join in the march with
their respective department
banner if possible.
Since it is a Sunday, the
VCC will be conducting a
mass service for all workers,
employers and government
at Saralana Stage at about
9.30am at the end of the
march there will be refresh-
ments and finger tips after
the service and inspection of
information booths erected
by workers, employers and
government for information
awareness about tripartism
and decent work.

The official opening of the
Pacific Partnership 2011 pro-
gram will take place today
at the Subenatavuitano
Nakamal at the Sanma pro-
vincial ground.
The ceremony is sched-
uled to start at 10am with
the inclusion of music and
speeches by Vanuatu officials
and the Pacific Partner 2011
commander.
The ceremony will be
extended to a reception
onboard the HMNZS Canter-
bury, a New Zealand Defence
Force frigate which arrived
in Luganville Wednesday this
week with supplies and mili-
tary equipment including hel-
icopters to be used during the
six-week program.
The military vessels have
arrived in Luganville for
the program which include
HMNZS Canterbury which
was first to arrive, USS Cleve-
land, HMAS Balikpapan and
HMAS Betano.
On board the USS Cleve-
land there is a total of 400
crew members, 2 Mh-60S hel-
icopters, 1 land craft, utility,
57-ton trucks and four long
wheel base jeeps and onboard
the HMZS Canterbury there is
a total of 100 crew, 1 SA0330
Puma helicopter(French
detachment), 2 landing craft
and 12 medium trucks.
For HMAS Balikpapan and
HMAS Betano there are a
total of 13 crews with deploy-
able geospatial survey team.
The United States of
America provide the largest
number of medical personal
with 130 person in the medi-
cal team, New Zealand has a
total of 28 and Australia has
a total of 19 person medical
contingent.
The partnership program
have already started for the
past two weeks with com-
bination of Vanuatu Mobile
Forces from Port Vila and
Luganville teaming up with
American and New Zea-
land personals to carry rep-
aration and instalment of
school facilities mainly class-
rooms and toilets at Banban,
Kamewa and schools in the
rural areas.
At the conference organ-
ised with heads of the Public
Service Department in Lugan-
ville Thursday and Capt Jesse
Wilson, USN (Commander
Destroyer Squadron 23) and
his counterparts from New
Zealand and Australiana stat-
ed they are excited and look-
ing forward to working side
by side with their Vanuatu
counterparts to improve rela-
tionships as well to services in
the communities and develop
capabilities in coalition opera-
tions and disaster response.
They also spoke highly of
Santo’s history as it was big-
gest US military based in
World War 11 and added
Santo has a beautiful scenac-
ery and friendly people.
With all partner countries
now have arrived in Santo,
it expected Luganville is very
busy and many people.
Pacific Partnership is an
annual deployment of forces
from the Pacific Fleet of the
United States Navy (USN),
in cooperation with region-
al governments and military
forces, along with humani-
tarian and non government
organisation.
The deployment was con-
ceived following the 2004
Indian Oceania earthquake
and tsunmai, as a way to
improve the interoperability
of the region’s military forces,
governments, and humanitar-
ian organisations during dis-
aster relief operations, while
providing humanitarian, med-
ical, dental, and engineering
assistance to nations of the
Pacific, and strengthening
relationships and security ties
between the nations.

ther extent, whether the Pub-
lic Prosecutor has prosecuted
anyone as a result of the said
findings. The report is due
in 7 weeks.
3. Blacksands and Paray Bay Fish

no news from the Dept. of
Environment following a fur-
ther request for an update.
4. Disciplinary Action for Govern-
ment Director for causing damage to
G-Vehicle: Transparency sent
a letter 2 weeks ago to the
PSC for an update -. We have
been advised by the PSC this
week by telephone that they
are still waiting for a report
from the DG of Finance. PSC
stated that it is at the dis-
cretion of the DG whether
or not a report is filed. They
also reported that it was only
a minor accident and the pic-
ture taken and published in
the media was a fake and this
might be a reason why the
DG is adamant to take any
action. However, it was con-
firmed by the Daily Post that
the picture published was
sent to them by a staff from
the Finance Dept.
5. The hearing of the corruption
case against David Moses, the former
land Officer was held on the 14th of
April 2011. The matter has
been adjourned to 19 May
2011 at 9:00 am.
6. Ombudsman Reports:
We have had no response from the
Ombudsman’s office following a let-
ter sent from Transparency request-
ing an update and why there has
been no annual reports issued since
2002 from this Office.
7. ALAC: the complaint office
of Transparency Vanuatu has
a budget of only VT3.5 mil-
lion per year with limited
staffing. We can advise, the ALAC
office is still currently receiving new
complaints daily.

Chief Registrar (8 weeks
ago) to enquire of the judg-

selected as one of the 3 Bands
to win the International Anti-
Corruption Music Competition
from 113 artists from 30 plus
countries.
This is a major achievement
not only for the Band but for
the people of Vanuatu.
Transparency Vanuatu has
been a long time supporter and
advocator of Good Governance
in the country and will contin-
ue to work together with youth
groups such as ‘Young Life’ to
continue to advocate these
issues of good governance and
anti-corruption throughout the
country and beyond.
Transparency Vanuatu’s
‘Youth for Change’ represent-
ative Tito Elise also accompa-
nied the group to Kenya. Mr.
Tito was accepted under the
Global Youth Anti-Corruption
Network to attend the 2nd
Annual Forum.
In support of the Young Life
Band, TV arranged the printing
of T-shirts for the seven band
members and presented these
to the Group at their recent
fundraiser.

On Sunday 24 April, 2011 I lis-
tened to the selected MPs becoming
Ministers and taking their oath of
allegiance. I do not know whether
they really know the true meaning
of the words in the oath or not,
because if they do the government
would be stable during the term of
1 parliament.
No they do not know the meaning
of the oath. That is why Vanuatu has
so many changes of government.
MPs also take oath of allegiance
after winning an election. They
swear to treat everyone “without
fear or favor” but what a bunch of
lies. They do exactly the opposite for
personal glory void of any public
interest consideration.

Constant changes of government
say this because if you look at the
campaign platform of all the politi-
cal groupings you would see that
they promise development. Succes-
sive governments have not demon-
strated any major difference apart
from the person being the Prime
Minister and Minister so why the
change? What are the major differ-
ences in political ideology? Non, non
at all.

panies and other petty politics such
as sharing of salaries between non-

Royal celebration
The wedding of Prince William and Kate Middleton today April 29 is likely to give Britain a much-needed boost, and herald
the start of royal succession law reform. After years of economic woes, the highly-anticipated royal wedding has given
the country a timely distraction: the king-in-waiting Prince William will finally make Kate Middleton his queen.
“The timing is right now,” Prince
William said as he formally introduced
his fiancee to the world.
The British Prime Minister, David
Cameron, says the royal nuptials will be
a “great day of national celebration”.
“It’s great to have a piece of unadul-
terated good news that everyone can cel-
ebrate,” Mr Cameron said when asked
about the need for Britain to come
together in the wake of austerity meas-
ures.
Previous royal occasions, such as
that of Prince William’s parents Prince
Charles and Lady Diana Spencer in
1981, and Queen Elizabeth’s corona-
tion in 1953 or the jubilees of 1977
and 2002, have seen huge celebrations
across the country.
Such events also generate greater
interest in the royals, with the tourism
industry expected to be a winner.
Sandie Dawe, chief executive of tour-
ism agency VisitBritain, says the wedding
will be “an enormous boost” for Britain’s
industry.
She says monarch-related attractions
usually generate more than $US800 mil-
lion a year for the tourism industry.
“We would expect that in a royal wed-
ding year we would do even better than
that.
“Millions of people around the world
are certain to see the wedding as the per-
fect moment to come to Britain to see
the young royals.”
David Cottle, a columunist with Dow
Jones Newswires, says that with Brit-
ain “in trouble...it’s time to play the last
ace.”
“A royal wedding will be big money
spinner for the UK economy,” he wrote.
“Think of the memorabilia, the mag-
azines, the tourist tat adorned with pic-
tures of the happy couple; billions of
pounds worth coming up.”
Royal succession
The marriage of Prince William and
Kate Middleton has reignited Britain’s
desire to reform ancient succession
laws.
Under the 300-year-old law presently
in place, Prince William and his fiancee’s
first-born son would eventually become
king, even if he had an older sister.
Under the 1701 Act of Settlement,
male royal heirs have prior claim to the
throne, which also bans the monarch
from marrying a Catholic.
Buckingham Palace has declined to
comment on the issue, saying it is a mat-
ter for the government.
Britain’s Queen Elizabeth II came to
the throne because she had no brothers.
The prime minister says he backs
changes to a law on royal succession and
the Catholic marriage-ban.
“In principle, I think both changes
should be made,” Mr Cameron told BBC
radio.
“But it will take time because it’s not
our decision, it’s a decision for others as
well.
“We ought to have proper discussions
with other countries.
“We have to recognise that the Queen
is not only the queen of the United King-
dom but also of many other jurisdic-
tions.”
It remains to be seen what the future
holds for Prince William and Kate Mid-
dleton, and indeed, a country struggling
to come back from financial crisis.
Apart from the predicted bad weath-
er, there will be little gloom on Friday as
Britain - and the world - raises a symbol-
ic toast to the happy couple.

How many more Motions of No Confidences before the 2012 General Election?

It has become a real con-
cern that since 1991, an
ongoing trend of both past
and present governments
stained by countless motions
of no confidence is something
we all should be concerned
about.
Even though we live in
a democracy, why is it now
becoming a habit for Vanuatu
politics that whenever a gov-
ernment comes into power,
we always have the Opposi-
tion, moving a motion of no
confidence based on political
power struggle for portfolios
rather than for development
needs of the people?
This ongoing trend is
seriously undermining the
nation's progress and it does
not look like it is in the inter-
est of our national aspira-
tions at all and the wishes of
the voters who have put them
there.
It is evident among the
ordinary Ni-Vanuatu that peo-
ple are fed up of motions of
no confidence in parliament
for simply the abuse of tax
payers' money, deteriorating
trust of parliamentarians and
less progress in development
and peace.
Unless parliamentari -
ans address this problem
of political party instabili-
ty by crossing floors, there
will continually be increasing
issues of governance crisis in
the future and this ongoing
trend of removing one gov-
ernment out and replacing it
with another, will simply be
the kind of politics that will
never get this country any
further.
This is a serious matter to
deal with because it will ulti-
mately in the end, affect the
Transparency
kind of economic develop-
ment growth that we aspire
for and this means more tax-
payers’ money will have to be
drained.
We need a government
that is transparent, accounta-
ble, and one that respects the
wishes of people. We need
MPs who work together across
party lines on behalf of all the
Vanuatu people but not those
that pursue their own person-
al agendas and greed.
Vanuatu has a long record
of instability and the motions
of no confidences signi-
fy the abuse of parliamenta-
ry democracy that politicians
have often taken advantage
of over the years.
In fact we have learned
from previous and past politi-
cal crises and from neighbour-
ing countries, that whenever
there is a weak political party
system in place and rampant
issues of corruption, it is like-
ly that more bigger problems
would occur that can lead to
social unrest.
Democracy indeed dic-
tates economic prosperity but
where is this promised pros-
perity if political party mem-
bers keep on acting as if there
is a personal war going on
between two factions who
have been all but caught up in
their own personal disputes?
It is important to learn
from the past and to acknowl-
edge that as a nation, it was
because of our government's
lack of good governance that
had ultimately brought about
the Comprehensive Reform
Program (CRP) that have
now put burden on ordinary
people to repay the loan of
Vt2 billion.
Thus good governance is
what this country needs in
order for stability to occur
and political parties stabili-
ty in parliament, is where we
should begin with.
It is a trend that is weak-
ening our resolve to polit-
ical maturity and it will be
our weakness in the face of
increasing and mounting
pressure, from our own per-
sonal demands and expec-
tations upon the MP's in the
future.
People need to be aware
that the more they elect MPs
who are in the habit of cross-
ing floors they risk effective
government performance in
the long run. MPs crossing
floors and changing political
affiliation unnecessarily and
without legitimate reasons is
just unacceptable.
This ongoing political
changes and maneuvering
means allowing a downward
spiral trend to develop with
increasing risks attached to
it. People need to know that
every time there is a change
in government, over Vt5 mil-
lion of taxpayers’ money is
spent to pay former Ministers
and their staff.
With the current political
situation where numbers from
the Government and Oppo-
sition side are fairly unsta-
ble, anything could happen
with the possibility of anoth-
er motion.
In fact, there are two real
practical solutions if we do
not want this to continue
into the future. It needs the
political will of all political
leaders to make changes in
the Constitution that would
cater for more stability such
as limiting the number of
political parties and provi-
sions regulating MPs cross-
ing the floor and also for
voters to make wise and bet-
ter choices when voting.

fully-clothed body of a miner
in New Zealand’s collapsed
Pike River mine has reinvig-
orated angry calls to “get our
boys out”.
The families of 29 men,
including two Australians, killed
in a series of methane blasts on
November 19 say the revela-
tion, together with news the
mine’s firefighting box had been
opened, was a “painful indica-
tion” the men may have sur-
vived the first explosion.
“Hearing that has made us
think ‘maybe there was hope,
maybe we should have forced
them somehow to get in there
earlier and try to save them’,”
spokesman for the families,
Bernie Monk, said today.
Mr Monk confirmed he had
contacted the families of the
two Queensland victims, Willie
Joynson, 49, and Josh Ufer, 25,

ing the carcass.
The whale was without a tail
and had chunks of flesh miss-
ing when it washed ashore on

Wildlife Service has cordoned
off the entrance to the rocks at

IT has no capital, no
airport and only 1400 people
who call it home, but the tiny
isle of Tokelau has become
the cyber crime centre of
the world.
A new report by an inter-
national group tackling
internet scams has con-
firmed that Tokelau, a New
Zealand territory, has more
malicious registrations
under its .tk domain name
than any other domain
except .com.
These fraudulent web
addresses are used for phish-
ing, where emails are sent
to random web addresses in
an attempt to steal banking
information and other per-
sonal details.
Tokelau sold its domain
name to a Dutch company
BV Dot TK, which provides
the domain free worldwide,
making it an easy target for
scammers.
“By offering free domain
names, .tk has become
the third largest coun-
try code top-level domain
after Germany’s .de and
Great Britain’s .uk,” the Anti-
Phishing Working Group
wrote in its latest global
report, released at a technol-
ogy conference in Malaysia
China
China census shows
population ageing and urban
China’s census shows its
population grew to 1.34 bil-
lion people by 2010, with a
sharp rise in those over 60.
Nearly half of all Chinese
now live in cities and peo-
ple over the age of 60 now
account for 13.3% of the pop-
ulation, up nearly 3% since
2000.
But the figures reveal that
China’s population is growing
more slowly than in the past.
That could affect the econ-
omy, as the number of poten-
tial workers, especially from
rural areas, could shrink.
The proportion of main-
land Chinese people aged 14
or younger was 16.6%, down
by 6.29 percentage points
from the last census, a dec-
ade earlier.
The number aged 60 or
older grew to 13.26%, up
2.93 percentage points.
The census results also
revealed that almost half of
all Chinese - 49.7% of the
population - now live in cit-
ies, up from about 36 percent
10 years ago.
The government’s strict
controls on family size,
including its one-child policy
for most urban families, have
this week.
The report examined all
phishing attacks in the sec-
ond half of 2010 and found a
“significant” number used the
tropical nation’s domain.
“While there were phish-
ing domains registered across
183 top-level domains, 89
per cent were concentrated in
just four: .com, .tk, .net and
.info,” the report stated.
About 80 per cent of
Tokelau-registered names
used for phishing were tar-
geting Chinese institutions.
Tokelau itself is not respon-
sible for the problem. The
sale secured islanders free
high speed broadband inter-
net without the hassle of
policing their domain.
Owner BV Dot TK appeared
to be aware of the problem,
admitting on its website: “we
are used by fraudsters and we
are very aware of this”.
The Anti-Phishing Working
Group said the e-crime land-
scape was a constantly
shifting battlefield, where
phishers were always mov-
ing away from well-defended
sites toward ripe targets.
“That makes free domains
like .tk especially vulnerable
to ongoing abuses,” it said.

spiracy theories that have

the 2012 White House race

modern media culture of
online rumour and reality
shows clashed with the som-
bre pageantry of the presiden-

UK military in royal wedding rehearsal
Britain’s military has taken part in a pre-dawn
rehearsal for Friday’s wedding of Prince William and
Kate Middleton. Up to 1,000 members of the army, navy

route the newlyweds will take. Pilots taking part in the
fly-over over Buckingham Palace have also completed
practice flights. Meanwhile, members of the public have
set up tents on the footpath outside Westminster Abbey,
staking their claim for the best view on Friday. Two billion
others are expected to watch the royal wedding from the
comfort of their couch. Fifty heads of state will be

UN finds human rights violations in
Libya
A United Nations team visiting the Libyan capital,
Tripoli, to investigate human rights violations during the
current conflict says it has already found evidence that
they have occured. However, the UN says it has not
drawn up conclusions on who is responsible.
Residents say forces loyal to the Libyan leader,
Moamar Gaddafi, are surrounding towns in the west of
the country, cutting them off from food, water and fuel
supplies. Libyan officials have denied they are targeting
civilians, saying they are fighting armed gangs and al
Qaeda sympathisers. They say they will co-operate
with the UN investigation. The head of the UN team,
Cherif Bassiouni, says there are many questions that
need answers. “The commission of inquiry is here to
find out from the Libyan Government side what its
position is with respect to several types of violations,”

Australian PM’s North Asia tour ends
The Australian Prime Minister, Julia Gillard, has flown
out of Beijing at the end of her North Asia tour. Ms Gillard
visited Japan, South Korea and China during her seven-
day visit to the region. She told Australia Network’s
Newsline she has raised the issues of future trade,
investment and defence in all three countries. “I think
when we’ve talked about the future, the perspective being
brought to it by those I’ve spoken to in Japan, South
Korea and China have all been a perspective of looking to
future growth,” she said. Ms Gillard has met with the
Chinese President, Hu Jintao, in Beijing and discussed
greater defence co-operation between the two countries.
Ms Gillard has also overseen the signing of a number of
economic agreements with China, including a new deal to
increase tourism. She says the visit has injected new life
into free trade negotiations. “This is a relationship with a
lot of mutual benefits in it,” she said. “We’ve just referred
to the nature of the economic relationship between our
two countries and there’s great prospects for growth in
that relationship.” The leaders have also discussed
human rights. Ms Gillard is heading to London to
attend Friday’s royal wedding.

UN Security Council fails to agree to
Syrian statement
The UN Security Council has failed to agree to a
statement condemning the killing of Syrian protesters.
More than 450 people have died across the country
since protests began last month. Russia and China has
resisted signing the joint statement, saying it is an
internal matter to be dealt with by authorities in Syria.
Ambassadors from the Britain, US, France, Germany
and Portugal say a strongly-worded statement is
needed. The US Ambassador, Susan Rice, says more
needs to be done to stop Syrian authorities from
ignoring the demands of its people. "My government
calls on President Assad to change course now and
heed the calls of his own people," she said. "We also
call upon the international community to respond to this
brutal crackdown and to hold accountable those who
are perpetrating these gross human rights violations."
Demonstrations against President Bashar al-Assad's
government first erupted in the capital, Damascus, on
