via telephone conference. The Court heard the arguments of the parties in relation to the Order (Docket No. 114) granting the Governments request for an anonymous jury. Mr. Lowell expressed his concerns regarding: The merits of an anonymous jury; the defense favors that more information be obtained from prospective jurors through written questionnaires than through voir dire in open court. Questions about religion, name of employer, experience with court officers, security business, what spouse, children and parents do, political activity and contributions, preference as to newspapers, TV, and radio, experience with crime and/or how government has affected them should be included in the written questionnaire or during voir dire.

Mr. Chesnoff : He requested that more questions about security firms be included to have a more complete background. Stated that Mr. Bravos situation is not the same as Mr. Martinez. The need to have information about Jorge de Castro-Font as to his being a witness or a cooperator and the report of his mental condition. AUSA Koski indicated as follows: More questions should be included which will allow immediate strike for cause of the jurors, such as English language proficiency. Government does not object that questions about cooperators or informants be included. Government will provide a list of possible witnesses before the deadline, but may be more inclusive than the final list of witnesses. The Court will: Include more questions about Mr. Bravos line of work, but will not ask about the prospective jurors political party affiliations. No individual voir dire, unless juror wishes to approach the bench. No voir dire by counsel. Parties to get together and jointly propose additional questions for the jury questionnaire by tomorrow (12/22/2010).
