Five basic principles values as a source of politic ethics

As a fundamental of state philosophy, Pancasila is not only as a derivation source of legislation regulation, but also as a morality source especially on a relation with authority legitimation, law and many wisdom on the realization and its implementation to the state. The first sila Ketuhanan yang maha esaand the second sila Kemanusiaan yang adil dan beradab as a sources of morality values for nationalism and matters pertaining to the state to its implementation in our life. Indonesia which is based on first sila Ketuhanan yang maha esa is not a Theocracy state which is base on state authority and state Implementation to Religious legitimation. Head of state authority is not absolute based on religious legitimation, but based on law legitimation and democracy legitimation. So the first sila Ketuhanan yang maha esa is more interrelated with moral legitimation. This thing is made the differentiation of state who have Ketuhanan yang maha esa principle with theocracy state. Even in Indonesia isnt based on religious legitimation, but in morality, matters pertaining to the state is should appropriate with values which is based on God (Allah) especially law and morality on matters pertaining to the state. Beside the first sila, the second sila Kemanusiaan yang adil dan beradab is also as a on source of morality values to matters pertaining to the state. State is population of human as Allah creatures. Indonesia as a part of people in the world who live together in the certain place, with hopes with life principles for prosperity (third sila). So people is a fundamental principle on the realization and matters pertaining to the state. So humanity principles is absolute in law and matters pertaining to the state. On matters pertaining to the state, citizen should get law guarantee, so, this thing is human rights. Humanity principles is also a morality fundamental in matters pertaining to the state and its implementation on our life. On matters pertaining to the state and its implementation on our life, polithic ethic should 1) Legality principle (law legitimation) means the realization should be the same with the regulation. 2) Legalize and should be done with democracy (democracy legitimation) 3) Should done with morality principles or not to be in contradiction (moral legitimation) Pancasila as a philosophy system have those three basic on pertaining to the state and its implementation to the authority, wise to the public, giving and an authority which is should base on religious (first sila) and humanity moral (second sila). This thing is clarified by Hatta when he made a state , state should based on religious moral and humanity moral to avoid Machtsstaats or a state with uncontrolable authority.

State should based on law legitimation or legality principles on its implementation. Indonesia is a law state, so justice on our life just like the fifth sila, is a goal of matters pertaining to the state. So in the realization and its implementation all wisdom, authority, arbitrariness, and giving is should based on the regulation. Violation of the justice principles in matters pertaining to the state is make an unbalance state. State is from the citizen, and all its wisdom and authority is for citizen itself (fourth sila). So, in matters pertaining to the state and its implementation , wisdom, authorityand arbitrariness is back to the citizen as a proponent. So, in the implementation of practice politic, all components which is related to eksecutive, legislative and judicative, decision concept, control and participation should based on legitimation from citizen, or we called it as democratic legitimation. In the practice realization in matters pertaining to the state of politic ethic basic principels, is implemented with correlative. Wisdom and decision choosen in the realization which related to politic of natin or foreign politic, national or global economic, which related to citizen, and the other based on law legitimaton, democratic legitimation, and morality legitimation. For example for refined fuel oil price, electricity fee, telephone charge, macro and micro economy,etc. This politic ethic should have the realization in each individual which involved in the implementation on state regulation. All state functionary, eksecutive, legislative and judicative, Indonesia legislative assembly, peoples consultative council, apparatus should realized beside law legitimation and democratic legitimation, theres should be a morality legitimation. For example Indonesia legislative assembly and peoples consultative council is already appropriate with the regulation, but when the citizen is suffer from poverty, its might be not appropriate with the morality legitimation.
