Index (IPI) in November 2009 contracted by
1.3%. The y-o-y contraction was due to the
drop of mining index (-7.4%). However, the
indices of manufacturing and electricity posted
an increase of 0.9% and 5.9% respectively.
Month-on-month (m-o-m) the IPI fell by 6.0%.

ECONOMIC DEVELOPMENTS
The Forum on ASEAN-China Free Trade
Area was successfully concluded in Nanning,
Peoples Republic of China. The Forum was
held to mark the full implementation of the
ASEAN-China FTA on 1 January 2010. Under
the FTA, import duties on over 90% of the
products traded between ASEAN-6 (Brunei,
Indonesia, Malaysia, the Philippines, Singapore
and Thailand) and China were eliminated and
can enter these countries duty free.

attended the Forum which focused on ways

to boost trade, investment and economic
cooperation between ASEAN and China.
The Forum also witnessed the launching of
the China-ASEAN FTA Business Portal (www.
asean-cn.org), Qinzhou Free Trade Area and
the Nanning Bonded Logistics Park. Eighteen
infrastructure cooperation projects involving
China and several ASEAN Member States
valued at US$4.89 billion were signed during
the Forum.
The ASEAN-China Free Trade Agreement
(ACFTA) Business Portal which is in
English and Mandarin provides detail and

comprehensive information on ASEAN-China
economic relations, namely:
Text on ASEAN-China Free Trade Agreement,
including the Framework Agreement,
Annexes and Schedules Commitments;
Latest News on exhibition and fairs as well
as publications;
Tariff Schedules including a search
engine for the ASEAN-China Frere Trade
Agreement rate, Rules of Origin and
Customs procedures;
Schedules of commitments;
Economic Cooperative Initiatives particularly
for small and medium enterprises (SMEs);
and
Country Profle of ACFTA members.
The ACFTA comprises a market of 1.9 billion
people with a combined GDP of about US$6
The ASEAN-India Free Trade Agreement
(AIFTA) which came into effect on 1 January
2010 for Malaysia and India would create a
market of 1.7 billion people with combined
GDP of US$2.8 trillion and combined global
trade of over US$2 trillion. Under the AIFTA,
by end of 2013, 71% of products traded
between Malaysia and India will be duty free
and another 10% of products by 2016. In
addition, duties on another 10% of products
will be reduced to 5%.
The commitments undertaken by Malaysia in
the AIFTA is to eliminate import duties on 6,792
ASEAN and India have agreed to exclude some
products from tariff reduction commitments. As
for Malaysia, 898 tariff lines comprising selected
poultry products, tropical fruits and rice, iron
and steel, automotive products, chemicals,
alcoholic beverages; tobacco and tobacco
products, and used tyres are excluded from
tariff concessions. The products excluded from
trillion and a total trade volume of US$4.3
trillion. Malaysian business community is
encouraged to explore this website for possible
business and investment opportunities.

During the visit, Y.B. Dato Mukhriz Mahathir
met with several Chinese companies, including
BYD Co. Ltd. (automotive-cars), King Long
Co. Ltd. (automotive-buses), Shenyang
Zhangming Chemical Co. Ltd. (chemical-paint
dryer), CSR Locomotive Co. Ltd. (transport-
train system) and Pureta Environmental
Products Corporation (agriculture waste
recycling). These companies have expressed
keen interest to invest in Malaysia. Besides
meeting these companies, Deputy Minister
also witnessed the signing of a MoU between
Crecom and Longmen Paradise for the
development of a hot-spring in Huizhou City
in Guangdong Province.

import duties on 7,767 tariff lines or products
by 31 December 2013 and 1,260 tariff lines
by 31 December 2016. The import duties on
1,810 tariff lines will be reduced to 5% by 31
December 2016.

and ceramic tiles and this involves a total of
1,298 tariff lines. However, these products are
not excluded on a permanent basis and will
be subjected to future review as provided for
under AIFTA.
Main elements of the ASEAN-India FTA

Compliance to Rules of Origin (ROO) is
important in exporting products under the
preferential trading arrangements. To qualify
for preferential tariffs under AIFTA, exporters
must meet two conditions namely Regional
Value Content (RVC) 35% + Change in Tariff
Despite the global economic setback, India
continues to register impressive economic
growth and in 2009, the growth is expected
at 6.9%. In 2010 and 2011, the growth is
forecasted to be between 7-9%. Based on
WTO report, Indias foreign trade totaled
US$470.9 billion which accounted for 1.5%
of world trade in 2008. There is also a rising
middle class population estimated at 300
million.
India has traditionally maintained high tariffs
in which over 80% of the products imported
into India attract duties ranging from 15-100%.
As such, Malaysia stand to gain from the
FTA as exporters can now export to India at
Malaysian exporters can beneft from
preferential tariff on all products provided it is
not in the Exclusion List of India and importers
Sub-Heading (CTSH). In other words, to
qualify for the preferential tariffs under AIFTA,
exporters must have at least 35% regional
value content or originating materials plus the
product must have undergone some form of
processing at the fnal point of exports.
RVC is calculated as follows:
RVC = FOB price minus non-originating products x 100
FOB price
RVC = RM200 - RM123 x 100 = 38.5%

The originating product accounts for 38.5%
preferential tariffs compared to Indias other
major trading partners. With the duty reduction
and elimination, there are opportunities to
expand and diversify the range of products
traded between Malaysia and India.
There are also ample opportunities for
Malaysian and India businessmen to work
together to form strategic partnership. R&D is an
area where Malaysian companies could forge
linkages to enhance their product strength not
only for the Indian market but also the global
market. Besides, other sectors where Malaysia
and India can form strategic partnership are in
pharmaceutical, ICT, healthcare, auto parts,
machinery and equipment, rubber and palm oil
can beneft from preferential tariffs provided the
products are not on the Malaysian Exclusion
List.

Opportunities for business
This 6-digit subheading for pneumatic rotary type (tools) is HS8467 11. However, in the process to manufacture this prod-
uct, other parts of products falling under HS8467 92 and HS8467 99 may have been used. Thus at the 6 digit level there is
change from HS8467 92 and HS8467 99 to become HS8467 11

India such as building of roads, rails, ports,
airports and running other services facilities.
AIFTA offers the opportunities for Malaysian
companies to source their requirements for
their projects in India from Malaysia.
JOINT ARTICLE MANAGEMENT PROMOTION (JAMP) TOOLS
AND SYSTEM FOR SOUND CHEMICAL MANAGEMENT

The Joint Article Management Promotion
(JAMP) programme undertaken in Malaysia
in 2008 and 2009 consist of seminars,
workshops and training courses to introduce
and disseminate JAMPs activities and its tools.
To date, some 150 manufacturing companies
representing middle-stream and downstream
industries i.e. chemical manufacturers, parts
manufacturers, assemblers and fnal product
manufacturers have undergone training under
the programme, which were organized in co-
operation with the Chemical Industries Council
of Malaysia (CICM), Federation of Malaysian
Manufacturers (FMM), Ministry of International
Trade and Industry (MITI) and Malaysian
Industrial Development Authority (MIDA).
The JAMP is a Japanese private sector
initiative developed primarily to promote the
management and appropriate information
transfer of chemical substances contained in
articles in the supply chain. The programme
is sponsored by the Japan External Trade
Organization (JETRO) and co-sponsored
by the Japan Environment Management
Association for Industry (JEMAI) and
supported by the Ministry of Economy, Trade
and Industry (METI-Japan). Demonstration of
JAMP Program has been carried out in China,
Malaysia and Thailand.
The main activities under the JAMP include
promoting the JAMP guidelines for information
management of chemical substances
contained in products and format sheets for
transfer of chemical substances information,
i.e. the JAMP Material Safety Data Sheet Plus
(JAMP MSDSplus) - for upstream to middle
stream users and JAMP Article Information
Sheet (JAMP AIS) - for middle stream to
downstream users. In addition, JAMP has
launched a brand new IT global portal service
(JAMP-GP) in July 2009 for extremely safe
and convenient transfer of JAMP MSDSplus
and JAMP AIS.
The benefts of using the JAMP tools and IT
system is enormous, as communication along
the supply chain can be made easier and
smoother, allowing industry players to know

useful as its goal is to contribute to international
competitiveness for industry, especially the
SMEs, by promoting appropriate management
of chemicals contain in products. Malaysian
industries are encouraged to make use of the
JAMP tools and systems to communicate with
other players to disclose substances contained
in different products. Exports, Regulatory
Affairs & Safety, Health and Environment
Managers / Offcers in these companies are
urged to take note of the availability of the
JAMP tools which also provides potential
solution to industrys obligation under the EUs
Registration, Evaluation, Authorization and
Restriction of Chemicals (REACH) regulations
and other chemical related legislations.
