Rental Rules/Agreement Contract


1. AGREEMENT Blue Heron Estate L.L.C. (Owner) and Tenant(s) agree as follows: the undersigned is an adult and will be an occupant of the house during the entire reserved period unless there is prior written and signed approval. Other occupants will be family members, responsible friends, adults and children. Use otherwise would terminate this agreement. 2. MAXIMUM OCCUPANCY The maximum number of overnight guests on the entire property is limited to fourteen (14) persons for entire property. Written approval for parties larger than fourteen (14) required 3. MINIMUM STAY Summer (Memorial Day Labor Day Weekends)/Holidays (Easter*, Thanksgiving*, Christmas*, New Years Eve/Day*) require a 4-night minimum. Quiet-season, require a 2-night minimum. *Longer minimum stays may be required during holiday periods. 4. RATES SUBJECT TO CHANGE WITHOUT NOTICE. Call or email for longer stays. *MAIN HOUSE Summer/Holiday Season Off Season $300 per night/4-night minimum $250 per night/2-night minimum $1900 per week $1400 per week $150.00 Non-Refundable Cleaning Fee $250.00 Refundable Damage For Groups of 15 or more, an additional $250.00 Non-Refundable Cleaning Fee For Groups of 15 or more, an additional $250.00 Refundable Damage Deposit Plus 8.6% WA State Sales Tax (no tax charged on refundable fees) *THE LODGE and/or THE SHIP INN Summer/Holiday Season Off Season $135 each per night/2 people max $110.00 each per night/2 people max $50.00 each Non-Refundable Cleaning Fee $50.00 each Refundable Damage Deposit Plus 8.6% WA State Sales Tax (no tax charged on refundable fees)

5. DAMAGE DEPOSIT A security/damage deposit, as mentioned above, is due upon making your reservation. The deposit is NOT applied toward rent; however, it may be fully refundable upon cancellation, or within seven (7) days of departure provided the following provisions are met and no additional costs are incurred. a. NO damage is done to our property or its contents, beyond normal wear and tear. b. All property is clean and is accounted for. #13 CHECK OUT DUTIES are performed. c. 2 (two) keys are left in key lockbox. House is left locked and gates are shut. d. NO early check-in or late checkout. e. Premises are NOT used for any illegal activity. f. NO damage to any of the neighboring properties. g. NO acts that interfere with neighbors rights to the enjoyment of peace and quiet. 6. PAYMENTS/RESERVATION Are on the first pay, first served basis. To book a reservation, the following must be received to secure your dates: a. A (half) of the total cost (rental rate + tax + cleaning) advance payment. b. A $250 (for main house) or $50 each (for The Lodge and/or The Ship Inn) damage deposit payment. c. The signed and faxed or scanned and emailed rental agreement signature page (page 3). All Payments are to be made through PayPal or by personal check when approved. First received, first served. The balance (remaining of total cost) is due thirty (30) days after booking your reservation or sooner. If you are booking within thirty (30) days prior or less, all funds are due immediately through PayPal ONLY. PAYMENT BY PAYPAL: Go to www.paypal.com. Use our email address : blueheronestate@comcast.net in the send to box. You can pay by credit or debit. You do not need a PayPal account to use. PayPal is safe (encrypted) and easy. 7. CANCELLATIONS MUST BE IN WRITING and received MORE THAN 30 DAYS PRIOR to check-in to receive a full refund less $75 processing fee. Cancellations that are made less than 30 days of the arrival date forfeit the full advance payment unless you re-book for a $50 fee. Changes that result in a shortened stay will be handled on a case-by-case basis. The damage deposit of $250 for the main house or $50 each for The Lodge or The Ship Inn is possibly fully refundable. 8. WHAT IS SUPPLIED The Main House - Our fully furnished home includes linens, blankets, pillows, towels, washer and dryer, hair dryers and a fully equipped kitchen including coffee pot. There are basic pantry items (Please replace items used for the next guest), well-stocked spices, teas and Coffee Roasterie Coffee. Several DVDs, some CDs, some books, and some board games are available in the main house. See www.blueheronestate.com for more on amenities. The Lodge and The Ship Inn do not have full kitchens but they each have a mini-fridge, microwave, plates, cups, glasses, utensils, linens, blankets, pillows, towels, hair dryers, coffee and tea pots. A gas BBQ will be provided, upon request, at no additional fee. 9. WHAT YOU SHOULD BRING Bring whatever food and beverages you will need. Some supplies can be purchased from the General Store. Plastic storage bags, your favorite CDs or DVDs. Some of each is available, but not necessarily what you may be looking for. DVD players are supplied at each facility and CD players are supplied at the Main House. Bring a book. Something for when its hot, cold or wet. 10. CHECK-IN Anytime after 3:00 PM. Key lockbox code will be issued upon receipt of all funds and a signed rental agreement. For your security leave 1 (one) key in lockbox at all times. Use lockbox code for your guests. There are no extra keys. The owner and Innkeeper live offisland and cannot supply you with a lost key. Please be careful with the keys. See #11 below. 11. CHECK-OUT By 12:00 PM (Noon). THERE IS AN EXTRA CHARGE FOR A LATE CHECK OUT! PRIOR APPROVAL IS NEEDED. Please leave 2 (two) keys in lockbox. Lost key(s) will result in forfeiture of security deposit.

12. CLEANING There is a $250 non-refundable cleaning fee for the main house and a $50.00 each non-refundable cleaning fee for The Lodge and also for The Ship Inn. YOU ARE REQUIRED to leave the property in the same general condition that you received it (see CHECK OUT DUTIES). If more than normal cleaning is required after your departure, charges will be deducted from your security deposit at the rate of $25 per hour. Additional nonrefundable cleaning fees of $250.00 are required for one-day events with more than 15 guests. 13. CHECK OUT DUTIES When you check out, make sure all doors and windows are closed, and the gas stove and lights are turned off. The following must also be completed: (please) a. Wash and put away all dishes. Wipe appliances, countertops and tables. b. Strip the beds and leave the sheets, pillow cases and towels in a pile ready to be washed. c. All garbage and recycling are placed in the appropriate containers inside The Red Barn. d. All furniture and furnishings must be returned to their original position/place by the end of your contract period. e. See item #11 regarding keys. 14. TENANTS LIABILITY The undersigned agrees to accept liability for any damages caused to the property (other than normal wear and tear) by Tenant and/or Tenants guests, including, but not limited to, landscaping, misuses of appliances, and/or equipment furnished. If damages are in excess of damage deposit being held, Tenant(s) agrees to reimburse Owner for costs incurred to repair/replace damaged items. 15. HOLD HARMLESS Owner does not assume any liability for loss, damage, or injury to persons or their personal property in the house, cottages or on the property. Neither do we accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, electricity, plumbing, cable or internet connection. Nor will we accept liability for any loss or damage caused by weather conditions, natural disasters, acts of God, or other reasons beyond our control. Nor will we accept liability for any loss, damage, or injury if Tenant or Tenants guests perform any activity on the property such as, but not limited to, the use of the crab pots, buoy (use at your own risk), hot tub (use at your own risk), pond, stream, access to The Ship Inn Tree House (use at your own risk), use of the fire pits (use at your own risk) or in the activity of fishing, swimming, etc. 16. ADDITIONAL TERMS AND CONDITIONS The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators fully releases and discharges Owner from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Owner free and harmless of any claim or suit arising there from. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs. 17. AGREEMENT VIOLATIONS require the tenant and all parties to vacate immediately. 18. NO AMENITIES ARE GUARANTEED! There will be NO refunds because of the malfunction of the contents of the house. All house contents are kept in good working order and any problems will be addressed as quickly as possible. There will be no refunds due to inclement weather or earthquakes. Contact your insurance agent about trip insurance. 19. ITEMS LEFT IN THE HOUSE We cannot be responsible for any personal items left in the house. If, after check-out, forgotten items are requested and found, they will be returned by mail C.O.D. with a service charge of $25.00. Items found and not requested within 30 days will be donated to Grannys Attic (our local food bank fund raiser). 20. WRITTEN EXCEPTIONS Any exceptions or additions to the above-mentioned policies must be approved in writing in advance and will be noted on the last page of this agreement.

21. THIS IS A NON-SMOKING PROPERTY. The only area smoking is allowed is on the parking areas. Please remove all smoking debris. Any evidence of smoking in the Main House, The Lodge or The Ship Inn will result in NO refund of your damage deposit. Please do not smoke in the facilities. 22. PETS Small, well-behaved dogs are permitted with the following rules: They must always be under owners care. No cats, birds or other animals. All animal waste must be disposed of in sealed plastic bags then place inside a garbage bag, and stowed in The Red Barn. A $10.00 per day non-refundable pet fee will be required. 23. PARKING Is permitted on the concrete pad on the other side of the neighbors driveway, in front of the garage and next to The Red Barn. No one is permitted to park in the access driveway to the neighbors house, or next to The Ship Inn. The property next to The Ship Inn is not owned by the Blue Heron Estate. Cars parked in these areas are subject to towing. The property will allow space for 14 cars total. All others must park off-site. 24. HOT TUB RULES a. Use at your own risk. b. Alcohol and hot tubs dont mix drink alcohol in the hot tub at your own risk. c. No children under the age of 18 are allowed in the hot tub. d. No glass or ceramics allowed. e. No food consumption. f. Do not enter the hot tub after being on the beach or after swimming in the salt water without showering first. It will result in having to drain the tub and re-establish the necessary chemical levels. Cost will be subject to your damage deposit. 25. QUIET TIME observed 9 AM - 9 PM, please be respectful of neighbors.
