DEED OF REAL ESTATE MORTGAGE

KNOW ALL MEN BY THESE PRESENTS: This Deed, made and executed by : R.G. TANCHOCO REALTY CORPORATION, a corporation duly organized and existing under Philippine laws, with principal office and postal address located at Myriam Theater Bldg., Rizal Ave., Taytay, Rizal, represented by its President, ESTELA C. TANCHOCO, hereinafter referred to as the MORTGAGOR;

CVM FINANCE AND CREDIT CORPORATION, a corporation duly organized and existing under Philippine laws, with principal office and postal address located at Manila East Road, Kaytikling, Dolores, Taytay, Rizal, represented by its President, WARLITO P. MANLAPAZ, hereinafter referred to as the MORTGAGEE;
WITNESSETH: That-

The MORTGAGOR does hereby convey by way of Mortgage unto to the MORTGAGEE a parcels of land, and all the improvements existing or which may exist thereon, situated in the Brgy. of Muzon, Municipality of Taytay, Province of Rizal, with an area of TWO HUNDRED TWENTY EIGHT (228) SQUARE METERS and ONE HUNDRED EIGHTY FIVE (185) SQUARE METERES covered by TRANSFER CERTIFICATE OF TITLE Nos. 653682 and 653540 of the Registrer of Deeds of Province of Rizal, and more particularly describes as follows:

Rec. No. ), situated in the Brgy. of Muzon, Mun. of Taytay, Prov. of Rizal. Bounded on the NE., along line 1-2 by Lot 479, on the SE., along line 2-3 by Lot 493., both of Cad-688-D., on the SW., along line 3-4 by Road Lot 38., on the NW., along line 4-1 by Lot 17, Blk. 32, both of the cons./subd. plan. Beginning at a pt. marked 1 on plan, being S. 44 deg. 25E., 2680.85 m. from BLLM No. 1, Taytay, Rizal., thence; S. 69 deg. 26E., 9.06 m. to pt. 2; S. 00 deg. 57E., 16.27 m. to pt. 3; N. 75 deg. 55W., 13.91 m. to pt. 4; N. 16 deg. 25E., 16.75 m. to pt. of beginning, containing an area of ONE HUNDRED EIGHTY FIVE (185) SQ. METERS.

Of which real properties the Mortgagor is the registered and absolute owner; FOR AND IN CONSIDERATION of the loan extended by the MORTGAGEE to the MORTGAGOR in the principal sum of ONE HUNDRED SIXTY THOUSAND (PhP160,000.00) PESOS, which the MORTGAGOR undertakes to pay with interest of 4% per month, and to secure the payment of the said loan obligation, the MORTGAGOR does hereby cede, assign, transfer and convey, by way of mortgage the above described parcels of land. That the loan shall be payable within THREE (3) months from the dated hereof. It is of the essence of this Deed that if the Mortgagor fail to pay loan and the interest; the mortgage shall be foreclosed and the above described properties shall be sold in the accordance with law, but if the MORTGAGOR pay the said obligation then, this mortgage shall become null and void and no effect.

If at anytime the MORTGAGOR shall fail to comply strictly with provision of this Deed, then the MORTGAGEE may, at its discretion, declare the mortgage due, payable and defaulted, the MORTGAGEE may immediately foreclose this mortgage, judicially and extra-judicially under Act No.3135 as amended by Act4148, and for the purpose, the MORTGAGEE or its lawful representative is hereby irrevocably appointed attorney-in-fact of the MORTGAGOR, with full powers and authority and without the necessity of any judicial order, to take actual possession of the mortgaged properties, to sell or dispose the same; or take any legal action that may be deemed necessary. Any amount received from the sale or disposal of the mortgaged properties shall be applied to payment of the expenses for the foreclosure proceedings, taxes, penalties, interest and the payment of principal indebtedness.
