TOPIC #1: Criminal Elder Financial Exploitation
When does financial exploitation of an elder or disabled person become a crime? How does an elder law attorney involve law enforcement effectively? What can an elder law attorney do to assist with criminal prosecution of a perpetrator? How do the civil, criminal and probate actions work together? These questions and more will be addressed as part of this panel discussion with a cross-section of panelists from the criminal and civil arenas.

TOPIC #5: Medical Marijuana for Elders: Law and Policy


This presentation will provide an overview of the culture and law surrounding one of Colorado's fastest growing health care fields medical marijuana. National trends will be highlighted in addition to relevant state laws and regulations.

TOPIC #6: Ethics and Capacity in Mediation - 1.5 ETHICS CREDITS


The presenters will examine the timely and controversial questions about who determines whether a person has sufficient capacity to mediate and how much is enough to participate in an elder/probate mediation process. Specifically, they will look at the legal impediments and larger issues surrounding mediation with a potentially incapacitated person, along with how the Rules of Professional Conduct impact such mediations.

TOPIC #2: Contested Litigation Basics for the Elder Law Practitioner
Any legal matter where there are two or more parties can become contested litigation and elder law matters are no exception. This session will cover tips and basics to get your elder case started, including claims and remedies, standing, venue and service, along with motion practice, discovery and evidence. The session will end with your chance to play stump the presenter, so come prepared!

TOPIC #7: GLBT Clients and Planning in the Elder Community


Panel discussion regarding legal and cultural sensitivity issues when working with seniors in the GLBT Community. Areas covered will include drafting hints, gifting between non-spouses, Medicaid for non-spouses and how to effectively communicate with your clients.

TOPIC #3: The Balancing Act Between VA Pension Benefits and


Medicaid Planning Is the best financial outcome for a client or a clients spouse always the best solution for the client? When dealing with wartime veterans or their surviving spouses, there is a complicated interplay between what the client and the family wants, where the client can get the best care, and what the greatest financial benefit will be to the client or the clients spouse. This session will explore those complicated issues while providing guidance on how the attorney can analyze and properly advise clients in this area.

TOPIC #8: Probate Compensation Act


This presentation will cover the new statutes governing compensation in probate and protective proceedings. The new statutes include standards for determining reasonableness of compensation and procedures for filing and dealing with objections to a request for payment. Conservatorship Practitioners Explore a variety of problems and share with your colleagues various solutions in challenging cases. Zealous representation of the respondent may conflict with the respondents best interest, but what if your client really needs assistance? How do we coordinate mental health proceedings with guardianship? What issues arise with dual diagnoses of mental illness and dementia regarding medications and placement?
