TOPIC #6: Ethics and Capacity in Mediation - 1.5 ETHICS CREDITS

The presenters will examine the timely and controversial questions about who determines whether a person has sufficient capacity to mediate and how much is enough to participate in an elder/probate mediation process. Specifically, they will look at the legal impediments and larger issues surrounding mediation with a potentially incapacitated person, along with how the Rules of Professional Conduct impact such mediations.

TOPIC #2: Contested Litigation Basics for the Elder Law Practitioner
Any legal matter where there are two or more parties can become contested litigation and elder law matters are no exception. This session will cover tips and basics to get your elder case started, including claims and remedies, standing, venue and service, along with motion practice, discovery and evidence. Medicaid Planning Is the best financial outcome for a client or a clients spouse always the best solution for the client?
