JFCI Drug Testing for Students Participants in School-Sponsored Activities Student Athlete Drug Testing Policy Definitions Drug:

Controlled substances as defined by Wyoming Code Section 35-7-1002, except those possessed and/or pursuant to a valid prescription.

Participant Athlete: Participant:

Any participant Students participating in interscholastic programs sponsored by the Wyoming High School Activities Association (WHSAA) and Star Valley High School, including cheerleaders, drill team, speech/debate, managers, stats, or video personnel, and all other programs listed under activities in Lincoln County School District #2at SVHS. Fall, winter, and spring season begin on the first day of practice allowed by the WHSAA and end when the final game is played in that season, including all District and State tournaments. Star Valley High School Lincoln County School District #2 is conducting a mandatory drug-testing program for participating students athletes in grades 9712. Its purpose is threefold: 1) To provide for the health and safety of all participants athletes. 2) To undermine the effects of peer pressure by providing a legitimate reason for participants athletes to say NO to drugs. 3) To require participants who use drugs to participate take part in a drug and counseling treatment program.

Policy Statement:

Procedures for participants athletes Consent: Each participant wishing to participate take part in an activity shall indicate consent by completing and signing the mandatory drug test form.

Participant Selection: At the option of the district, participants who participate in activities may be subject to drug testing during at the beginning of any athletic season they are taking part in. In addition, random testing by lottery draw may be conducted monthly during the athletic season. Selection for random testing will be by The lottery drawing will be done from a pool of all participants in activity programs at the time of the drawing. The building principal or designee shall take all reasonable steps to assure the integrity, confidentiality, and random nature of the selection including, but not limited to: ensuring that the person drawing the names has no way of knowingly choosing, ensuring that the names of all participants are in the pool, and ensuring that the identity of participants drawn for testing is not known to those involved in the selection process; and ensuring direct observation of the selection process by at least two adults. Sample Collection: Samples will be collected at a mutually convenient time on the same day the participant is selected for testing, or if the participant is absent on that day, on the day of the participants they return to school. If a participant is unable to produce a sample at a particular time, they participant will be allowed to return later that same day to provide the sample. All participants providing samples will be given the option of doing so alone in any individual stall with the door closed.

Prescription Medication: Participants who are taking prescribed medication need to provide a copy of the prescription or a doctors verification in a sealed envelope to school personnel at the time a sample is collected. That envelope will be forwarded,

unopened, to the testing lab with the sample and instructions for the lab to consider the participants use of such medication to ensure the accuracy of the result. Such information provided by the participant will not be disclosed to any school official. Participants who refuse to provide verification and test positive will be subject to the actions specified below for positive tests. Scope of Test: The testing lab will be instructed to test for one or more illegal drugs. Participant samples will not be screened for the presence of any substance other than an illegal drug or for the existence of any physical condition other than drug intoxication. Any participant or athlete who willfully provides a false urine sample, or who otherwise tampers with a urine sample or undertakes any effort to obstruct or impair the accuracy of a drug test, shall likewise be prohibited from or suspended from participation in athletics activities for the rest of that sport season. A coach or administrator who has reasonable cause for concern may request a participant an athlete, who is participating taking part in an activity under his/her direction, to take a test any time during that sport season.

Procedures in the Event of a Positive Test: Whenever a participants or athletes test result indicates the presence of illegal drugs (positive test) the following will occur: 1. Upon parent request Another the sample will be submitted to the an independent lab for retesting at the parents expense. If the sample retests negative, the participant will be notified and no further action will be taken. If the sample retests positive, the custodial parent or legal guardian will be notified and a meeting will be scheduled with the building principal or designee, the participant, and the custodial parent or legal guardian. Procedure in the Event of a Second Positive Test: A participant athlete who tests positive a second time as confirmed by the independent lab during any test will be suspended for all athletic from participation for the balance of that sport season. In order for the participant athlete to be eligible for the next sport season that he/she participates takes part in, they participant must submit to weekly drug testing for six weeks at their participants own expense, and complete a drug assistance program with counseling at their own expense if applicable. Also, the participant or athlete will be required to take a mandatory drug test prior to participating taking part in another sport activity. Third Positive Test: A participant athlete who tests positive a 3 time will be suspended from participating in athletics taking part in activities for the remainder of his/her high school eligibility.

Non-Punitive Nature of Policy: No participant athlete shall be penalized academically for testing positive for illegal drugs. The results of drug tests pursuant to this policy will not be documented in any participants academic records. Information regarding the results of drug tests will not be disclosed to any criminal or juvenile authority unless requested by valid and binding subpoena or other legal process, which the district will not solicit. In the event of service of any such subpoena or other legal process, the participant and his/her custodial parents or legal guardian will be notified at least 72 hours before response is made by the district.

Voluntary testing program: To assist in the ultimate goal of drug free schools and drug free students participants, the district will provide drug testing to any participant whose parents request the testing be done. The nature of the testing is a routine sample with immediate on-site results. The testing is provided at no cost to parents and is absolutely confidential in nature with only the parent, participant, and tester knowing the results. There are no legal or criminal actions taken and no discipline from the district will result from the testing. There will be no records kept. This service is offered solely for the information of the parent and is ultimately their decision what to do with the results and information. Guidelines and procedures for testing: At the beginning of each athletic sport season, as setforth by the Wyoming High School Activities Association, all participants who wish to participate in said activity will submit a signed consent form from their parents or legal guardian allowing testing to be done. Participant names will be drawn from a pool of those taking part in activities of names of participants who are participating in activities at Star Valley High School. After names are drawn for the testing they will be returned to the pool thus ensuring the randomness of the draw. It is possible that an athlete a participant could be drawn every time or that they may not be drawn at all. Testing Procedure: On the day the numbers are drawn, those participants selected will be notified and will report to the designated place to produce a sample. They will be given a sample collector and will go to a stall where they will produce a sample. He/she may do so behind closed door and in private. All excess clothing, coats, and extra shirts will be removed. Athletes Participant may be asked to empty pockets to insure the validity of the test. The tester may color the water in the commode before the athlete student enters. After the sample is given it will be checked for temperature and signs of tampering. It will then be sealed with the number of the athlete participant clearly printed on it. If an athletes a participants test is confirmed positive his/her number will be removed from the pool until he/she has completed policy requirements at which time the number will be returned to the pool.

I hereby agree to accept and abide by the standards, rules, and regulations set forth by Star Valley High School, the Lincoln County School District #2 Board of Trustees, and the sponsors for the activity in which I participate. I also authorize Star Valley High School Lincoln County School District #2 to conduct tests on urine specimens, which I provide, to test for drugs. I also authorize the release of information concerning results of such a test to Star Valley High School Lincoln County School District #2 and my parent or guardian. This shall be deemed a consent pursuant to the Family Education Right to Privacy Act for the release of above information to the parties named above. The undersigned parent/guardian does hereby consent to and authorize the above described testing.
