CAUSES OF ACTION

What are the possible causes of action that one can take against

the church?

Well in the matter of Rob Jr. the Church of the Devine Light

was at fault on the 15 years son of Rob and Bunny. Because the

organizer of the youth group Tom Marsden was an em ployee of the

Church and the church were held responsibility for the youth

group. The charges that the boy’s parents could file was for cause

of action is negligence, intentional infliction of em otional distress,

also false imprisonm ent.

Because when he kept misleading the boy and brainw ashing him

and didn’t want him to leave to go hom e that was infliction

Em otional distress on the child. When the parents had to make

An excuse to see the child then that was em otional distress for

the child and the parents. It put the child in a state of mind he

Didn’t know who to believe according to what I read. When they

the church held him against his parents will was false

im prisonm ent also. When they kept him at the church and didn’t

let his parents see him that was negligence on the part that the

parents didn’t know if he was being taken care of or what.

Then when they held him there for a period of six months and they

had to make an excuse to see him to give him money for that month
That was endangering the welfare of a minor because the parents

didn’t know what to expect of the church because of the

misrepresentation that had endured. Also when you are in control

of a group of people’s children you as an adult are to protect the

children from harms way and that every precaution should be took

not to endanger that child or children. As for the parents they had

every legal right to bring suit against the church. Because the church

had exploited the child by putting him in danger by brain washing

him and also intentional infliction of em otional distress. Because the

child didn’t understand what the church was doing to him. They the

church did an enjustm ent against the child. The parents because

they trusted the church and they were misleading by the church also.

The suit they can file is Intentional Tort from what I read because

an intentional tort is described as a civil wrong resulting from an

intentional act on the tortfeasor. The unjust enrichm ent was done

on the child and his parents by the church. The basis of the cause

action was when they the church held him there for a period of six

months without the parents perm ission to do so.

This is the basis of my paper was written on.

Causes of action

Neglect: is when the tortfeasor to take sufficient care in fulfilling a

Duty ow ed.

Battery: is when negligently and voluntarily brings unconsented

harmful or offensive contact with a person or to som ething closely

associated with harm.

False imprisonment: wherein a person is intentionally confined

without legal authority.

Intentional infliction of em otional distress: is a claim of recent

origin for intentional conduct that results in extreme em otional

distress.

Unjust enrichm ent: is a legal term in law and in several

jurisdictions in which one party is unjustly enriched at the expense

of another, an obligation to make restitution arise, regardless of

liability for wrongdoing.
