WHEREAS, in thdjbast elections, there were insiances when: (1) the upper and lower serial numbers of ftie ballot are different; or (2) either the upper or lower serial number of the ballot is &sing; or (3) the serial number of the ballot cannot be easily ascertained or is unreaddble; or (4) the serial number of the ballot does not belong to the series of the ballots igmed; WHEREAS, there iS a possibility that the foregoing problems will recur during the October 25, 2010 Bat-angay and Sangguniang Kabataan Elections but due to time constraints, the said balldts can no longer be replaced; NOW, THEREFORE, the Commission on Elections, by virtue of its mandate under the Constitution, the Omnibus Election Code and other election laws, RESOLVED, as it hereby RESOLVES to issue the following guidelines in cases when: (1) the upper and lower serial numbers of the ballot are different; or (2) either the

upper or lower serial number of the ballot or both are missing; or (3) the serial number of the ballot cannot be easily ascertained or is unreadable; or (4) the serial number of , the ballot does not beloncj td the series of the ballots issued;
A. THE UPPER AND LOWER DIFFERENT SERIAL NUMBERS OF THE BALLOT ARE

The Board of Election Tellers (BET) concerned shall record in the Minutes of Voting the different serial numbers appearing in a ballot, indicating therein whether it is located in the upoer or lower portion of the ballot before issuing the same to the voter. The two differknt serial numbers shall be recorded opposite the name of the voter in the EDCVL.

OR

I f the serial number either in the upper or lower portion of the ballot is missing, the BETs concerned shall take note in the Minutes of Voting the serial number contained therein, indicating whether it is located in the upper or lower portion of the ballot. The Chairman of the BET shall copy the available serial number in the portion of the ballot where it'does not appear and affix his initial thereon. The available serial number shall be recorded opposite the name of the voter in the EDCVL. Thereafter, the Chairman shall issue the ballot to the voter.
I f both serial numbers in the upper and lower portion are missing, the BET shall take note of the fact in the Minutes of Voting, mark the ballot as "defective ballot" and thereafkr, place the ballot inside the envelope intended for spoiled ballots.

The ascertained serial number of the ballot shall be noted in the Minutes of Voting and recorded opposite the name of the voter in the EDWL. Thereafter, the Chairman of the BET shall issue the ballot to the voter. I f the serial "dhber of the ballot is totaily unreadable, the BET shall take note of the fact in the Minutes of Voting, mark the ballot as "defective ballot" and thereafter, place the ballot inside the envelope intended for spoiled ballots.

The BETs concerned shall note in the Minutes of 'Voting the serial number of the ballot that does .hot belong 'to the series and record the same opposite the name of the voter in the EDCVL. Thereafter, issue the ballot to the voter.

RESOLVED M O R ~ C ~ V E R in all instances, the BETS are directed to issue that first the Official Ballots with complete and regular serial numbers and shall only issue , the Official Ballot/s with the above circumstances t o the voter, except those which were marked as defective ballots, if there are no more available ballots in the precinct concerned. Let the Office of the Deputy Executive Director for Operations implement this Resolution. SO ORDERED.
