Thebuyeragreestopurchasefromselleramale/femalepuppy("puppy,""thisdog"),litternameofthe EnglishshepherdbreedfromtheCaledoniaDannyBoy(sire)xBrandywineBriarRose(dam)litterwhelpedon26July 2011.Puppy'spermanentAvidmicrochipnumberis: Thepurchasepriceofthepuppywillbe,dueonorbeforedeliveryofthepuppy.Anyandallshippingor transportcharges,includingairfares,healthcertificatecosts,shippingcontainers,andseller'sdeliverytoanairport,are theresponsibilityofthebuyer.

Thesellerwarrantsthat:

1. Thepuppyisingoodhealthatthetimeofdeliveryandhadbeenimmunizedandtreatedforparasites accordingtheattachedhealthrecord. 2. TheparentsofthispuppyhavebeenevaluatedforhipconformationbytheOrthopedicFoundationfor Animals(OFA)andwerebothscored"OFAGood"asdocumentedontheOFAopendatabaseandtheEnglishShepherd ClubRegistry(ESCR)database. 3. Thepuppyisinapparentgoodhealth,andnocongenitalorgeneticdefectsareapparentatthistime.

4. Thepuppyappearstobepotentiallysuitableatthetimeofdeliveryforthebuyersstatedpurposeof .Sellermakesnorepresentationthatthepuppywillbesuccessfulatthispurpose,orthatthepuppyis suitableforanyotherpurposenotstatedbybuyer. 5. Allrepresentations,writtenandverbal,sellerhasmaderegardingthispuppy'sancestry,health, temperament,andconditionare,toseller'sknowledge,trueandcorrect. 6. IfthisdogdevelopscongenitalhipdysplasiaratedmoderateorseverebytheOrthopedicFoundationfor Animalspriorto26January2014sellerwillrefundpurchasepricetobuyer. a) Dysplasiasecondarytoinjurywillnotmeritarefund.Injuryincludes,butmaynotbelimitedto,anyhistoryof traumatothehipjoint,pelvis,rearlimbs,orlowerspineoftheanimal. b) Ifthedoghasbeenpermittedtobecomeoverweightandscoresa4or5onastandardbodyconditionscore(BCS)5 pointscale,afindingofdysplasiawillnotmeritarefund. b) Seller'sliabilityisstrictlylimitedtotheamountofthepurchaseprice,anddoesnotincluderefundoftransportation feesoranymedicalexpenses,oranyotherexpenses. B. Theselleragreesto:

1. Registerpuppyinbuyer'sname,usingbuyer'schoiceofnameandwiththeBrandywinekennelprefix,with theEnglishShepherdClubRegistrywithin60daysofexecutionofthiscontractor30daysofallbuyersfromthislitter informingsellerofeachnamechoice,whichevercomeslatest.Sellerwillpayregistrationfees. 2. Informbuyerofallchangesinaddress,telephonenumber,andemailaddresswithin30daysofchange.

3. Informbuyerofanyinformationaboutthegenetichealthofthisdog'srelativeswhensignificantinformation becomesavailable.SubmitallsuchinformationtotheEnglishShepherdClubRegistryDatabase(ESCRdB).

Acceptreturnofthisdogandrefundbuyer'spurchasepriceifnotifiedwithin72hoursthatbuyer's examiningveterinariandetectsapreviouslyundetectedcongenitaldefectorcommunicablediseasethatwaspresentat timeofpurchase. 8. Registerthisdog'spermanentmicrochipIDnumberwiththeapplicable24hourtrackingservice,providing bothbuyer'sandseller'scontactinformationtothemicrochipregistry. C. Thebuyerattests:

1. AllrepresentationsIhavemadetoseller,writtenorverbal,aretrue,complete,andcorrect,tomyknowledge andbelief.Substantialmisrepresentationbymewillconstitutegroundsforownershipofthisdogtoreverttoseller. 2. Ihaveneverbeencharged,convictedorpleadednocontesttoanychargeofcruelty,abuse,orneglecttoan animalorchild,inanyjurisdiction.Anypriorchargesofthisnaturewillconstitutegroundsforownershipofthisdogto reverttosellerwithnorecompenseorrefundduethebuyer.Anyfutureconvictionofthisnaturewillautomatically revertfullownershipofthisdogtotheseller,withnorefundorrecompenseduethebuyer,unlesstheappliedlawisthat oftheCityofAlbuquerque,StateofNewMexico. 3. Isufferfromnophysicalormentalconditions,notdisclosedtoseller,thatcouldinterferewithmyabilityto carefor,train,andprovideappropriatesafety,directionandleadershiptothispuppy.Nomemberofmyhousehold, regularvisitor,orpersonwhocouldgainaccesstothispuppyposesarisktothispuppy'ssafetyorphysicalormental welfare. D. Thebuyeragrees:

1. Iwillhavethepuppyexaminedbyalicensedveterinarianofhisorherchoicewithin72hoursofdelivery, andinformthesellerinwritingofanysignificantorabnormalexamresultswithin24hoursoftheexamination.I authorizesellertoconsultdirectlywithmyveterinarianaboutsignificantorabnormalhealthfindings. 2. Iwillprovideappropriatetraining,socialization,nutrition,andveterinarycareconsistentwiththewritten andverbalguidelinesprovidedbyseller. 3. Iwillnotallowthisthepuppytobecastratedorspayedbefore26January2012.(6monthsofage).

4. Iwillmaintainthisdogforthepurposeindicatedtoseller,underhumaneconditions,andinaccordancewith allapplicablelaws.Iwillneveruseorallowthisdogtobeusedforanyillegalpurpose. 5. Iwillinformsellerofanyhealthconditionthatthisdogdevelopsthatmaybegeneticorcongenitalinnature, orcarryageneticorcongenitalcomponent,within30daysofdiagnosis,andinformseller,within30daysofthisdog's death,ofthedateandcauseofdeath. 6. Iwillinformsellerwithin48hoursifthisdogshouldbelost,stolen,ormissing.

7. IwillreturnpuppytosellerintheeventthatIcannolongerkeepher/him,atanytimeduringpuppy's lifetime.Buyeragreesthatthisdogwillnotbesold,givenaway,surrenderedortransferredtoanypersonnotpartyto thiscontractwithoutthewrittenconsentofthesellerandexecutionofanewcontractbetweensellerandthedog'snew owner.IagreetoinformmyheirsofthisprovisionagainsttheeventthatIpredeceasethisdog. 8. IwillinformsellerandoffertoreturnthisdogifatanytimeIamconsideringeuthanizingthedogforany reasonotherthanuntreatableillness/injuryorunrelievedpain. 9. Iwillpayalltransportcostsincurredtoreturndogtosellerorherdesignatedagentshouldthisbecome necessary,eitherbymychoiceorthetermsofthiscontract. 10. IwillneverattempttoregisterthisdogwiththeAmericanKennelCluborCanadianKennelClub,including inclusioninthe"FoundationStockService"oranyfuturesimilarprogram.Iwillneverattempttoobtainanindefinite listingprivilege(ILP)numberforthisdogwiththeAKCorCKC.IwillneverattempttoenrollthisdogintheAKC "CaninePartners"programoranyfuturesimilarprogram.Iwillneverattempttoregisterthisdogwithanyentityasa differentbreed,orcompeteinanysportasadifferentbreedorasa"mixedbreed."Iwillneverattempttoregisterthis dogwithanyentityinsuchamannerastoconcealher/hisidentity.Iwillneverattempttoconcealthisdog'sidentityby removingoralteringthemicrochipnumber. a) Iforiginalorreplacementmicrochipbecomesunreadable,isremoved,orfailsforanyreason,Iwillhavethisdogre microchippedwithin24hoursofdiscoveryandnotifysellerinwritingofthenewmicrochipnumberwithin24hoursof implantation,alongwithallauthorizationanddocumentationnecessaryforsellertoregisterthenewnumber. b) Ifthisdoghasanadversereactiontothemicrochipthatnecessitatesitsremovalbyaveterinarian,Iwillnotifyseller within24hoursandarrangeforalternativepermanent identificationandregistrationinconsultationwithher 11. Iwillneverenterthisdoganyconformationcompetition.Iunderstandthatsellermayprovidemewith writtenpermissiontopresentthisdogforconformationevaluation/breedsurveysponsoredbytheEnglishShepherd Cluboranotherorganization,shouldsuchevaluationsbecomeavailableatafuturedate. 12. Iwillhavethisdogradiographedandevaluatedforcongenitalhipdysplasianolaterthan26January2014 (30months)andcommunicatetheresultstosellerwithin15daysofreceipt. a) HipevaluationshallincludeevaluationandratingbytheOrthopedicFoundationforAnimals(OFA)and/or evaluationandratingbytheUniversityofPennsylvaniaHipImprovementProgram(PennHIP)and/orevaluationand ratingbyOntarioVeterinaryCollege(OVC).Theopinionofaprivatepracticeveterinarianorpreliminaryevaluationwill notfulfilltherequirementforevaluation. b) IfthisdogisevaluatedbytheOFAorOVC,buyerwillselecttheopendatabaseoptionatthetimeof radiographandallowdog'sresultstobepublished c) IfthisdogisevaluatedbyPennHIP,buyerwillforwardaphotocopyofthereporttosellerandallowsellerto publishresultsintheESCRdatabaseandelsewhere. d) PennHIPevaluationwillsatisfythetermsofthiscontractifconductedafter26July2012(12monthbirthday). OFAorOVCevaluationwillsatisfythetermsofthiscontractifconductedafter26July2013(24monthbirthday.) 13. Iwillmaintainthisdoginaccordancewithallapplicablelaws,includinglawsgoverningvaccination, licensing,housing,andpublichealth. a) Iwillinformsellerwithin48hoursintheeventthatanychangeinalocalorstatelawintheplacewhereI reside,orchangeinresidenceshallrenderitimpossibleformetolegallymaintainthisdogunderthetermsofthis contract. b) IwillreturnthedogifrequestedbysellerifIcannotmaintainthedogunderthetermsofthiscontractand remainwithintheapplicablelaws. 14) IwillagreethatIwillnotacquireorraiseonthesamesiteasthispup,anypuppybornbetweenthedatesof January26,2011andJanuary26,2012(withinsixmonthsofthispup'sbirthdate)beforethedateofJuly262012(pup'sone yearbirthdate).Thisclausedoesnotapplytoshorttermfosteringofpuppiesforrescuesorshelters.

1. Iwillnotbreedthisanimalpriortotheageof24months,26July2013."Breeding"shallmeanallowingan intactmaletoserviceanybitch,orallowingabitchtotiewithanyintactmale,oranyartificialprocedureintendedto effectconception.Iwillnotbreedthisbitchontwoconsecutiveheatcyclesortwiceinany12monthperiod.Iwillnot permitthisbitchtobecomepregnantmorethanfourtimesinherlifetime. 2. IwillnotbreedthisdogpriortotheissuanceofaFair,Good,orExcellenthipratingfromtheOFAora normalratingfromOVCissuedonradiographstakenafter26July2013,oraPennHIPDIbelowthebreedmedianwithno evidenceofDJDissuedonradiographstakenafter26July2012.Sellerreservestherighttoliberalizethesecriteriain individualinstancesathersolediscretion.Allwaiversandalterationswillbeinwritingonly.Buyershouldcontactseller todiscussoptionsifthisdogreceivesaPennHIPDIratingslightlyabovethebreedmedianoraBorderlineratingfrom OFAandbuyerstillwishestoconsiderbreeding. 3. Iwillexerciseduediligencetopreventthisdogfrombreedingpriorto24monthsofageandissuanceofan acceptablehiprating.Iwillinformsellerimmediatelyintheeventofanaccidentalbreedinganddiscussavailable options. 4. Iwillneuterthisdogwithin60daysofreceivingtheratingintheeventthatthedogfailstorateaFairor betterfromOFA,oraDIbelowthebreedmedian,oraNormalratingfromOVC,unlessotherwiseexemptedinwritingby seller. 5. Iwillnotbreedthisdogtoanyanimalthathasbeendiagnosedwithorissuspectedofsufferingfromhip dysplasiaoranyothergeneticconditionthatseriouslyimpairstheanimal'shealthorqualityoflife,orhasthepotentialto substantiallyaffectthequalityoflifeofhis/herdescendants,includingbutnotlimitedtoepilepsy,deafness,visiondefects, luxatingpatella,autoimmunedisorders,severeallergies. 6. IwillnotbreedthisdogtoanyanimalthathasfailedtosecureannormalhipclearanceasdefinedinE.2., whetherthatanimal'sradiographswerefoundtobenonnormalbytheratingentities,ortheanimalwasnever radiographedandevaluated,orreceivedonlyapreliminaryscore,withoutwrittenwaiverfromseller. 7. Iwillnotbreedthisdog,andwillneuterthisdoginatimelymanner.shouldhebediagnosedwithany geneticorpossiblygeneticconditionthatsubstantiallyaffectshisqualityoflife,orhasthepotentialtosubstantiallyaffect thequalityoflifeofhisdescendants,includingbutnotlimitedtoepilepsy, deafness,visiondefects,luxatingpatella, autoimmunedisorders,severeallergies..Thisclauseshallnotbeconstruedtorequireneuteringanydogthat,inthe opinionofbuyer'sveterinarian,shouldnotundergoneuteringsurgeryduetoanelevatedhealthriskoftheprocedure. 8. Buyermayhavethisdogneuteredbyalicensedveterinarianatanytimeafter26January2012(sixmonth birthday),athisowndiscretion.Noportionofthiscontractshouldbeconstruedtoprohibitbuyerfromhavingthisdog neuteredaftersixmonthsofage.Sellerdoesnotrecommendneuteringpriortooneyearofageinmostinstances. F. BreachandDamages

1. ThiscontractisexecutedunderthejurisdictionoftheCommonwealthofPennsylvania,whichalsohas jurisdictionincaseofbreachbyeitherparty. 2. IncaseofbreachofprovisionsofsectionsE.orC.2.,orincaseofsubsequentconvictionornocontestpleatoa crueltytoanimalsorchildabuseorneglectchargebybuyer,damagesshallconsistofimmediateforfeitureofthisdogto sellerwithoutcompensationbyseller,andimmediateforfeiture,withtransferofallregistration,ofanyoffspringowned bybuyerand,inthecaseofbreechofsectionE.,theproceedsfromthesaleofanyoffspringorstudservicesperformed beforediscoveryofbreachbyseller.
