Document: CASE SUMMARY Author: 44577 - LADD, J Related date/time: Oct-27-2011 0432 The def violated a domestic violence injunction out of Sarasota as well as a "no contact order" issued by Judge Heinrich by calling the victim on the phone. While attempting to apprehend the def, he fled on foot and jumped from a 3rd floor balcony. The def was eventually taken into custody.

Document: INITIAL REPORT Author: 44577 - LADD, J Related date/time: Oct-27-2011 0544 We responded to 2021 N. Lemans Blvd. #1411 in reference to harassing phone calls. These calls were coming from the def who she had a restraining order against. C. Miller and myself were familiar with this case since we arrested the def two nights ago. We were also aware of a "no contact order" issued by Judge Heinrich. Upon arrival, we interviewed the victim. She was very upset and fed up with this whole situation. We looked at her land-line phone and saw a call from the Tahitian Inn came in at 2252hrs. We saw another call from the def's cell phone at 0053hrs. This cell number was (310)988-8395 which was the same number the def gave us two nights ago as his phone number. While we were gathering this information, the def called again from his cell phone. We had the victim put the phone on speaker when she answered. During this conversation the def kept asking things like "how can we work things out, where you moving to, you know I didn't threaten you, I didn't throw the remote at you I threw it at the floor." This phone call lasted about 5 minutes and mostly involved the def trying to work things out. We whispered to the victim to hang up and tell him to stop calling which she did. The def called again at 0145hrs from his cell phone, but we told the victim not to answer the phone. We then met with Sgt Miller and informed him of this offense. We all responded to the Tahitian Inn in an attempt to pick-up the def. We originally were unable to locate the def but did locate his friend (David Dominique) in the parking lot. I interviewed this subject at this time. During this interview, I saw a subject on the second floor hiding behind a pillar. I yelled the def's name and told him to come down and talk. This def tried concealing himself a little more but decided to run up a stairwell as we approached him. We identified ourself as the police and ordered him to stop which he refused to do. He had a big head start running up the stairs but we heard the door at the 3rd floor hallway slam. As we came through this door we lost sight of the def. The def's friend (David Dominique) had the key for this room and opened the door for us to look inside. The def wasn't in the room but I observed the sliding glass door heading out to the balcony off the track. It was obvious the def came out this way. As we went out to the balcony to look around, we saw the def fall from a 3rd floor balcony next to the one we were standing on. The def apparently leaped up from his balcony and grabbed a hold of the roof. He then must have scurried across the roof (about 30 feet) until he thought he was hanging over top of the next balcony. The def then let go but missed this balcony. He came crashing down on top of wooden high chairs that were laying on the ground. This fall was 34 feet (measured with laser). The def then hid in some trees directly below where he was apprehended. The def's mouth was full of blood from where he bit his tongue. He also injured his foot. Document: STATEMENT Author: 44577 - LADD, J Subject: MAJOR, KATHRYN ANN Related date/time: Oct-27-2011 0447 Stated that the def was arrested on 10/25/11 for domestic violence. She said the Judge from this case ordered the def to have no contact with her. She also says she went to court on 10/25/11 in Sarasota and the Judge in that case extended the temporary injunction she had on the def until he could show up at court. On todays date 10/26/11 the def's friend (David Dominique) came to her apartment to get all of the def's belongings out of her apartment. During this time, the def called her from the Tahitian Inn at 2252hrs. He asked to speak to David at this time. Once she realized who it was, she told him he wasn't suppose to call her and handed the phone to David. David talked to him briefly and then hung up. David eventually gathered all the belongings and left the apartment. On 10/27/11 at 0053hrs (2 hours from the first call), the def called the victim from his personal cell phone. When she answered the phone, the def was insisting they try and work things out. She said the def sounded very drunk at this time. She said this phone call didn't last long because she didn't want to talk to him. She decided to call the police soon after she hung up. When the police arrived and began interviewing her, the def called again from his cell phone at 0133hrs. The police asked that she put the phone on speaker when she answered. During this conversation the def was asking her to work things out. This conversation lasted approx. 5 minutes and ended with her telling him to stop calling. At 0145hrs the def called again from his cell phone, but the police told her not to answer. She said she is afraid of the def and afraid of what he's capable of doing to her. She does wish to prosecute.

Document: STATEMENT Author: 44577 - LADD, J Subject: DOMINIQUE, DAVID FABRICE Related date/time: Oct-27-2011 0529 Stated that he is the def's trainer and is friends with the victim. He says there is always drama between these two. On this night, he went to the victims apartment to gather all the def's property. He said the def called him while he was there, but doesn't remember if he called her phone or his cell phone. After he gathered all the belongings, he returned back to the Tahitian Inn #307 where the def and him are staying. The police arrived at the Tahitian Inn and spoke with him in the parking lot. He told police he didn't know where the def was, but thought he went to a different hotel with another friend. He insisted the def was not at this location. When he saw the def hiding on the second floor he was shocked. He asked the def to come down and talk to the police but saw the def run. He then opened room #307 and let us inside to look for the def. He was shocked when he saw the def jump from the 3rd floor balcony.

Document: SUPPLEMENTAL Author: 20734 - MILLER, CRAIG Related date/time: Oct-27-2011 0441 I responded to the victim's (Kate Major) residence to assist Ofc. Ladd in his investigation. As Ofc. Ladd was conducting her interview the house phone rang. Kate Major put the phone on speaker and I immediately recognized the voice as Michael Lohan as I had spent the previous day with him while he was in custody for five hours. See supplement of what Michael Lohan said on the phone. We then responded to the Tahitian Inn. This is where Michael Lohan stated on the phone he was staying. Ofc. Ladd, Sgt. Miller, Ofc. Hesselink and myself arrived at the hotel and made contact with David Dominique. Mr. Dominique was standing in the parking lot to the rear of the hotel. He was then interviewed by Ofc. Ladd. Ofc. Ladd then bought it to my attention he spotted Michael Lohan on the second floor of the hotel hiding behind a pillar. We both shouted to Lohan to come down the stairs to us. He immediately ran down the breeze-way towards the stairwell. Ofc. Ladd and myself ran up the stairwell from the parking lot. As we ran up I yelled to Lohan, "It's the police and to stop you are under arrest." Lohan continued up the stairs to the third floor. As the fire door slammed shut I heard another door slam shut. We immediately went to room 307. This is the room Lohan was staying in. I knocked on the door and yelled, " Michael it is the police open the door." After several commands and knocks Lohan did not open the door. Sgt. Miller and David Dominique came up to room 307. Mr. Dominique used his key and opened the hotel room door. Ofc. Ladd noticed the screen door was off the hinges to the balcony. Ofc. Ladd opened the sliding glass door. I stepped out onto the balcony and heard a loud crash below. I saw a white male wearing a maroon shirt lying motionless on the ground. Sgt. Miller and myself exited the room and ran down the stairs. the area of the balcony. I ran past a large group of palm trees. I stopped and saw a maroon shirt in the corner of my eye. I turned towards the palm trees and noticed Lohan was crouched down in the middle of them trying to conceal himself. I ordered Lohan to come out. He laid there motionless as to think I would not see him. I reached over a small black aluminum fence and grabbed his left arm. I pulled him out of the palm trees and put his left arm in a straight arm bar. I was directing him towards the gate when Sgt. Miller jumped over the fence. Lohan was then taken into custody without further incident. I got permission from Lohan to look at his cell phone. He claimed Kate Major called him first. I did not see any incoming calls from the number that he gave me that he says is hers.
