Dear President Michael Crow, My name is Jenny Reich and I am the co-president of the ASU Coalition for Human Rights. Together, with co-president Danielle Bck, I am writing to humbly make a public records request relating to Arizona State Universitys current investment portfolio, which has accumulated over the past three years. Pursuant to Arizona Revised Statutes 39-121, et seq., we are entitled to examine or be furnished copies, printouts or photographs of any public record during regular office hours or may request that the custodian mail a copy of any public record not otherwise available on the public body's website to the requesting person. Public records include books, papers, maps, photographs, or other documentary materials, regardless of physical form or characteristics. Specifically, our organization would like to review: 1) the names, addresses, and dollar amounts invested for every organization in which the Universitys funds have been invested over the past three years; 2) any documents or other materials that detail the Universitys investment selection process and criteria currently used to select the Universitys investment opportunities; and 3) all documents, correspondences, and other materials (electronic and print) shared between the ASU Foundation and the University over the past three years, particularly those that mention the investment selection process and criteria currently used by the ASU Foundation to select entities in which to invest University funds, as well as the names, addresses, and dollar amounts invested in organizations through the ASU Foundation. This request is for noncommercial purposes. We will be more than happy to pay for copies and postage fees of up to $50.00. Please inform us if the inspection and copy costs will exceed this amount. If you refer me to a website containing the information requested, please specify the precise web page(s) on which the information may be found. We request your kind response within ten (10) business days of receiving this letter. If you are unable to complete the request within that time, please contact me with your progress and expected completion date. If you feel that any of these items are specifically exempt from disclosure by statute, please state your reasoning. We will consider our request denied if your office fails to promptly respond, or fails to itemize any records that you expressly deny access to.

Please be advised that we are prepared to pursue whatever legal actions necessary to obtain access to the requested records, including the filing of a special action in the Superior Court of Maricopa County to compel disclosure. Willful violation of the open records law may result in the award of legal costs, including damages and reasonable attorney fees.
