ASUS Computer International LIMITED ONE-YEAR WARRANTY FOR ACCIDENTAL DAMAGE Terms and Conditions If you purchased your

ASUS notebook computer on or after September 10, 2007 from a selected retailer, your Notebook Computer includes the following limited, one -year warranty for accidental damage. The warranty period extends for one year f rom the date of purchase by the original end-user. There is a limit of one claim per notebook. This limited warranty applies only to selected ASUS-branded Notebook Computers, and to any accessories that are built in or onto the base unit, including parts or accessories that are required for regular operation of the unit and shipped w ith the unit at the point of sale, such as internal memory, built-in LCD, intern al components/switches, built-in buttons, drawers, lids or panels, remote contro ls, synchronization devices or cables. This limited warranty does not cover exte rnally-attached peripheral devices, such as handhelds/PDA s, printers, digital cam eras, monitors, plasma or LCD televisions, projectors, components, cases, televi sion or monitor wall mounts, or wiring classified as accessories or consumables and not built in or on the base unit, such as batteries, light bulbs, disposable/rep laceable print/ink cartridges, print or photo paper, memory disks, disposable me mory devices, wire connections, carrying cases, stylus pens, docking stations, e xternal modems, external speakers, game devices, game disks, secondary monitors, external mouse or other input/output devices, any other components not internal to the Notebook, or other parts/components requiring regular user maintenance. This limited warranty does not cover any software shipped with peripherals. 1. Scope of Services: A. Repair and Replacement Service. During the term of this limited warranty and subject to the limitations in this limited warranty, we will repair or replace the Notebook as necessary to correct any damage to the Notebook which occurs during the usual and customary usage of the Notebook if: An electrical surge damages the Computer Device s internal circuitry, or Fire dama ges your computer in a way that affects its functioning or You accidentally drop the Notebook (in the case of Notebook) or the Notebook is otherwise accidentally damaged from handling including damage to: The keyboard if you spill liquid, or, The LCD/monitor cracks or shatters in extreme temperatures. If we repair your Notebook, you understand and agree that we may replace origina l parts with new or used parts from the original manufacturer, or a different on e. Replacement parts will be functionally equivalent to the original parts. In o ur discretion, we may designate an affiliated company or contract with a third p arty to complete repairs on the Notebook. If we decide that it is necessary to r eplace the Notebook rather than repair it, you will receive a Notebook equivalen t to or better than the Notebook you originally purchased from us, as determined by us in our sole and reasonable discretion. B. Limits of Support Services. This does not cover and we are not obligated to repair or replace: Any Notebook purchased outside of the United States (the fifty (50) states and t he District of Columbia ) or Canada. Any damage to or defect in the Notebook that is cosmetic only or otherwise does not affect Notebook functionality. Under this limited warranty, we are not oblig

ated to repair reasonable wear and tear on the Notebook and other superficial it ems, such as scratches and dents that do not materially impair your use of the N otebook. Any Notebook that anyone other than ASUS or a person we designate has tried to r epair. Any repair or attempted repair on the Notebook covered by this limited wa rranty by any party other than us or someone we designate will void and cancel t his limited warranty. We will not reimburse you for any repairs that you or anot her person make or attempt to make to the Notebook. Any Notebook that suffers damage in connection with or as a result of incorrect or inadequate Customer Installation. Customer Installation shall include any of th e following performed by the Customer or any third party on behalf of the custom er: (1) unpacking or moving the Notebook (2) installation or mounting of a Noteb ook to a wall or other structure (or removal of the same following installation) and (3) affixing of brackets or other weight bearing devices designed for mount ing or attachment to a wall or other structure (or removal of the same). Custome r Installation does not include third party installation services purchased from ASUS. Any Notebook that is lost or stolen. To receive repair or replacement of a Noteb ook, you must return the damaged Notebook to us in its entirety. If we find evidence of intentional damage by any cause, we are not obligated to repair or replace the Notebook. Any recovery or transfer of data stored on the Notebook. You are solely responsi ble for all data stored on the Notebook. We do not provide you any data recovery services under this limited warranty. There is no warranty given by ASUS for an y computer programs on disks that may be packaged with the Notebook and/or insta lled at the factory (the bundled software ). However, if hard drive replacement is necessary, we will reload, at no charge to you, the then-current version of majo r application and operating system software you originally purchased from us, in cluding any factory installed bundled software applications, but not custom-inst alled software applications. This limited warranty does not obligate us to ensur e that any installed bundled software applications or any custom software applic ations will be compatible with the replacement Notebook. There is no warranty th at any of the bundled software is interoperable with the Notebook. However ASUS does represent that it has used commercially reasonable methods to determine tha t the bundled software is interoperable with the Notebook. Preventive maintenance. It is not necessary that you perform any preventive main tenance on the Notebook to obtain repair or replacement of a Notebook covered by this limited warranty. Except as specifically provided herein, any other damages that do not arise from defects in materials or workmanship or ordinary and customary usage of Notebook . Any damages arising from acts of God. C. Limitation of Liability. NEITHER ASUS COMPUTER INTERNATIONAL NOR ITS AFFILIATES, PARTNERS, OFFICERS, DIRE CTORS, EMPLOYEES OR AGENTS ARE LIABLE TO YOU, OR ANY SUBSEQUENT OWNER OR OTHER U SER OF THE NOTEBOOK, FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LIABILITY OR DAMAGES FOR THE NOTEBOOK NOT BEING AVAILABLE FOR U SE, LOSS OR CORRUPTION OF DATA OR SOFTWARE, PERSONAL INJURY, DEATH, OTHER INDIRE CT LOSS DUE TO NOTEBOOK FAILURE, OR ANY AND ALL INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMAN CE OF THE NOTEBOOK, EVEN IF YOU HAVE ADVISED US OF THE POSSIBILITY OF SUCH DAMAG ES. BY REQUESTING SERVICE UNDER THIS LIMITED WARRANTY, YOU EXPRESSLY WAIVE ANY C LAIMS DESCRIBED IN THIS PARAGRAPH. YOU AGREE AND UNDERSTAND THAT WE WILL NOT BE RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AGGREGATE DOLLAR AMOUNT PAID BY YOU FOR THE PURCHASE OF THE NOTEBOOK COVERED BY THIS LIMITED WARRANTY. SOME STAT ES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAG ES, SO SOME OR ALL OF THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

2. Your Responsibilities: To receive service under this limited warranty, you are responsible for complyin g with the following: 1). Cooperate with Technician. You must cooperate with the technician to ensure that the Notebook is properly serviced. At our discretion, the technician will e ither send you a replacement part for you to install on the Notebook or give you directions to ship the Notebook to our repair facility. We do not cover the cos t of shipping the notebook to our facility. Once at our repair facility, we may repair the Notebook or ship you a replacement Notebook depending on our assessme nt of the damage to the Notebook. ASUS will pay the cost of shipping the noteboo k back to you. 2). Proof of purchase. You must provide ASUS with proof of purchase (such as you r original receipt), and include the serial number of the Notebook. 3). ASUS Computer International, 800 Corporate Way, Fremont, CA 94539 , is the o nly party obligated to provide service under this limited warranty. To initiate a service request under this limited warranty, you must call our service departm ent at 1-888-678-3688. When you call, a ASUS technician will ask for the serial number located on your Notebook. Once the technician has verified your limited w arranty, he or she will ask you a series of questions to assess the extent and c ause of damage to the Notebook. 4). You may not transfer this limited warranty to subsequent owners of the Noteb ook. We will not provide services under this limited warranty to subsequent owners of the Notebook. 4).
