Dear President Soesilo Bambang Yudhoyono,

I am writing to protest in the strongest terms against the union-busting tactics of the management of Indonesias state-owned electricity company, PT. PLN (Persero), against our affiliate Serikat Pekerja PT. PLN Persero (SP PLN), whose duly elected President since 2011 is Mr Fauzi Riza (the position was previously held by Mr Ahmad Daryoko). It has come to our attention that on 4 October 2011, the management of PT.PLN instructed security personnel to enter the offices of the national secretariat of SP PLN and to forcibly eject the occupants and confiscate their equipment and documents. This blatant violation of the right to freedom of association and right to organise of SP PLN is just the latest in a series of violations. According to our information, the current management of PT.PLN has been systematically interfering in the activities of SP PLN, in violation of ILO Conventions 87 and 98, ratified by Indonesia, by: refusing to recognise the legitimacy of SP PLN, and its elected leadership, which represents some 45,000 members across Indonesia; and helping to set up a rival or yellow union within the company; concluding a collective bargaining agreement (CBA) with this yellow union, despite the fact that negotiations on the CBA between PT.PLN and SP PLN were still open and that the existing CBA should have remained in force at least until 23 November 2010; preventing members of SP PLN from paying union dues and withdrawing check-off facilities, unilaterally dismissing the union committees and generally intimidating and harassing SP PLN members, preventing them from engaging freely in union activities; dismissing the former General Secretary of SP PLN, Mr Sumadi; transferring members of SP PLN committees.

PSI works with the United Nations system and in partnership with labour, civil society and other organisations.

In addition, letters have been issued to some employees belonging to SP PLN, adversely affecting their pension allowances and right to leave, amongst other things. PSI strongly believes that this anti-union campaign is the result of SP PLNs open opposition to the privatisation of electricity, based on the belief (supported by strong evidence) that privatisation will be disastrous for the people of Indonesia, leading to poor quality of service and escalating prices for consumers. Indeed the harassment appears to have started shortly after SP PLN filed a Judicial Review of Law no. 30/2009 on Electricity. PSI respectfully requests that you to use your good offices to intervene in this matter and urge the management of PT.PLN to: immediately cease from interfering in the affairs of SP PLN; recognise the legitimacy of SP PLN under the leadership of Mr Fauzi Riza, who was duly elected by the SP PLN Congress; restore the offices and all withheld assets of SP PLN to the legitimate leadership; refrain from all acts of intimidation and harassment against the membership of SP PLN; respect the rights to freedom of expression and association of SP PLN; respect the rights to organise and bargain collectively of SP PLN.
