Tamilnadu : Power at peoples cost : Polluting its coast


PLUNDERING EAST COAST ROAD ENVIRONMENT : 2007
The need for power should not be met at the cost of plundering our environment in East Coast Road. During the visit of Union Power Minister Shusil Kumar Shinde it was announced that 2 power plants would be set up closer to East Coast Road. Immediately Dravida Peravai sent a detailed memorandum to the Union Minister for Power. Later Dr.S.Ramdass, founder of PMK protested. Thereafter the Tamil Nadu Power Minister Arcot N.Veerasamy had gone on record that Cheyyur Thermal power plant will be dropped off. In this background to awaken the Union Government to evolve a Power Policy keeping in mind of global initiatives in renewable energy quest, Dravida Peravai memorandum dated 10 th September 2007 is given below in verbatim. Our objections to the 2 proposed Mega Thermal Power Projects off East Coast Road During your recent visit you had announced that the Union Government will be sending an official team to Tamilnadu to study the possibility of setting up one more ultra mega power project, as reported in the media. Though we agree on the need to enhance our power capacity it should not be at the cost of great human sufferings uprooting people practicing traditional professions practiced beyond 2000 years. In your interview you had mentioned that Tamilnadu Power Minister Thiru.Arcot N.Veerasamy had suggested Marakanam for setting up of 4000 MW capacity ultra mega power project. The Tamilnadu Power Minister had stated that Center had already finalized Cheyyur as the site of one mega power project. We are here opposing the 2-mega power projects and our views are submitted for your perusal. An attempt was made by National Thermal Power Corporation in 1999 to set up a power plant in Cheyyur when Thiru.Rangarajan Kumaramangalam was Union Minister of Power. The Hindu, a national daily with concern for people alerted people and rulers on Sunday March 21, 1999 issue in a front page story by Thiru.Mukund Padmanabhan under the heading: Proposed Power Plant will be in a Lagoon. Th e 3000 acres to be made available to NPTC in five villages in the Cheyyur area lie in low lying area into which there is copious flow of rainwater from the surrounding uplands and a little seawater ingress. The picturesque water body which attracts a large number of birds and is u sed for fishing acts as storm water run off for an estimated 42 villages in Cheyyur area wrote Thiru Mukund Padmanabhan a senior journalist in The Hindu. Dravida Peravai heeded to the warning signals unleashed by Thiru.Mukund Padmanabhan and wrote to the Indian Prime Minister Th iru.Atal

precautionary principle in preventing pollution. The term precautionary principle was raised by the German delegation at first North Sea Conference in 1984 when faced with the problem of dealing with one of the worlds most contaminated seas. Since then the approach had be en adopted by a number of regulatory regimes including Oslo and Paris Commissions (1989), The UNEP Governing Council (1989), Nordic Council (1989), The Bergen Declaration (1990), The London Convention (1991), The Bamako Convention (1991) The Barcelona Convention (1991) and The UNEP Rio UNCED Declaration (1992). On September 8, 2007-Asia-Pacific leaders agreed and adopted a "long-term aspiration goal" to reduce greenhouse gas emissions in the region in support of the U.N global efforts, announced Australian Prime Minister John Howard. Under the Sydney Declaration on Clima te Change, Energy Security and Clean Development, the goals are to reduce energy intensity by at least 25 percent by 2030 from the 2005 level, and to increase forest cover in the region by at least 20 million hectares of all types of forests by 2020. The non-binding numerical targets indicate that APEC leaders wish to throw their political muscle behind an international push to avert the worst consequences of a warming planet. This is the first year that leaders from the 21 APEC member economies have included climate change discussions in their annual summit. While other countries follow precautionary principle in India we neither have the intention nor the political will to arrest pollution of our seas, rivers and water bodies. While Salman Khans are arrested for single killings, in Cheyyur and Marakanam all the migratory birds to these water bodies have to loose their natural habitat and the offenders will go scot-free.

LET US HAVE A LOOK AT THE PROBLEMS FACED BY OTHER COUNTRIES THAT HAVE OPTED FOR THERMAL POWER PLANTS: Quoting China Daily news [Sept 9-2007] Chinas environmental watchdog warned in Beijing that booming thermal power plants may worsen China's acid rain pollution if their sulfur dioxide emission is not well controlled. Pan Yue, vice-director of the State Environmental Protection Administration (SEPA), made the remark when reporting to the press the crackdown against the Guiyang thermal power plant in the southwestern province of Guizhou, which had put the newly built power set into use without the desulphurization equipment. "Thermal power plants discharge a large proportion of the country's total sulfur dioxide emission. If their emissions are not well controlled, the acid rain po llution will probably worsen, Pan said. Although China's power production and generation capacity reached the second place of the world by the end of 2003, they still cannot satisfy the soaring economy's appetite for energy. Reportedly China will suffer from severe power shortage this summer. There are already 24 provinces and municipalities, which set limits on industrial and civil use of electricity. Thermal power plants, accounting f or 74 percent of total power supply, spring up to fill the gap.

Exhaust gas discharged by thermal power plants, which are based on coal burning, contains abundant sulfur dioxide a chemical causing acid rain. Statistics show that China's annual sulfur dioxide emission, of which thermal power emission makes up 34.6 percent, exceeds the maximum of environmental capacity by 80 percent. The resulting acid rain costs annual loss of 110 billion Yuan (US$13.3 billion), two or three percent of the annual Gross Domestic Production. China's laws and regulations state that the desulphurization equipment must be designed, bu ilt, and put into operation simultaneously with the power sets. Unfortunately, most investors are too eager for instant profits to stick to the rule, according to Pan. SEPA updated the environmental standards for thermal power plants in March, which tightens their sulfur dioxide emission. SEPA also demands all plants install an exhaust gas monitoring system, which could be connected to SEPA's central server. To reduce the thermal power sulfur dioxide emission to 7.84 billion tons in 2020, 80 percent of thermal power plants have to set up the desulphurization equipment before 2005. Besides, SEPA will enforce economic policies including implementing an emission licensing system, add desulphurization cost to the power price and raise the sulfur dioxide emission fee. CHINA FACES A PROBLEM AND IT HAS ACTED TO CONTAIN POLLUTION DO WE IN INDIA, OR DO OUR COMMUNIST COMRADES DO NECESSARY HOMEWORK TO OPPOSE THERMAL POWER PLANTS? After all China shows the way and it is not America, hence they need not feel embarrassed to oppose thermal power plants and the pollution unleashed by such plants. In 1997 the E.U.-15 member states set themselves the task of doubling Europes renewable energy sources from 6 percent to 12 percent by 2010. A decade later, even though the contribution from renewable sources had increased in absolute terms by 55 percent, the E.U.s new Renewable Energy Roadmap admitted that not only was 12 percent unfeasible, but a figure well below 10 percent was more realistic. By January 2007, the original E.U.-15 member states (the E.U. had expanded to 27 states by then) had actually achieved a figure of only 6.4 percent from renewable sources. So when the E.U. su mmit in March 2007 upped the renewable energy sources target to 20 percent by 2020, its acknowledgment that the target would prove challenging was viewed by most energy insiders as something of a gross understatement. The Roadmap stated that Europes renewable share was growing too slowly. To speed things up, a plan was devised for the main sectors: electricity bio-fuels for transport, and heating and cooling. The Roadmap sees electricity as the key sector for producing genuine progress. It argues that if all of the 27 E.U. member states made their national quotas on renewable for 2010 in this sector, the proportion of electricity consumption from renewable would be 21 percent. But only nine E.U. member states Denmark, Germany, Finland, Hungary, Ireland, Luxembourg, Spain, Sweden, and the Netherlands are in fact on track. The reality is that unless the present trends change, the E.U. will achieve a target approaching at best 19 percent. IN INDIA: In Jharkhand about 9,000 tones of fly ash is being generated everyday from the coal based thermal power plants with present generation of about 1500 MW. Fortunately, the state is utilizing over fifty present of the fly ash through environmentally sound techniques such as abandoned mine reclamation, Cement Manufacturing, Brick manufacturing etc. Damodar valley Corporation is reclaiming Central Coalfield Limited (CCL) abandoned mine using its pond ash, Tata Power at Jhamshedpur is feeding all its fly ash to Lafarge Cement, ACC and other cement plants. Jharkhand State Pollution Control Board has taken a l ead in the utilization of fly ash in the Sate with the co-operation of Thermal Power Plants, Mining Industries, Cement Industries, Brick manufacture etc If in 1500 MW Thermal power plant 9000 tones of fly ash is generated in Jharkand as per Jharkand Pollution Control Boards statistics, In Cheyyur 4000 MW mega power plant will generate 36,000 tones of fly ash polluting the entire ECR road, about which Deepa H.Ramakrishnan of The Hindu wrote as The Road Beckons [Metro plus Sept 8 of 2007]. The Road Stinks may be her article if she travels next year in same ECR Road. The S wedish Energy System: Role Model for India Electricity production in Sweden is basically fossil-free. Approximately half of the electricity production comes from hydropower and the remainder is provided by nuclear power. Swedish scientists were among the first to discover the effects of acid rain; this was a focal point in the first UN Environmental Conference in Stockholm in 1972, twenty years before the following conference in Rio de Janeiro in 1992. Swedish industry was also among early world pioneers in demonstrating the first technological solutions for flue gas desulphurization. We live in a world which is known now as global village. If we fail to follow the footsteps of pioneers and opt for outdated un-clean technologies, it is a national shame to the genius of India. Our Planning Commission will have hundreds of committee reports arguing all good things on earth but all remain in paper and only lip service is rendered. Sweden shows the way and our planners will have all blueprints for futu re ready in their shelves but our Ministers opt for unclean technologies, may be because of other considerations

DROP CHEYYUR MARAKANAM THERMAL POWER PROJECTS


Dravida Peravai urges the Government of India to have a rethink on starting many more thermal power plants, and we oppose the proposed Cheyyur and Marakanam power projects on the following grounds. The formal classification in the land registry-adangal records declare that the 2888.06 acres meant for the project is an area comprising salt puramboke and grazing land. In reality it is a waterbody.Survey number 352 at Mudaliarkuppam [274.12 acres] and Survey number 359[ 103.32 acres] under Panaiyur villages where National Thermal Power Corpo ration plans to have the fly ash disposal plant and main site are in fact are water bodies. We are aware of how fly ash is disposed in Ennore Thermal Power Plant and how Pulicut Lake has become dead lake with pollution and waste dumping. Similar fate will befall Kaluveli Tank. Na tional Thermal Power Corporation in 1999 short listed 4 sites Kovalam near Chennai, Mahabalipuram, Cheyyur and a site beyond Cuddalore. Two days ago a private company which was planning to set up a Power Project near Cuddalore had to face the peoples anger when the District Collecto r of Cuddalore convened a consultative meeting. Police lathi charged and arrested many villagers of Thiagavalli near Cuddalore in September 2007.TamilNadu electricity Minister Arcot Veerasamy is uprooting people when their traditional dwellings in order to fill his personal overf lowing coffers, people have started to gossip about the fortunes made.Kovalam is a Beach, Mahabalipuram a tourist spot of historical antiquity.Cheyyur where NPTC took the first step, they were halted by our agitations. Now Cheyyur has become once again the target of evil eyes which want to spoil the natural beauty of our coast. Marakanam, an ancient Port known then as Eyilpattinam is the centre of salt pans providing livelihood for thousand s for centuries. Dravida Peravai does not see any valid argument for shifting the focus from tourism promotion exploiting the natures bounty of our beaches to thermal power generation and converting water bodies as dumping grounds of waste and polluting the air apart from driving sal t pan workers out of jobs. The argument advanced by Tamilnadu Electricity Minister to bring coal from Orissa by ships, Marakanam harbour will be of use, is just wishful thinking. Apart from 12 major ports which are governed by Major Port Trusts Act, none of the 138 minor or intermediary ports under the control of various governments are functioning ports. Neither they are economical, viable, profitable for public utility. All minor ports with the exception of minor ports under Gujarat Maritime Board remain monuments of wasteful expenditure. On the way to Chennai in ECR Road we can see Cyclone Shelters in depilated conditions, which are another monument of wasteful expenditure. There had been no plan on h ow to use these shelters apart from cyclone times; hence they remain without maintenance and use. To develop Marakanam as Port just to bring coal will also meet the same fate. All moneys pumped into development of minor ports by various state governments have led to criminal and wastef ul expenditure. This is because the Union Government has no national policy to reduce the traffic congestion in our surface transport. We have the longest coast in east and west of our peninsula. If only the Union Government had heeded to various memorandums/p ress statements/port trust minutes, wherein Dravida Peravai had mentioned and argued the need to create a National Seaway Authorit y and frame policies for cargo/passenger ferries interconnecting these minor ports, travel in roads would be eased in congestion. Only on the event of shifting focus from lorry and rail cargo carrying to carrying cargo by ships and only when inducing people to travel by ships with well connected chain between all minor ports of the country, then ventures like developing Marakanam Port will become profitable. Focus on utilizing our ports for peoples usage is missing but focus is on wasting money on port development. Can Government of India order a study on the investments made by various State Governments in the name of developing minor ports and the yields from such investments? If such a probe is made you can find all moneys have created assets which yield nothing draining the public exchequer. We understand that there prevails a policy wherein the power generating project need not be situated in states where power is consumed but states can set up power projects near coal mine s and the power can be routed through the national grid to reach the beneficiary state.Puducherry Government on August 15 th media release had announced ab out a coal block allotted in Orissa.We presume Puducherry Government will put up the project in Orissa as per this new policy of the Center. Our question is while Puducherry can set precedent why should not Tamilnadu follow that instead of ferrying coal from Orissa to Marakanam and setting up power projects off ECR road which was meant to promote tourism and not pollution? Dravida Peravai has reservations about Puducherry Government not selecting big industrial houses in India or going for cleaner technologies in alliance with multinationals but opting for Dr.Jagathratchagans enterprise which has no expertise in power sector as its partner in the Rs7500 crore mega power projects, and we will come out in detail soon on this. Throwing dalits and fishermen out of their traditional home s and professions in Marakanam_Cheyyur belt by mega projects which have become outmoded in western countries, is a crime against fellow human beings, the citizens of India, who are the real masters as per the lexicon of democracy. FIGHT AGAINST POOMPUHAR POWER PROJECT :2009

Subject: Historical and Environmental reasons cited to oppose the proposed Thermal Power plant regarding We appreciate the District Collector of Nagapattinam for calling for this public enquiry. Our views will be in Tamils historical interest and the traditional rights of indigenous communities like fishermen and farmers of Tamilnadu. Pichavaram to Kodikarai is highly important area for unearthing our civilization since ancient harbours existed in this belt with hidden heritage at sea. It needs to be subjected to researches highly important for marine archaeology and coastal archaeology. Already 250 km out of 1076 km of Tamilnadu coast is without fishermen. The need for preserving the catamaran people and their traditional knowledge is important. Hence all development projects must aim at protecting indigenous communities like fishermen and farme rs and should not uproot them from where for centuries they made a livelihood. In fact more assistance to these communities with new scientific equipments would enable them to earn more foreign exchange to our countrys coffers than offering soaps at the cost of public exchequer to pro jects of plunder. Generating alternative renewable energy like ocean thermal energy, ocean tidal energy will be more helpful. Developed countri es have bid adieu to thermal power. Coal bearing ships and conveyer arrangement will be hazard for the coastal area and will stimulate global warming through carbon discharge. The waste generated from plant will create pollution at sea .Thoothukudi lost its pearl culture of the past cultural heritage by the non ocean oriented people. Bearing these in mind we urge the Government of Tamilnadu to stall all thermal power projects coming up in Nagapattinam District, more particularly the one near Poompuhar. We all are aware that apart from the Indus Valley excavations, equally important cities of our ancient civilization could not so far be unearthed in South India due to our own lethargy. We have stone inscriptions, copper plates and burial pots and this is not sufficient to establish the greatness of our past. Our literary evidences on submergence of ancient Tamil land illuminate us about our past but western scholars look for more scientific proof. Hence there is a need for undersea-archaeological search to find out our roots. No other ethnic group of Earth possesses so much literary evidences but remains lazy to go to the submerged cities of their ancient land. Though we have a place named as Poompuhar where Dr.Kalaignar M.Karunanithi during his rule erected monuments to recapture the past, it could only serve as tourist spot and could not satiate a researchers quest to unravel a hidden city of our ancient civilization beneath the bowels of our sea in Bay of Bengal. We all know about the changes that continuously occur and the ancient Port City of Chozha Empire is not the Poompuhar of our times, but it is within the sea nearer o r far to current Poompuhars coast. Graham Hancock wrote many books out of which Underworld: The Mysterious Origins of Civilization by Crown Publishers, New York 2002 containing 760 pages ISBN 1400046122 hardback priced $ 27.50 is of relevance to our Poompuhar. He undertook marine archaeology in 2002 and brought out as reported in Dinamani that a city with 9500 year old civilization remains hidden off coast of Poompuhar. [Dinamani news clipping enclosed] His earlier books Fingerprints of the Gods and Heavens Mirror had mentioned about his findings. But in this latest book, he lays out evidence based on modern scientific research, comparative mythology, religious and spiritual observances, first hand diving exploration of underwater megalithic structures and ancient maps to demonstrate the likelihood that a technically advanced civilization unrecognized by modern science capable of navigating the globe and with a profound understanding of architecture and building existed

and was washed out by global flooding.

Inundation maps created by Dr.Glen Milne of Durham University shows vast tracts of mostly coastal land which were submerged by three waves of cataclysmic flooding between 17,000 and 8000 years ago. Nearly 5 percent of Earths surface or 25 million square kilometers of land stands submerged. These maps and other sources made Graham Hancock to set his foot in Tamilnadu. Graham Hancock used scuba diving and found many artifacts and evidences roughly 2000 pieces which he displayed in Bangalore exhibition, as per media reports of th e day. Graham Hancock had updated Tamil history to 9500 years old. We like parrots were repeating 2000 years as time limit of our ancient civilization, and when Graham Hancock updated Tamil h istory with fresh facts, the Government of Tamilnadu which is going to celebrate World Tamil Conference, must take pains to employ more scuba divers and marine archaeologists to find out about our Kaveripoompattinam. We should honour Graham Hancock in that Conference. The coast or sea near Poompuhar should not be plundered and kept free from industrialization if our ancient glory brought out powerfully by Dr.Kalaignar had to be proven scientifically. Mr. Graham Hancock investigated about our Kumari Kandam, an anti-diluvia civilization said to have existed thousands of years ago around South India. It is believed to have been a greater center of learning with magnificent academies which may have left a legacy of cartographic and astronomical knowledge which exists today in the ancient Indian texts. Interestingly the author spoke to local fishermen who described often diving to free their nets caught on underwater temples and columns, pyramidal pagodas and buildings with doorways. Coinciding to our Poompuhar, in Gulf of Cambay to city which is 7500 years old was found but media highlighted that and did not do justice to Poompuhars findings. If a scientist within few weeks with the help of National Institute of Oceanography could bring out so many artifacts, is it not the duty of Tamilnadu Chief Minister Dr.Kalaignar M.Karunanithi who instilled in our hearts the greatness of Poompuhar by his powerful pen to employ all scientists, marine archaeologists, scuba divers, and constitute a multi disciplinary State-Sponsored Task Force under Anna University and Tamil University of Thanjavur to explore our exclusive economic zone and our territorial waters in Bay of Bengal at least to begin with to pick up the thread from where Mr. Graham Hancock left in 2002. Dravida Peravai hence appeals to the District Collector of Nagapattinam in the public hearing on Public Hearing on the proposed 2x500 MW Coal Based Power Plant by M/s. PEL Power Ltd to stop this power project. Allowing such plants to be set up here with whatever technology will disrupt the scientific and historical research that is needed to unearth our past beneath Bay of Bengal off Poompuhar. We are enclosing a map which shows how much land near our coast had been submerged. This is an indication of how much more land would have been submerged for centuries running into thousands of years back. My article Save the Coast in New Indian Express is enclosed. Letting out effluents or dumping waste into rivers and seas had been going on unabated though technically they will promise to use clean technology and blinded by that promise our environmental agencies will give them clearance. First of all we should bear in mind what all technology we get is outmoded and unwanted in developed countries, hence such technologies are dumped on developing countries like India. If we are really a super power we should follow the Swedish precedent to completely abandon thermal power projects to save its environment. Here it is not only to save our environment but also to prove to the world we are an ancien t civilization, we need to keep Poompuhar coast and seas close to Poompuhar free from industrial garbage and litter.

Coal based power projects are being set up in Tamilnadu coast. There seems to be a policy which permits setting up of power plants near coal mines, so that through National Power grid equivalent quantum of power can reach the power seeking State. Under this policy a current Union Minister of State before he came to power got a Coal Block allotted in Orissa.In this project of a Tamilnadu politician Puducherry Governments PIPDIC is a partner. This joint venture plans to set up power project in Orissa to generate power and pass on to the grid so that Puducherry Government will get power without polluting the Union Territory of Puducherry. If a tiny state like Puducherry could follow this route, what compulsion prevails for Tamilnadu to bring coal all the way by ships to set up a power plant in the Nagapattinam coast that too near ancient Port city of Poompuhar? There seems to be a race to set up more and more ports without planning what products could be brought in or exported from these ports. The Former Prime Minister Atal Bihari Vajpayee when he visited Kanyakumari announced a scheme called Sagar

Mala, which means Garland of the Seas. In fact I mooted the suggestion to create a National Seaway on the lines of National Highways to introduce ship connectivity to all the 138 minor or intermediary ports to bring inland cargo that was coming by Lorries and to ferry passengers. This suggestion through Planning Commission reached then Prime Minister who wanted to make use of existing infrastructure to connect all ports in Indian coast. At that time only Gujarat particularly Gujarat Maritime Board was making good use of its minor ports. Tamilnadu which launched a Poompuhar Shipping Corporation under DMK rule lost the race by making its vessels ferry coal and did not think of diverting cargo and passengers from road use to sea lanes. Roads could be re-laid year by year but traffic congestion, loss of lives, making more and more lanes, land acquisition etc could be avoided if our existing ports could be connected under the Sagar mala scheme of Vajpayee. Instead opening new ports with no cargo to handle breeds even sand smuggli ng to Maldives which was caught red handed by you, the Honble Collector. Hence we Dravida Peravai, a splinter of DMK but with great regard for Dr.Kalaignar in view of personal friendship undiminished by parting of ways, urge Nagapattinam to accord to priori ty to unearth our ancient city of Kaveripoompattinam and keep this coast free from polluting industrialization. Interestingly the National Institute of Oceanography , Chennai had announced that its scientists in collaboration with Experimental Design Bureau of Oceanological Engineering of the Russian Academy of Sciences had developed a vehicle named ROSUB 6000 capable of exploring the ocean up to a depth of 6 kilometers and can be remotely operated. Though we have to go further deep not only off the coast of Poompuhar but also even beyond our exclusive economic zone, this vehicle could be used to gather further evidences on our submerged Port City of Poompuhar. International Seabed Authority has allocated 150,000 square kilometers of seabed in the Indian Ocean to India for exploration of cobalt, manganese, nickel and copper which are in the form of polymetalic nodules. Well Government of India will be happily exploring Indian Ocean for minerals and metals but let Government of Tamilnadu explore Indian Ocean to discover the lost continent of Kumari and the Port Cities of Chera, Chozha and Pandyas, including the ancient capitals of Thonmadurai and Kavadapuram which our literature speaks. Respected Representatives of the Government of Tamilnadu On the eve of the public hearing on the proposed1820 MW Coal Based Power Plant by M/s. Tridem Port and Power Co. Ltd., & 150 MW Coal Based Power Plant by M/s. Nagapattinam Energy Pvt. Ltd, we are submitting our views to oppose the coal based thermal power plants. We would like to bring to your notice that within Union Cabinet there is difference of opinion which came to public light after The Hindu, a daily carried out the following news: The Hindu, English daily reported on July 5 th of 2009 that Environment and Forest Minister Jairam Ramesh has written to Power Minister Sushil Kumar Shinde seeking to put an end to laying of foundation stones for projects without proper and formal clea rances and advising all state power PSUs like National Thermal Power Corporation, National Hydro Power Corporation , Sutlej Jal Vidyut Nigam and North Eastern Electric Power Corporation to show greater sensitivity to environmental concerns at the highest level. Under such situation we would urge the Nagapattinam District Administration and Tamil nadu Government to have a re-think on all coal based thermal power projects. Recent news from our neighbor China as reported in China Daily dated October 28 th of 2009 states that Chinese Environment ministry had suspended or rejected 29 applications of new construction in petrochemical, steel-making and electricity-generating industries with a total investment of 146.7 billion yuan (US$21.5 billion).Chinese government has promised that its economic stimulus plan would not compromise anti-pollution efforts and policies would not be loosened to allow more projects to pass environmental examinations. Environmental Protection Minister Zhou Shengxian said the government would abide by strict environmental standards when evaluating new projects. Unfortunately Tamilnadu is not observing strict environmental standards. It craves for power at all costs. Tamilnadu has 4 major thermal power plants producing 2970 MW of power. The Hindu, daily dated 6 th February 2009 carries a confession by the Chairman of Tamilnadu Pollution Control Board. Mr.R.Balakrishnan admits that thermal power plants in coastal areas of the state are not meeting pollution control standards. If truth could come out of Chairmans mouth, our voices in protesti ng power plants stands justified by international, national and regional yardsticks. Thermal Power Plant in Tuticurin, a joint venture between Neyveli Lignite Corporation 89% and Tamilnadu Electricity Board with 11% stake is a 4000 crore project aiming to generate 1000 MW. Bharat Heavy Electricals Limited and Tamilnadu Electricity Board have joined together to start 1600 MW power project at a cost of Rs.8700 crore in Tuticurin District. The coal from Neyveli has to be carried by congested roads to Tuticurion. It can be argued that it goes within our state from one part to other. Also by sea route coal may get transported. One can say within the source of raw material i.e. our state power project comes up. Even this could be assimilated for argument sake but not bringing 4.6 million tons of coal annually from Orissa to Ennore port in order to enable Tamilnadu Energy Company, a joint venture between National Thermal Power Corporation and Tamilnadu Electricity Board to generate 1000 MW at Vallur in Tiruvallore District of Tamilnadu. The cost is 4500 crores. There is a national policy to set up power plants near mine heads, where coal is mined. Under such policy instead of bringing coal from Orissa to Ennore, Tamilnadu could have planned to set up power plant in Orissa and pass on power to national grid and then draw equal quantum here through national grid. By this way Tamilnadu could have had power as well as avoided unnecessary construction of new harbors and unnecessary pollution of our soil. Mind boggling statistics reveals that Ashok Leyland Project, First Corp Petrochem project, UTL Utility Systems project, Essar Power, GMR Power, Trichy Power Project and Coal and Oil Company of Dubais project which have planned to produce 1000 MW power each could be avoided if the policy to set power projects at mine head is observed. After all even if power projects are set up same Orissa and Bihar labour have to be brought to work here, since all industries of Tamilnadu and Puducherry uniformly follow a policy to engage only Orissa and Bihar labour and never to disturb local labour from watching free television and eating Rs 1 per kg rice given by noble leader Dr.Kalaignar. Empee Power and Infrastructure Ltd aim generation of 1200 MW. A company from Spain aims 2000 MW. Then comes the 4000 MW power project by National Thermal Power Corporation near Thirukuvalai, Chief Minister Dr.Kalaignars birth place. Central University coming in his home district is welcome but not polluting industries. The rice bowl of Tamilnadu should have agro-based industries and should promote agriculture and fisheries, the traditional people pursuing these professions for centuries or millennium. Similarly 2000 MW power project near Cheyyur also will erase the ecology of Kaluveli tank; a place of haven for migratory birds, and the tourism potential of ECR road will have to be wiped out to dump fly ash everywhere, congesting roads with coal transport. We urge the Tamilnadu Government to re-think its energy policy. The Memorandum of Understanding signed with Tri-Sakthi Energy P Ltd for 525 MW of power. India Power project, SPIC Energy Private Limited, Chennai Power Company etc for 1000 MW each and Cuddalore Thermal Power Project to generate 1320 MW too are coal based. Reliance plans 3000 MW power project. All these proje cts are coal based environmental hazards. Dravida Peravai lauds only 2 initiatives of Tamil Nadu Power Minister. The Memorandum of Understanding signed with an American firm for generating sea solar power is welcome. The Project that comes in Udangudi of Tuticurin District to generate 100 MW of Solar Thermal Power is welcome. produces 42 percent and this is a good development. We whole heartedly welcome these solar, wind, and ocean thermal power projects. But we oppose the Coal based Thermal Power projects that are coming up in Nagapattinam Districts, for which this public enquiry is called for. National Thermal Power Corporation of India is pumping 500 million US dollars in a joint venture with Ceylon Electricity Board to set up a power project at Sampur in Srilanka. India that could not ensure safety sail for Indian fishermen in Bay of Bengal more particularly in Gulf of Mannar and Pak Straits is going to ferry coal to Srilanka from Orissa. From Anuradhapura in Srilanka to Thalaimannar of Tamilnadu both India and Srilanka had planned under sea link to transmit power at a cost of Rs 2200 crore. In dia that for 30 years had not linked its rivers to help Indian farmers, but now wants to link Srilanka and Tamilnadu by under sea link to bring power to boost the growth of all polluting industries in Tamil soil. If India had annexed Tamil areas of Srilanka and merged North and East Districts of Srilanka with Tamilnadu and created a Tamilnadu State within Indian Union on both sides of Pak Straits, then such link between Tamil states may be welcomed but not the current project. Dravida Peravai mooted an idea when the undersigned was Trustee in Tuticurin Port Trust, and took up with Planning Commission and through then Defence Minister Comrade George Fernandes apprised then Indian Prime Minister Atal Bihari Vajpayee on the need to create a National Seaway Authority like National Highways. Every state government has minor and intermediary ports under its control but they are idle monuments with no revenue generation with the exception of Gujarats minor ports. Hence to interlink these 138 minor and intermediary ports for passenger and cargo traffic, creation of such authority is must, we suggested. Accepting that during his visit to Kanyakumari, then Prime Minister announced Sagar Mala scheme for this purpose, which is yet to take off. We now also urge Indian Government and Tamilnadu Government to go for reviving that idea, to use existing harbors for passenger and cargo traffic, thereby creating jobs for educated fishermen coming out of maritime university. It will ease traffic congestion i n roads. Unfortunately the regular hidden incomes through frequent laying of roads will be the only loss to the officials and political bosses. Instead of using Sagar mala scheme to purposefully use existing harbours there seems to be a craze to allow harbours under private only to ferry coal to coal based power plants. This ridiculous policy causes the new creation of Ports in Nagapattinam District which we oppose. Tamilnadu must give clearance to biomass power plants. Times of India dated 29 th October 2009 states that 9 companies have approached Tamilnadu Energy Development Agency for permissions to start biomass power plants. Tamilnadu Electricity Board must give clearance for these 9 companies to generate 487 MW of power. The speed with which clearances came for coal based power projects is lacking here, that too for small quantum of power, which can be termed as tokenism too TN Government lacks political will. The biomass energy produced currently is 111 MW writes Vivek Narayanan in Times of India. Hence according clearances for clea n energy is must in days when we sing lullabies on climate change. If India has to reduce its carbon emissions; it would mean a major reorientation of her energy strategy, especially if that warranted a shift from its current coal-based to an oil and gas based energy system. Murthy, Panda and Parikh (2000) examined the consequences of alternative CO2 emission reduction strategies on economic development and, in particular, the implications for the poor by empirically implementing an economy-wide model across India over a 35-year time horizon. A multi-sectoral, inter-temporal model is used for this purpose. The model has specific technological alternatives and endogenous income distribution with dynamic behavior; it covers the whole economy in an integrated top-down-bottom-up model. Such alternative thinking must dawn on Tamilnadu Government. International Seabed Authority under the auspices of United Nations has earmarked 1,50,000 square kilometers of sea bed in Indian Ocean for mining of cobalt, nickel , copper etc. We are not aware whether any such area is earmarked in Bay of Bengal. If the pursuit to mine sea-bed begins apart from natural gas to minerals, the traditional living sources of fishermen will be totally robbed from them. Even after Exclusive Economic Zones have been earmarked under International Law of Seas by United Nations, the fishermen of India particularly Tamil fishermen could not tap the fish wealth in their countries exclusive zones. Foreign fishing vessels creep in, sneak in, and poach in our zones, and fishermen with catamarans cannot compete. Fish wealth is near their eyes yet thei r country allows sharks from other nations to rob that instead of arming Indian fishermen with finances and schemes to make a better li velihood. The policy to uproot people from their traditional professions is suicidal, cynical, unethical and anti-national. Yet hand in glove with corporate world that greases their palms for petty gains and better lives today, our political masters are ruining traditional fishermen and agriculturalists depriving them a decent livelihood, thus earning a historical curse on them for their historical blunder. In precious stone rich Jharkand and Orissa, mining of this wealth which remained in the bowels of earth over which indigenous tribal peoples lived for millions of years is bartered to corporate world. Dravida Peravai had incorporated in its party manifesto that if a dam is constructed or project is set up uprooting people, such uprooted people and all villagers over which these projects come up must be made share holders in the projects that come up. Share the profits with the displaced people, compensate permanently elevating the lives of the deprived than throwing paltry pittance to political class, companies must be told. This includes the harbour and power project that comes up in Nagapattinam District. If a power project comes in Chief Ministers home village, all its villagers must be made share holders in that projects, all the jobs must be given to every educated youth forbidding total hiring of outsiders, and if talent is needed it should be only from Tamilnadu. No contracts labour system, because Chief Ministers home village must emulate a national model for development. Let Tamilnadu plan projects that will not aggravate our climate change. Let Tamilnadu go for clean technologies to generate power like Sweden. If our Chief Minister cannot make Tamilnadu a Sweden in energy, a cleaner Singapore in environment, then no one else in India can envisage and transform peoples lives. With Regards Yours fraternally

All India Policy and its repercussions on Coastal peoples:


Let me humbly quote President Barrack Obama reported in The Hindu dated May 10 th of 2010 titled a fight for the soul of American democracy. Yes in India people are fighting for peoples democracy against the corporate democracy. President Obama further states : Every time a major issue arises, we have come to expect that an army of lobbyists will descend on Capitol Hill in the hopes of tilting the laws in their favour, the voices of ordinary Americans were being drowned out by the clamour of privileged few in Washington The lobbyists are powerful in Indias national capital too and they decide which portfolio should go to whom, not political parties or leaders as recently exposed tapes tapped by Income Tax department proves. Once famous English daily of North India in its center page article wrote that Mr.Manmohan Singh began his term as Prime Minister of India but ended as Prime Minister of Delhi. It meant that our PM is accommodating all retired bureaucrats in some committee or other and keeps them in humour; thereby instead of serving the people he pleases bureaucrats who can serve corporate interests. Once talking to a Member of Planning Commission Dr.S.B.Gupta at Yojana Bhavan during NDA rule, I suggested many schemes, and he instantly showed committee reports on each subject I raised. Then I asked him, why you have reports ready from bio-diesel to Himalayan preservation of bio-diversity, but why no plan is moving in the ground. He sighed and told me You go around this floor and ask where the sons, daughters, son-in-laws of those who work in Planning Commission are working and you will either get the reply that they are in World Bank or IMF or USA. This factor decides our plans, he lamented. So we plan according to World Bank dictates not out of national compulsions but because Indians there are lobbyi sts for its policies in homeland. So every plan we proudly and fishing hamlets. The Ultra Mega Power Project, though for power generation, is to encourage corporate plunder. Hence Dravida Peravai, a splinter of DMK since 1994 and a registered political party since 26.10.1996, is opposing t he Ultra Mega Power Project of Cheyyur. We proclaim that all projects to be evaluated by the yardstick whether it benefits peoples or corporates, and we in India drove away East India Company and British not to invite neo-colonialism, but to build a self sustainable India. Unfortunately plans drafted at the National capital forget India lives in its villages

Public Sector must generate power and not act as brokers to Private Sector ; Government of India has envisaged
capacity addition of 100,000 MW by 2012 to meet its mission of power to all. It needs huge capacity addition during 10th & 11th plan, which is not feasible from the ongoing and proposed new projects already identified.As such there is need to develop large ca pacity projects at the national level to meet the requirements of a number of states under the competitive bidding guidelines dispensation. This will give a thrust to development of projects through competitive bidding Ultra Mega Power Projects are steps in that direction. The projects will substantially reduce power shortage in future. Recognizing the fact that economies of scale leading to cheaper power can be secured through development of large size power projects using latest super critical technologies. Ministry of Power, CEA and Power Finance Corporation are working in tandem for development of five projects under tariff based competitive bidding route. The Ultra Mega Power Projects with each having a capacity of minimum 4,000 MW, would have scope for expansion in future as well. The size of these projects being large, they will meet the power needs of a number of states through transmission of power on regional and
national grids. In the last six months several rounds of discussions were held with states who have agreed to support Ultra Mega Power Projects.

Experience of this initiative would facilitate development of state specific projects in the range of 1000-2000 MW through competition on similar lines. In order to enhance investor confidence, reduce risk perception and gets a good response to competitive biddin g, it was deemed necessary to provide the site, fuel linkage in captive mining blocks, water and obtain environment and forests clearance, substantial progress on land acquisition leading to possession of land, through a Shell Company. In addition, Shell companies would also be responsible for tying up necessary inputs from the likely buyers of power. In addition shell companies would also facilitate tying up of power off takes from these projects with appropriate terms and conditions and Payment Security Mechanism. Power Finance Corporation has initiated the process of registration of five shell companies with the Registrar. PFC has also set up a core group having Chief executives from NTPC and members from PFC and CEA for monitoring and expediting the process. The role of the Shell companies is to facilitate following activities:
Preparation of project report Land acquisition Allocation of fuel linkages/coal blocks. Allocation of water by the state Govt. Appointment of consultants for EIA & Project Report Appointment of consultants for International Competitive Bidding (ICB) document preparation & evaluation. Various approvals and statutory clearances. Off-take/sale of power section 63 of EA2003 provision. Power Evacuation/ (Transmission) System. Rating of Projects (suggested by FIs in the meeting on 06.01.06)

Dravida Peravai condemns this policy. Government of India must build a Public Sector Enterprise for Power and it should not act as facilitator/broker or agent of Private Sector. We oppose Cheyyur power project because it is in pursuance of this national policy, such project is to be set up in Cheyyur.

Coastal Pollution:
The question of coastal pollution deserves serious attention. In the book The Present Status of Coastal Pollution in India and Future Strategies written by D.Sathyanarayana and R.Sengupta and published in 1996 the coastal pollution question is analyzed. Apart from domes tic sewage and industrial effluents, offshore oil exploitation in the coastal shelf increases coastal pollution to high magnitudes, the authors wrote. Have our Tamilnadu, a progressive state as per our proclamations and perceptions, done homework on disposing municipal wastes and generate power? Domestic sewage though claimed to have been treated is actually pumped into the sea causing harm to our marine life and indirectly human lives that thrive on fish consumption. National Institute of Oceanography in Goa in its report of March 2008 states that domestic waste, industrial effluents, agricultural run off, shipping activities, off shore exploration and exploitation, infrastructural development have caused marine pollution. Though there will be rules it will be floated, though there are guidelines it had always been violated by industries set up near the coastline. Tall promises in paper that effluents will be treated will remain as eyewash to judiciary but actually bureaucracy turns blind eyes to direct disposal of effluents into the seas or underground aquifers.

Hotspots had been identified, as Veeraval, Tapi, Gangavaram, Thane creek, Mandovi, Mangalore, Kochi, Veli, Tuticurin, Cuddalore, Port Blair, Kakinada Bay, Visakapattinam, Byde Bhimavaram, Puri, Paradip, Mahanadi, Haldia Port, Hoogly estuary, Sandheads, Ennore, Pondicherry. By allowing Cheyyur Power Project and Paramankeni Port, Kanchipuram District is going to get prestigious place among the hotspots, and the tourist spot will turn into a hell for those who live there from time immemorial. It would be a caution to compare with Cuddalore and Port Blair, which both had been declared as hotspots for coastal pollution. The Industrial effluents untreated let off into the seas had turned these two places into hotspots. So such eventuality awaits Cheyyur and Paramankeni.

Captive Port:
The Hindu dated 11th July of 2009 reports about Tamilnadu Minister Vellakoil Swaminathans speech in Tamilnadu assembly, wherein he states that Tamilnadu had sanctioned three captive ports and one jetty at a cost of Rs 3350 crore. Paramankeni in Kanchipuram District will be developed into a captive port for Cheyyur Power project which aims to generate 4000 MW of power. Udangudi Port will be at a cost of Rs.350 crores for the power project which will generate 1600 MW of power. Parangipettai Port will be at the cost of Rs 1000 crore for the Power Project that will generate 4000 MW. Near Poompuhar a jetty at the cost of 500 crores will be set up to cater the power plant that aims to generate 1320 MW. In addition efforts are on to demarcate area near Mugaiyur in Kanchipuram District for setting up a ship repair yard at the cost of Rs 750 crore the Minister had said. We cannot understand the rationale behind captive power ports. At the dawn of this millennium when I was a Trustee in Tuticurin Port Trust, I had mooted the idea of creation of National Seaway Authority to interlink 138 minor or intermediary ports under different state governments and to utilize them for coastal shipping of cargoes and passengers. Since almost all minor and intermediary ports remained idle asse ts without income generation and further I felt the need to divert sufficient cargoes from road transport to coastal shipping, I mooted the idea to use our coastline for activities which wont harm people. Then Prime Minister of India, Atal Bihari Vajpayee to whom these suggestions reached applied his mind and during his visit to Kanyakumari announced the SAGAR MALA scheme to interlink idle ports. When we have so many idle minor and intermediary ports, the futile exercise to go on adding captive ports to cater to each project is laughable. These ports will import coal, I agree, but what they will export? Are they going to export power in containers? Hence Dravida Peravai not only opposes the Cheyyur Power Project but also its interlinked Paramankeni Captive Port.

Indonesia with volcanoes: Indonesia is the zone known as Ring of Fire in the Pacific Ocean. Yes near its vicinity beneath the seas lot
of volcanoes are roaring and waiting for an opportunity to erupt. The Wikipedia, free encyclopedia lists out the volcanoes in Indonesia. By mining more and more there we are going to invite trouble in near future. The visionless greed of Western nations to conduct nuclear tests beneath the ocean closer to uninhabited islands of Australia and Indonesia in last century developed into a tsunami aggravating existing vulnerable earth quake prone zones. The geo-fracture that starts in that region crosses the Myanmar and reaches the Himalayas. Hence the Sumatra Tsunami reached India; the earthquakes in that region reach Myanmar, Himalayas and our Andaman Nicobar region. Mining coal in Indonesia will add to the gravity of this existing danger. The land inundation maps by Dr.Glen Milme of Durham University had shown three tsunamis in between 17,000 years to 8000 years where 5 percent of Earths land surface that is 25 million square kilometers of land had been swallowed by the surging seas. This you may brush aside as past and has no relevance to current times. Let me quote Phil R.Cummins from his article The potential for g iant tsunamigenic earth quakes in North Bay of Bengal. The great Sumatra-Andaman Earthquake and Indian Ocean Tsunami of 2004 came as a surprise. Risk of another giant Earth quake is high off Central Sumatra just east of 2004 earthquake there seems to be little concern about the subduction zone of the North, in the Northern Bay of Bengal along the coast of Mynamar. Another Tsunami will not affect fishermen who bore the brunt of 2004 tsunami. Since Tamilnadu in systematic manner removing f ishermen from

warning systems in place. Further let me enclose the ocean floor picture of sea off Pondicherry coast, where there was an e arthquake beneath the

coast for its ports, power projects and industries, the next tsunami will hit all these projects. This danger has not been taken into account nor

future danger zone near Pondicherry. Further the Director of Earth Sciences of Bharathidasan University Dr.S.M.Ramasamy using pictures taken by remote sensing had warned about a geo-fracture that starts near Kalapet in Puducherry and extends to Cumbum valley in Tamilnadu. His article is enclosed. These geo-fracture zones carry earth quake tremors from one place to other like water flows where there is way. So Cheyyur Power Project is closer to these danger zones which also imports coal from a danger zone known as Ring of Fire.

India must not uproot people in the name of development:

India so far had been uprooting tribals from forests in the name

of mining and now the process to uproot fishermen from their traditional homes and profession is on fast track. If only Government of India had created a separate Ministry for Fisheries and provided cold storage facilities in all fishing villages apart from imparting new skills to fishermen and giving them modern vessels and machinery to engage in fishing, the foreign exchange that could have accrued by way of fishing would exceed hundred times the revenue the companies promise to offer the National Exchequer. In addition to existing danger, globalization is bringing new dangers to the door of fishermen. International Sea Bed Authority is an autonomous international organization under 1982 UN Convention of the Law of Seas and 1994 Agreement relating to the implementation of Part XI. 159 countries so far had ratified this. 16 th session of the International Sea Bed Authority took place only recently between 27 th April -7th May of 2010. This International Sea Bed Authority had earmarked 1,50,000 square kilometers in Indian Ocean and Bay of Bengal/Arabic Ocean for India to mine in sea bed for cobalt, manganese, nickel and copper. So in order to keep the seas for mining India had started to uproot coastal fisherman in a systematic manner. By delivering lethal blows on the traditional profession and by uprooting indigenous fishermen from coast, India is going to sell not only land but sea too to corporate se ctor and multinationals. So corporate democracy warned by President Obama is knocking our doors asking us to quit our homes and perish as nomads. Such scenario is enacted in Cheyyur and hence Dravida Peravai is opposing the Ultra Mega Power Project and the Captive Port and the very idea of importing coal from quake prone Indonesia. CHANGING TAMILNADU COAST

Tamils lack sense of history. This inherent ingredient of the Tamil people is responsible for lack of recorded history at the time when every country woke up to construct its history on facts. We have to mainly depend on the literary evidences to write our history. The epic Silapathigaram gave us an insight into the landmass that is lost in the Indian Ocean. Now we have other sources to confirm our literary references. With the knowledge explosion, thanks to the internet revolution, we get lot of information. To understand the past history of the Tamils inclusive of Pondicherry and to foresee its future we have to know about continental drifts and the theory of plate tectonics. "The theory of continental drift that the continents move relative to one another was proposed by Alfred Wegener in 1910. It was not until 1945 that Arthur Holmes suggested a mechanism for the process-convection in the mantle. Complete evidences to convince more scientists those plate tectonics the movement of larger segments of the outermost shell of the earth as a mosaic of large rigid plates was not accomplished until the 1960's...." The Department of Geological Sciences of the Canadian University of Saskatchewan in its web pages states that Plate Tectonics is the unifying theory that explains almost all the processes at work on the planet. To understand the evolution of our planet and to have a coherent idea on earthquakes, volcanoes, mountain belts, ocean basins and the topography of the sea floor, scholars are relying on the theory of plate tectonics. Alfred Wagener known as the Father of Continental drift in his publication of 1912 said that " Looking at a global map it would appear that the continents could be brought together to fit like a jig saw puzzle" Mankind is one and this stands proven once again by the geological fact that continents were together at one time and drifted apart. Now everyone accepts that as solid upper Earth floats on astheno-sphere, the litho-sphere drifts". The Earths crust since its formative years dating back to 4.6 million years is in constant motion. "Broken into a patchwork o f plates and floating on currents in the fluid visco-plastic upper mantle beneath, the plates continuously collide and pull apart. The continental crust is significantly less dense than either oceanic crust or the upper mantle rocks. The formation of Himalayan Mountains is due to the fact that Indian sub continent moving northwards buckling up material whil e colluding with the Asian continent. The scientists of the Earth Observatory of Columbia University New York confirm that the IndoAustralian plate south of Equator in the Indian Ocean area has broken into two and each is moving in one direction. In the la st 50 million years Indian sub continent is drifting at 5 centimeters a year towards North. Tibetan plateau and Himalayas bear the brunt of this mounting pressure. The Altyn Tagh fault i.e. geo-fracture extends 2200 kilometers in Western China...........

TAMIL NADU: KUMARIKANDAM MEENDUM?


Researchers in the Earth and Planetary Science letters state that instead of Earth's surface being divided into 12 major plates there are now 13 plates. In the latest research by LamontDoherty scientists about 8 million years ago the accumulated mass of Indian subcontinent became so great that the Indo-Australian plate buckled and broke under stress. The result of this crucial stage in the collision between India and Australia is the break up of Indo-Australian plate into separate Indian and Australian plates. In The Central Indian Ocean Nature is conducting a large scale experiment for us showing what happens to the oceanic lithosphere (earths outer layer) when force is applied. Using drilled samples in 1970 scientists discovered that a broad zone of the Indian Ocean floor stretching more than 960 kilometers from east to west along with the equator was compressed and deformed. They later found that the newly created seafloor had spread outward from the mid ocean ridges in the zone and theorized that the movement of seafloor could only be fitted in only if a distinct boundary existed between Indi an and Australian plates... [On this in Dinamani Tamil daily 26.01.1996 Nandhivarman had written as "Meendum Thonruma Kumari kandam?"] The changes that could happen have been a matter of speculation. Highlighting the gravity of the situation in THE OTHERSIDE October 1997 edited by George Fernandez, Nandhivarman wrote with specific thrust on Pondicherry as follows: WILL PONDICHERRIANS BECOME ECOLOGICAL REFUGEES? Pondicherry, a word born out of the Frenchman's tongue is a variation of the Tamil word 'Puthucheri' which means new settlement. Now at the fag end of this century we Pondicherrians have to engage in the quest for new settlements. The danger of becoming ecological refugees looms large. This is neither soothsaying nor a prophecy of doom. A forewarning to plan our resource use in a proper manner to avert this eventuality. A Report on Ground Water survey and exploration in the Union territory of Pondicherry and its environs prepared by a team of experts of Central Ground Water Board (Southern Region-page 13) contains the following observations: "The general strike of the cretaceous-Paleocene formations trends NE-SW with gentle dips ranging 2 to 5 towards Southeast. The Cuddalore sandstone formation though maintains the same strike, shows a dip up to 10. The cretaceous and Paleocene beds form an inliers having been exposed due to the denudation of the overlying Cuddalore formation which overlap them completely. A low angle fault trending in NNE-SSW direction is inferred from Mudrapalayam. This fault passes just west of the bore holes drilled by Oil and Natural Gas Commiss ion at Mudrapalayam and Muratandichavadi which when extended passes close to Rayapudukuppam where the rocks show high and irregular dips. Probably this fault takes a swerve towards North East beyond Rayapudukuppam and runs along the out crop contact between the Manaveli and Kadaperi kuppam formations met with in the Oil and Natural Gas Commission bore hole at Murattandichavadi is marked by breocinted clay stone indicating probably a fault zone. The limited thickness of Kadeperikuppam formation in the bore holes at Koluvari, Mudrapalayam and Muratanndichava di appears to be the result of the aforesaid faulting. It is presumed that this fault is met with much below at depth further north of slim hole at Alankuppam. Photo-geological study has also confirmed the existence of a fault to the west of the coast line a straight scarp running almost parallel to Pondicherry-Marakanam East Coast Road. This straight coast line is also indicative of some structural dislocation. These observations made since 1973 contain the shocking news about faults otherwise known as geo fractures. Dr.S.M.Ramasamy Director of the Center for Remote Sensing of Bharathidasan University explaining the findings on his project River Migration Tamil Nadu in the interview to The Hindu says But the East-NorthEast-West-South-West trending faults on the contrary are showing left handed (sinistral) ongoing translational movements and again the North West-South-East trending faults are showing right handed (extral) translation movement. Such sinisterly and dextrally moving faults display definite morph tectonic anomalies in the remotely sensed data and also in the field. In addition there is a conspicuous land subsidence between Pondicherry

in the North-East and Cumbum valley in the South-West.

The same scholar in an article in the Journal of the Indian Society of Remote Sensing dated September 1993 observed: One such graben has been established along NE-SW trending faults in between Pondicherry- Cuddalore in the North East and Cumbum Valley in the South west ( Kodaikanal and Cumbum Valley).. It is significant to observe that the earthquake epicenters fall along such NE-SW trending fault in Pondicherry, Cuddalore, Ariyalur, Dindigul and Kodaikanal. The findings of the Central Ground water Board and the findings based on the photographs taken by remote sensing have confirmed the existence of faults. I.e. geofractures and the earthquake epicenters in Pondicherry. Let us seek the same scholars advice on actions to be taken. The present analysis shows that the NE trending quaternary faults and the NE-SW trending quaternary reactivated faults are seismicity prone in Tamil Nadu. Hence care must be taken in avoiding developmental activities in the form of urbanization, industrialization and also construction engineering structures. Hence it can be concluded that mainly quaternary fracture systems and our quaternary reactivated pre Cambrian faults are pollution accentuating fractures in Tamil Nadu (Pondicherry) and hence pollution discharging industries should be avoided along NS trending fault systems. Science is issuing a forewarning. Scientists have suggested steps to prevent calamities. We the citizens of Pondicherry must be concerned over these findings. Highlighting these is intended to harm none but to forewarn. Dravida Ilaignar Peravai had taken up with the Union Minister of Forests and Environment on 2.12.1995 the need to scientifically study the geofracture. Pondicherry Administration also is apprised of this through a memorandum submitted on 12-12.1995. I appeal to the environmentalists of our country in particular to generate sufficient awareness in the corridors of power forcing our Administration to set up a team of scientists to study the geo fracture, the evil effects of pollution discharging industries. the way to arrest our gro und water depletion etc. The depletion of ground water will not only result in salt water intrusion but also will aggravate the geofracture. In fact most of our coastal villages suffer from salt water intrusion. We are getting ground water in all the colors of the rainbow, due to the contamina tion of ground water by pollution discharging industries. Eachangadu a tiny coastal village with 250 families even today gets water in the color of engine oil from its bore pumps. Our party's campaign led to the closure of the polluting industry in February but even after 6 months villagers suffer without clean drinking water......... These issues were ignored. Later by 2000 when there were tremors and when in 2004 tsunami struck our coasts, some people recalled our forewarnings made from a decade ago. And now when waves lash our coasts, drawing attention to the Sea Coast erosion N.Nandhivarman wrote an article in The New Indian Express of 4.06.2005. We reproduce it here because it shows in past decade we continue to focus on Green Issues.

ACCOSTING THE SEA COAST

Nowadays seas frighten the fisher folk. For centuries fisher folk had established unassailable bond of love with seas, but in post tsunami phase every change in the sea causes nightmare. The sea recedes and people become panicky. Waves enter villages lashing out the bea ches. People run hither thither for safety. Kanyakumari to Cuddalore almost for a week people of the coast spent sleepless nights and anxious days. This scenario had wakened up the social thinkers and scientists to look for solutions to coastal erosion. Changes due to continental drift are inevitable. Here too if we look at the projections made by scientists, the future world map of 100 million years and 250 million years show ch anges in Indias position but India always remain attached to the Asian continent. This should be viewed with consolation, because in past India was an island nation separated from Asia. Our planet is a tri-axial ellipsoid, moving around the Sun in an elliptical orbit at 30 kilometers per second and rotating around its axis at 1,6 66 kilometers per hour which is faster than speed of sound. Such high speed rotation has resulted in polar areas being compressed towards the center and equatorial areas being bulged out says Professor Vishal Sharma. Apart from these changes the coast of Tamil Nadu had und ergone variations in the past but the present causes more concern. As per a study by the School of Earth Sciences of Bharathidasan University Before 1.5 million

years ago Sea extended up to Madurai. Around 90,000 years before Chennai, Pondicherry and Vedranyam were encircled by seas. S ince sea level subsided 65,000 years ago India and Ceylon got connected. When sea level rose by 27,000 years ago both parted and when it fel l by 17,000 years before joined again to part again". And amidst panic reaction to such studies, if we look at the map of coastal changes in Tamil Nadu, one could know that the coast instead of moving inwards had extended seawards. This is enough to give us fresh hope for survival braving the fury of Nature.

VARYING TAMIL NADU COAST


The sea erosion of coast is not an India specific problem. "More than 80 percent of the world shorelines are eroding at the rates varying from centimeters to meters per year." says Orrin.H.Pelkey, Professor of Geology and Director of the Program for the study of Developed Shorelines in the Duke University, North Carolina, USA. He had authored two books and one of its titles has a message to all of us. Living by the Rules of the Sea" is his book and it is high time we learn to live by the rules of the seas. A walk in the beach and breathing its salubrious breeze is world wide habit. But how many of those who visit beaches is aware on how beaches are formed? People are worried about erosion. But it is a fact that without erosion beaches could not be formed. "Without the process of erosion, we would not have beaches, dumes, barrier beaches and the highly productive bays and estuaries that owe their existence to the p resence of barrier beaches" opines Jim O'Connell, the Coastal Processes Specialist of Woods Hole Oceanographic Institution. Well erosion might have helped beach formation, but it is sending alarm bells from Kanyakumari to Chennai and beyond. Let us look for some scholarly opinion in th is regard. After a close study at the Pitchavaram forests near Chidambaram, M.S.Swaminathan Research Foundation reveals that "in between 1930 and 1970, the seashore had eroded by 550 meters. Between 1970 and 1992 the rate of erosion was about 12 meters." The writing on the wall is clear. In past Sirkazhi was a coastal town, which now is interior by kms. The Harbour of Choza Empire, Poompuhar is now beneath the seas. At present warning from Pitchavaram must awaken us. Apart from facing Nature's onslaughts with preventive measures, human errors too needs to be corrected. Sand is the food for beaches, and it is needless to say that our rivers are not supplying that food to the beaches. Human exploitation and drying of rivers depletes sand supply to beaches. Interlinking of rivers as often advised by our President A.P.J.Abdul Kalama will not only solve water crisis but will save dying beaches. Sea level rise is primarily due to the thermal expansion of the sea water and melting of the glaciers and ice caps. Artic Climate Impact assessment by 250 scientists says that global warming is heating the Artic almost twice as fast as rest of the planet United Nations sponsored Inter Governmental panel on climate change will be bringing out its fourth assessment by 2007. Changing Winds and currents in the Indian Ocean in 1990s contributed to the global warming says a NASA study in the Geophysical Research Letters. The recent lashing of waves of Tamil Nadu coast was triggered by a storm near Australia, scientists say. The National Hurricane Center of USA reports that hurricanes release heat energy at the rate of 50 trillion to 200 trillion watts. This is equivalent to 10 mega ton nuclear bomb exploding about every 20 minutes. But we in In dia are in one way lucky. Our coast will not be hit by hurricanes. Our cyclones are less intense. Storms that hit continental America have almost the full width of Atlantic Ocean to gain strength, since our cyclones emanate from Bay of Bengal there is neither room nor time for them to grow, and this natural phenomenon helps us in one way. Global warming also causes rise in sea level inundating coastal areas. We must know that most of the ice sheet rests on land that's below sea level. At a point called the "grounding line" it starts floating, thus displacing its own weight in water. And as it turns out, the line may not move much because the flow of the ice streams seems to be restrained by friction against rocks at the bottom and sides rather than the ice shelf. So if the ice shelf melts, the flow of the streams should not change appreciably. And since the volume added to the ocean depends on how much ice moves from land to water -- as determined by the grounding line -- the upshot seems to be relative stability. "The ice streams do not appear to be susceptible to the kind of unstable retreat once envisaged," says Bentley. "Their flow is largely insensitive to the presence of the ice shelf so the grounding line would remain the same." Instead of possibly collapsing in 100 years, as was considered possible 10 years ago, Bentley says the West Antarctic Ice Sheet is more likely to collapse -- if at all -- in perhaps 5,000 years at the soonest. By this scientific prediction it becomes evident that sea level rise by global warming too will not cause more harm in near future, if we are well prepared for it with preven tive measures. If governments have plans for beach nourishment with vegetation, which is the cheapest preventive measure, it will go a long way in arresting coastal erosion. Subject: The demand for separate UT status for Karaikal and our grievances due to neglect of our enclave by Government of Puducherry regarding. Disparities in national development: Policy makers, political leaders, development analysts and other concerned citizens are increasingly focusing attention on the disparities in levels of development between different sections of the population in India. Such disparities have important political, social, economic and law and order implications. Many violent, anti-constitutional movements can be traced to stark economic disparities. The different successful and continuing agitations for smaller states have both a political and cultural as well as an economic dimension. The disparities are also a matter of concern as they threaten the nation's hopes of achieving various internationally accepted Millennium Development Goals by 2015. Our peaceful movement : Karaikal Union Territory Struggle Group started in 2005 to draw the attention of the Government of India towards the economic backwardness of our region since independence namely Karaikal, an enclave of the Union Territory of Puducherry separated by 140 kilometers and surrounded by neighboring State of Tamilnadu. All development were grabbed by the main enclave of Puducherry which elects 21 legislators to the assembly, and we made a point in last elections that since our 6 legislators failed to argue for our region effectively and to bring development irrespective of party affiliations people should vote out all the 6 M.L.A.s. People heeded our call by defeating 4 Congress legislators of our enclave while DMKs 2 legislators scrapped through in double digit vote difference. This was treated like referendum and the Government of the day declared that Karaikal be made into a District and started increasing allocations in budgets. Though it was declared as District, it remains a mystery whether it has the approval of the Union Home Ministry. Our enclave had not been included in the most backward districts identified by the Government of India. On this occasion we urge the Home Ministry to clarify the ambiguity over the district status of Karaikal. We urge the Union Home Ministry to include Karaikal in the most backward district list, in order to catch up in development with the rest of the regions/enclaves. It is unfortunate that Government of Puducherry could have urged through proper channel and procedure to make the Union Government issue notification declaring Karaikal as District. Tamilnadu each year declares few districts as backward and gets Central schemes for backward districts. In spite of Tamilnadu teaching the art of good governance, the Government of Puducherry is yet to get due approval for Karaikal and if that step had been accomplished then only we can get declared as backward district to avail Centers schemes. Our struggle is to educate people, organize protests on Gandhian lines and non-violence is our motto to win our goal of separate UT status for Karaikal. Karaikal in this background we would like to state that on the basis of population, our enclave should get 33 percent of plan and non plan allocations and special component plan for the SC/STs. In short all infrastructure should reach our region wherein the 33 percent due share is given to our region. But only in education we won a concession for 18 percent regional qu ota in admissions in professional colleges. A study by reliable intelligentsia reveals that though we were told 18 percent is our quota in reality we are getting only 13 percent. Our group first brought out the step motherly treatment meted to our region in a memorandum submitted to the then Lt.Governor of Puducherry His Excellency Mukut Mithi. He alone sought details of funds allocated; jobs that went to our region and all such details to study in whatever ways our region had been neglected. We now urge Union Home Ministry to depute a high level team to find out the quantum of neglect to our region, so that Union Government will feel justified to grant us separate UT status. Our regional Quota and the Conspiracy to deprive us: On 19th June of 2006 Karaikal Union Territory Struggle Group and Karaikal Parents & Students Association fasted along with 1200 students demanding hike in regional quota for admissions in medical/engineering colleges, proportionate to the population of Karaikal enclave. Almost all media reported. Then on 25th March 2007 KUTSG, Karaikal Parents & Students Association jointly took out a rally reiterating this demand. In 2007-2008 heeding to the justifiable demand of the neglected region of Karaikal Government of Puducherry issued guidelines for the Centralized Admission Committee for reservation and special allocation for Karaikal enclaves students based on the population of our region. Thus KUTSG won the regional quota for Karaikal students. Subsequently in 2008-2009 again in Centralized Admission Committee details of reservation and special allocation for Karaikals students were reassured, with our students getting their due. On 3rd April of 2009 speaking in the assembly DMK legislator S.P.Sivakumar while demanding the scrapping of entrance examinations welcomed the regional quota granted to the students. But he does a volt face in 12 th April of 2010 and opposes regional quota is another story. On 12th April 2010 AIADMK legislator A.Anbazhagan, DMK legislators from Puducherry enclave S.P.Sivakumar and R.Siva along with PMKs Anantharaman sought scrapping of the regional quota given to Karaikal students. But the DMK legislator and Former Speaker/Minister VMC.Sivakumar told the house that what the MLAs of his party had told is their personal opinion, not party opinion, and he is for Karaikal students continue to get the regional quota. KUTSG issued statement condemning the illogical demand made by individual members to snatch the existing quota, won after great struggle. On 22nd April 2004, with due police permission KUTSG organized a Peaceful Protest in Gandhian lines to condemn the MLAs.

On 23rd April 2010 as media reports the protest, AIADMK legislator A.Anbazhagan raises the issue of MLAs speech in assembly being criticized outside Assembly and instantly Honble Speaker of Puducherry Assembly issues directions in open floor of the assembly to take appropriate steps against KUTSG that organized the protest. KUTSG reiterated that it is within its democratic right to criticize the demand for scrapping an existing quota, and this snowballed into an unnecessary controversy. All 5 legislators of Karaikal enclave irrespective of political affiliations came out in open to support the continuance of existing quota. The Opposition leader of DMK who in assembly wanted to scrap, changed his cap, and thundered t hat he will fight against scrapping of the quota. In this background since the Speakers order had raised the Peoples Freedom of Speech versus MLAs Freedom of Speech, KUTSG wrote on 30th April 2010 to the Loksabha Speaker, Vice- President, and to all the Speakers of various assemblies. Admitting the MLAs have immunity, the right of expression given to people could not be suppressed, the memorandum urged the Speakers to discuss and frame guidelines for future in the next All India Speakers Conference. THIS ONE INCIDENT SHOWS HOW INTOLERANT THE MAIN ENCLAVE IS TOWARDS KARAIKAL.50 Years KARAIKAL FACED NEGLECT. STUDENTS GOT A RELIEF in 2007 and THE POLITICIANS OF MAIN ENCLAVE COULD NOT ASSIMILATE OUR STUDENTS GETTING DUE SHARE. It is altogether another story that though we were promised 18 percent, actually only 13 percent was obtained by our students. Hence we urge the Union Home Ministry to recommend to the Union Cabinet to consider granting UT status to Karaikal. Let us look back at the historical accident that brought various enclaves with no contiguous areas into a Union Territory. A short note of Past History: Puducherry (or Pondicherry) was a part of the Pallava kingdom of Kanchipuram in the fourth century AD. During the next few centuries Pondicherry was continued to be under the control of several dynasties of the south. In the tenth century A.D. the Cholas of Thanjavur ruled the region for over 300 years but later on it was replaced by the Pandya Kingdom. Till 1638, Pondicherry came under various rulers like the Muslim rulers of the North; the Vijayanagar Empire and then the Sultan of Bijapur came to rule over Gingee. The 17th century marked the beginning of colonial era in India. The French East India Company set up its trading centre at Puduch erry in 1673. This outpost eventually became the chief French settlement in India. Dutch and British trading companies also wanted trade with India. Wars raged between these European countries and spilled over into the Indian subcontinent. The Dutch captured Pondicherry in 1693 but returned it to France by the Treaty of Ryswick in 1699. The French acquired Mahe in the 1720s, Yanam in 1731, and Karaikal in 1738. During the Anglo-French wars (1742-1763), Pondicherry changed hands frequently. On January 16, 1761, the British captured Puducherry from the French, but the Treaty of Paris (1763) returned the city to the French. It was taken again by the British in 1793 amid the Wars of the French Revolution, but once again returned to France in 1814. When the British gained control of the whole of India in the late 1850s, they allowed the French to retain their settlements in the country. Pondicherry, Mahe, Yanam, Karaikal and Chandernagar remained a part of French India until 1954. But after India gained her independence in 1947, an agreement between France and India in 1948 agreed to an election in France's Indian possessions to choose their political future. On 1st November 1954, Pondicherry was transferred to India. A treaty of Cessation (together with Karaikal, Mahe and Yanam) was signed on May 28, 1956. It became a Union Territory to be administered by the President of India in 1962 under the 14th Amendment of the Indian Constitution. GOA PRECEDENT: KARAIKAL SEEKS SAME PRINCIPLE The economic neglect of our region and total insensitivity to our problems by the leaders of the main enclave, made Karaikal Union Territory Struggle Group write to all in the Cabinet and to the most prominent and vociferous members of both houses of Parli ament, as well as all Leaders of Parties in Parliament, seeking their support for getting UT status for Karaikal, when Puducherry main enclave is elevated to statehood. Here we cited the precedent of Goa Statehood, while other enclaves of Goa obtained UT status. This pre cedent Karaikal Union Territory Struggle Group wants to be applied and Karaikal be made into separate UT. With liberal Central assistance, main enclave of Puducherry had neglected Karaikal, and if it becomes State with resource crunch hitting its coffers, it wont even care to any demands from our region. Hence we urge for separating us and making us a UT. Even after getting UT status, the prolonged economic neglect of Goa is past, still keeps Dadra & Nagar Haveli among the most backward regions of this country. Karaikal too will take at least a decade to repair the damage done and to breathe freely to march towards development. [Our memorandum to Union Council of Ministers dated comes as Annexure 1 to this memorandum. BAD GOVERNANCE LEADS TO BACKWARDNESS A comprehensive estimation of district-level deprivation made recently by Bibek Debroy of the Rajiv Gandhi Institute for Contemporary Studies, New Delhi, and Laveesh Bhandari of Indicus Analytics in District-level Deprivation in the New Millennium (Konark Publishers, New Delhi; 2003), came up with other significant findings: One often touted cause for backwardness is bad governance. All the various lists of most backward districts include notoriously ill-governed regions. However, one cannot pinpoint poor governance or lack of political will as the overriding cause of extreme backwardness. Since Karaikal was not officially declared as District, data clubbed with developed Puducherry will not reveal our backwardness. Other Initiatives: A study To end economic backwardness, Government of Orissa created Western Orissa Development Council, and reports in media suggest it failed to yield desired development. If that being the case imagining that by making Karaikal into a District all its ills will be addressed is just a mirage chase Western Orissa Development Council Ten Western Orissa districts lag behind their counterparts of coastal districts in core sectors with meager percentage till date. Looking at the degree of development/ backwardness of 10 Western Orissa districts, it can be said that out of 87 blocks only 5 blocks are developed, 25 are developing, another 25 are backward and 32 blocks are very backward, whereas in coastal districts 70 blocks are developed, 50 blocks are very backward out of total 227 blocks. WODC was formed to upgrade the levels of development with a

view to removing regional imbalances, upgrade the relative levels of development in different sectors in each Districts having regard to the levels of development for the State as a whole, prepare long-term and short-term plans and programmes for removal of developmental imbalances and formulate plans and programme accordingly. UN to assist India's backward districts


The Planning Commission and the United Nations (UN) have signed a Joint Programme on Convergence to help Indias backward districts achieve the Millennium Development Goals by better utilization. Backward Districts Initiative Rashtriya Sam Vikas Yojana The Scheme and Guidelines for Preparation of District Plans etc exist but our region cannot avail. TO AVAIL THESE SCHEMES GOVERNMENT OF PUDUCHERRY HAD PUT ROAD BLOCKS WITHOUT LEGITIMIZING KARAIKAL DISTRICT AS BACKWARD, HENCE WE DEMAND UT STATUS FOR KARAIKAL. The General Secretary of KUTSG Mr.A.S.T.Ansari Babu had obtained informations under RTI. Those are just pieces of information. It does not give comprehensive picture on our regions economic backwardness. As per his version the Non-Plan allocation for 20012002 stood at 356.65 crore. Out of which Karaikal got only 47.54 crore, whereas Mahe got 9.22 crores and Yenam got Rs 9.97 crore. In the year 2002-2003 in total of 416.10 crores, Karaikal got 67.95 crores, whereas Mahe got 14.00 crores and Yenam got 14.41 crores. For the year 2003-2004 in the allocation of Rs 468.63 crores, Karaikal got 69.04 crores, whereas Mahe got 12.86 crores and Yenam gets 16.30 crores. For the year 2004-2005 in the amount of 615 crores, Karaikal gets 83 crores, Mahe gets 15.32 crores and Yenam gets 23.98 crores. For 2005-2006 after our groups emergence in scene the total is 925 crore, Karaikal is said to have got 144.42 crore, Mahe gets 26.45 crore and Yenam bags 41.19 crore. For 2006-2007 in the total 1043.45 crore, Karaikal gets 153.60 crore, Mahe gets 30.89 crore, and Yenam gets 42.85 crore. In budget estimate for 2007-2008 the figure is 1455.00 crore and Karaikal is supposed to have got 268.54 crore but in actual it got only 177.07 crore. Mahe gets 27.72 crore, and Yenam gets 80.99 crore. So goes on statistics, as telephonically told by our sources, which will mail you all the replies under RTI in short time. These only indicate the urgency and need for the Union Home Ministry to depute a high level team to probe what we got and where it went and why an enclave faces neglect for half a century, forcing it to raise the voice for separate UT status. KARAIKAL NEGLECTED IN GOVERNMENT JOB AVENUES: As per the information collected by our team, in between 2001 -2005 when 650 posts of Secondary Grade Teachers were filled up, Karaikals share was just 16. For the posts of LDC, out of 181 vacancies, Karaikal got only 16, whereas the ONE constituency Thattanchavady of Former Chief Minister N.Rangasamy bagged 46 seats. When 54 Sub Inspectors posts were filled up Karaikal got only 2 seats. Out of 600 policemen chosen, Karaikal got only 20. Out of 182 vacancies in Electricity Board, Karaikal was given only 19. In 20th November 2005 when 46 Village Administrative Officers were selected Karaikal got only 2 posts. When 30 Deputy Tahsildars were chosen Karaikal got only 1. Out of 664, NMRs Yenam got 150 whereas Karaikal got 75 only, Mahe getting 25, rest going to Puducherry. On 13 th June 2006 when 74 daily rated persons were chosen Karaikal and Mahe got 6 each, 0 for Yenam, all other to Puducherry. In December 4th 2006 when 111 Men constables were selected Puducherry got 94, Karaikal only 5. Mahe 7 and Yenam 5. In 22nd March 2007 when 64 women police were selected Puducherry got 53, whereas Karaikal got 7 only and Mahe 4 and 0 to Yenam. 18th June 2007 in Education Department 28 Drawing Masters were chosen, Karaikal got 0, Mahe 2, Yenam 1 and Puducherry 25. When PT masters were selected Karaikal got 7, Mahe 1, Yenam 3 and Puducherry 36. In 2009 when 56 Junior Inspector of Cooperative Societies have to be chosen, Puducherry got 45, Karaikal 9 and Yenam2. These are part of the story. If Union Home Ministry seeks white paper on regional disparities shown in providing jobs, it will give clearer picture. Also what so far had been hinted is enough to justify our demand for separate UT status to Karaikal. SECURITY RISKS INVITES HOME MINISTRYs INTERVENTION. The Private Port in Karaikal and mushrooming of captive private Ports almost every 15 kilometer one in the neighboring coast of Nagapattinam where coal based power plants are coming up, necessitates more than normal vigilance. The Marine Police Station that exists in Karaikal is eyewash. We urge all the intelligence agencies converge in Karaikal and station a permanent vigil cell to contain criminalization and its extension towards terrorism patronized by self styled godfathers who are cut-out godfathers. The unresolved murders in the region where needle of suspicion points towards two VIPs from two main parties is proof that crime gets patronage to conceal its ugly face. In a coastal area, where even the boat provided to the Marine Police Station is second grade compared to the one given to Pondicherry, and without maintenance remains unusable, the speed with which local action against sneaking terrorists or smugglers who look forward towards a lucrative business through private ports and captive ports through which with no proper checking or scrutiny, anything under Sun could be brought in, will be just a day dream. Hence a team to keep constant vigil of the enclave which breeds crime in the absence of due job opportunities and development, is essential as first step. Complete overhaul of the financial allocations to our region be made and ensured that we get 33 percent in finance, jobs, educational avenues and in infrastructure in accordance with the population strength.

Subject: Report on Unlawful Terrorist activities in the Karaikal region as reported in media and the inefficiency of the incumbent Home Minister of Puduchery and Collector of Karaikal regarding... We read in papers that Honble Prime Minister is going to fine tune Union Cabinet weeding out incompetent and inefficient from the seats of power and is planning to induct new faces, or redistribute portfolios. We were aghast at the one constituency development agenda pursued by ousted Chief Minister N.Rangasamy, and we wanted to liberate Puducherry UT from that rule. But we never in our dreams thought that instead of ONE CONSTITUENCY AGENDA TWO CONSTITUENCY agenda will sneak in robbing all development that is meant for main enclaves of Puducherry and population wise second enclave of Karaikal. We were demanding Statehood for Puducherry, and following the precedent laid when Goa was elevated to Statehood other enclaves were made into UT, we sought Union Territory status for Karaikal. Now we are adding two more demands. Merge Mahe enclave with UT of Lakshadeep, let Yenam either join Telengana or Rayalaseema, when Andra Pradesh is bi-furcated or trifurcated. Or it can be with Andaman Nicobar UT .Though we can present you statistics to substantiate the step motherly treatment meted out to Puducherry and Karaikal with so much portfolios in hands of two representatives of Mahe and Yenam hijacking all development to win their seats but to make all others loose whenever election s are held, we are specifically placing Terrorist related incidents necessitating Union Government granting UT status to Karaikal and directly rule Karaikal through a Lt.Governer directed by Union Home Ministry. Karaikal UT can yield one more Loksabha member, thereby increasing the strength of Lok sabha where Karaikal could be heard. KARAIKAL to KARACHI: Terrorist links. We are enclosing the Junior Vikatan dated February 12 of 2010 which reports about seizure of explosives in Karachi by the Kar achi CID Superintendent of Police Fiyaz Khan in last October 2009. The news, Junior Vikatan states had been reported in DAWN, PAKISTHAN DAILY, with photographic evidence of showing the NAME of the SUPPLYING FACTORY situated in Karaikal. ASIAN TRIBUNE had also reported this, the story also tells that for entire South East Asia, explosives had been supplied from Karaikal. The news report states that in the bomb blast that took place in Bali Island too explosives had come from Karaikal. Not only the Karaikal Collector Vasantha Kumar had failed to prevent this, nor did he have the moral courage to own his faux pas and resign on his own, the moment Pakistan dailies reported this smuggling from the region of his control. Because of neglect by main encla ve of Puducherry we started demanding UT status for Karaikal. As a result then Chief Minister Rangasamy, without clearance from Home Ministry had declared Karaikal as District. Few months back Union Minister of State Mr.V.Narayanasamy publicly stated as reported in media that he will hasten the process to get official stamp of Union Home Ministry for the declaration of Karaikal as District. Hence we are not sure whether our Collector is a Collector or is like a Collector, which people ask whether he is like a wife or concubine. The failure of Home Ministry to give approval for District status can be condoned by granting UT status and relieving the so-called Collector, against whom we nurse no personal grudge but place before you a Fact File on Karaikal. First is Junior Vikatan Report which comes as enclosure. SECOND EVIDENCE: DINAMANI TAMIL DAILY REPORT. The Tamil Daily with unblemished record in reporting news in neutrality , DINAMANI dated 15 th February 2010 had published a lengthy story titled WHETHER SECURITY WILL BE BEEFED UP IN KARAIKAL. ACTIONS SOUGHT WITH REASONS Not only to contain but also to weed out terrorism from Karaikal Union Home Ministry must take over Karaikal under its direct control. Pending decision on UT demand, immediately UNION GOVERNMENT must post IAS and IPS officers with clean records , post Intelligence officials, and completely end the nexus between local politicians and bureaucracy which shields all anti social, why anti national activities in this region. During 1994-1995 The Coimbatore blast fame Imam Ali practiced and perfected his terrorist activities by carrying out rehearsals living in Ammayar Nagar of Karaikal. During 1993-1998 the J.S.Rifawee, SIMI activist stayed in Jamia Pushra Womens College of Karaikal as Principal.

All email or mail threats are emanating from Karaikal. These mails purported to be sent by terrorist organizations like Lakshari Taiba, Indian Muhajudeen, JamawoodDawa, Huji etc are rooted and routed from Karaikal. The threat of 29.3.2008 is known to Karaikal Police Town P.S which seized the matter. On 5 th January 2009 Air India of Chennai received a threat from Karaikal. On 9.3.2009 when a mail claimed the seizure of bag with lethal weapons and explosives, this frequency of threats emanating from Karaikal came to light. Identical mails reached both Karaikal and Nagapattinam Superintendents of Police. Suspicious murders of Karaikal Region: MARG Port DGM Saravanan, Personal Assistant of Opposition Leader A.M.H.Nazim, Thiru Saravanan etc is tip of the iceberg, of suspicious unresolved murders which Union Home Ministry must unravel. The murderer of Poondi Selvam, a leader from neighbouring Tamil nadu sought shelter in Karaikal.The politician-mafia nexus here warrants direct Union Home Ministrys intervention. Lack of Immigration unit in Karaikal is resulting in illegal entry of even crew members of foreign members as verification is not done. Free port to smuggle explosives, free port with wide open gates for foreigners is what Puducherry Government had given us in the name of development. Even after the Special Audit by CAG on directions of Home Ministry, it is learnt the RBI and SEBI blacklisted contractors who bagged the contracts are enjoying patronage of local Port Minister, who continues to hold most portfolios making the Chief Minister a dummy Chief Minister. The allocation of land to Puducherry and Karaikal Ports made without the clearance of the Union Home Ministry necessitates a review by a high level committee of Union Home Ministry to completely trace down all decisions taken in violation of rules and regulations floating all norms of governance, thereby openly challenging Government of India. This had made us to appeal to Union Government to come to our rescue and to immediately bail us out by taking Karaikal under direct Home Ministrys control. On behalf of the people of Karaikal and on behalf of Karaikal Union Territory Struggle Group for which I am the Honorary President and on behalf of the experimental political party Dravida Peravai for which I am the General Secretary, I welcome wholehearte dly your assumption of office as 4th Collector of Karaikal. Karaikal an enclave of Puducherry got step motherly treatment since independence and main enclave walked away with all development. Our struggle group started in 2005 appealed to defeat all sitting legislators of that time since they failed to fight for Karaikals rights. People heeded our call, defeated all 4 sitting Congress M.L.As leaving two DMK M.L.As to scrap through in double digit vote differences. This electoral debacle taught then ruling Chief Minister N.Rangasamy a bitter lesson, who unilaterally announced Karaikal as District. That is how Karaikal is elevated to district status. We were demanding separate Union Territory status for Karaikal once main enclave Puducherry becomes statehood. The status of of Karaikal as District was ambiguous since Home Ministry had to notify, and our District could not be declared backward district to get special attention, in view of this ambiguity. Recently when our delegation met the Union Home Ministry officials in North Block, we raised the issue to get clarification, and we got within four walls. After assuming Collector of Karaikal it would be your duty to sanctify our District status, to legitimize our District status, to ensure Karaikal is made into backward district to get special care under UN-Planning Commission joint schemes. With this we welcome you with open heart. Mizos are known to have no class discrimination or discrimination based on gender. We hope in your administration you will not show any discrimination to party in power or party in opposition or political parties or peoples organizations like us. We all are for people. Our Tamil poet Kaniyan Pongundran two thousand years ago said Every Country is my country, every man is my kinsman. This Tamil nobility finds its echo in Mizos Tlawmngaihna the code that inculcates in Mizos to be kind and hospitable to all, to be unselfish and naturally we would expect these noble qualities to be inherent in you and will act as guiding principle in serving the people of Karaikal. Dravida Peravai, and the Mizo Peoples Conference headed by Brigadier T.Sailo along with Nagaland Peoples Conference headed by Mr.Vamuzo were admitted as associate parties of Samata party headed by Comrade George Fernandes, and as special invitees I used to have friendly relationship with Brigadier T.Sailo, the Chief Minister of Mizoram between 2nd June 1978 to 10th November 1978 and subsequently between 8th May 1979 to 4th May 1984, and who is still MLA from Aiwa West-II constituency. When Mr.B.V.Selvaraj I.A.S, a poet whose poems I translated in Tamil was Resident Commissioner of Mizoram Guest House, I used to stay there enjoying the Mizo hospitality, since Puducherry House stinks with un-cleanliness and amoral activities which had multiplied to uncontrollable magnitude since then. I always sympathize with North Eastern peoples. In Manipur when Mr.Radha Binod Khoijam became Samata Party Chief Minister, I had personal contacts. More than that I do believe NAGAS are DRAVIDIANS. Yes we are one, it is my firm belief, which I had elaborated in my research paper enclosed titled: Nagas are Dravidians. OUR GOAL IS MILES AWAY LET US MARCH


Karaikal, an enclave of the Union Territory of Puducherry is demanding separate Union Territory status for Karaikal. This demand has become louder and louder when the main enclave of Puducherry vociferously seeks statehood. The people of Karaikal had been subject to neglect since independence and the main enclave developed at the cost of other enclaves. If this being the case while we are under the umbrella of a union territory where Union Government had liberally filled our coffers, what would happen if Statehood is conferred for all enclaves under the current Union Territory of Puducherry, is the fear that has gripped the minds of Karaikal Union Territory Struggle Group. The General Secretary of that Group A.S.T.Ansari Babu brought out a fortnightly Karai Union Pradesam, wherein as Honorary Editor in the few issues that appeared, I could educate the people of Karaikal on the other union territories and in what way we had to struggle to get union territory status for Karaikal. It is not easy to achieve the demand without a long drawn struggle and manifold sacrifices. The Union Government headed by Manmohan Singh needed the crucial votes of the Telengana Rastriya Samithi to win the trust vote. Yet the Union Government did not yield to the separate State demand. This must be an eye opener. We have miles to go to press for our demand and to impress upon the political parties of the ruling combine as well as the parties aiming to capture power. It is not easy as some in our group think that by statements, we can get union territory status. I had repeatedly asked our group to compile statistics of the neglect doing in depth study in budgets presented at least in the past decade. Yet we have to become fully equipped to argue our case before the national parties. The difference between the States and the union territories particularly the 28 states and the 7 union territories had to be compared with experiences in other parts of the world. Longer periods of constitutional changes only shape a country, creates its constituents, determines its powers. Let us have a look at Canadian experience. Canada has a constitution - the Constitution Act of 1982. The constitution talks about all sorts of things, like what official languages are and what individual rights are. The constitution works together with system of laws to make up the rules of the country. The constitution also indicates what provinces is a part of Canada and what the powers of those provinces are. For example, provinces have jurisdiction over education and the environment. Territories on the other hand are created by Federal Law. That means the territories have a bit less power than the provinces. They still have representation in the federal government , but don't have provincial governments. The biggest difference is that the provinces get to vote on changes to the constitution but the territories do not. Up until 1982, Canada didn't have a Constitution. It had the British North America Act. This Act functioned the same way as the Constitution does, but reflected continuing close ties to Great Britain. Up until 1982, most changes to the British North America Act had to be passed by the parliament of Great Britain. In 1982, under Prime Minister Pierre Trudeau, the Constitution Act was passed. This act did two main things: it added a Charter of Rights and Freedoms and it made the process of changing the constitution something that Canadians could do on their own. Constitution Act, 1867 (Formerly known as the British North America Act, 1867) After the war with the colonists in the United States, Queen Victoria decided it would be in the best interests of everyone involved to consent to the formation of a parliament within Canada. This parliament made decisions and laws for Canada. Like Great Britain, it had a House of Commons and a Senate. However, the Crown's (the Queen's) representative, called the Governor General, had the 'Power of Disallowance'. This allowed him to revoke any federal law within two years after it was enacted. He could also withhold assent from a bill for a period of two years ultimately preventing it from becoming a law. The provinces of United Upper Canada (Ontario), Lower Canada (Quebec), Nova Scotia and New Brunswick were recognized as forming the Dominion of Canada. The Crown's representatives for these provinces were called the Lieutenant Governor (one per province). They could also withhold assent from bills and revoke laws but had a one year time limit. Parliament of Canada Act, 1875 gave parliament the power to regulate its members. Adjacent Territories Order admitted all remaining territories of British North America surrounding Canada (except Newfoundland) into Canada. Although they were now p art of Canada, they didn't automatically become provinces at this point. Constitution Act, 1886 (Formerly British North America Act, 1886) Allowed parliamentary representation for citizens residing in the Territories. Canada (Ontario Boundary) Act, 1889 Extended the boundaries of the Province of Ontario. Statute Law Revision Act, 1893 repealed certain obsolete laws Canadian Speaker (Appointment of Deputy) Act, 1895, Session 2 (Repealed by the Constitution Act, 1982) confirmed the rules around the Deputy Speaker of the Senate. Yukon Territory Act, 1898 Separated the Yukon Territory from the Northwest Territory Alberta Act, 1905 (Formerly The Alberta Act, 1905) Created the province of Alberta Saskatchewan Act, 1905 (Formerly The Saskatchewan Act, 1905) Created the province of Saskatchewan Constitution Act, 1907 (Formerly British North America Act, 1907) Changed the way money was transferred between the federal and provincial governments. Constitution Act, 1915 (Formerly British North America Act, 1915) Changed the number of s eats in the Senate from 72 to 96. British North America Act, 1916 (Repealed by Statute Law Revision Act, 1927) Extended the term of Parliament during World War I Statute Law Revision Act, 1927 repealed the previous act (since the war had ended) Constitution Act, 1930 Transferred all rights and interests of certain natural resources of the provinces of British Columbia, Alberta, Saskatchewan and Manitoba. Constitution Act (No. 1), 1975 (Formerly British North America Act (No. 1), 1975) gave the Yukon and Northwest Territories representation in the House of Commons. Constitution Act (No. 2), 1975 (Formerly British North America Act (No. 2), 1975) changed the number of Senators from 110 to 112. Gave the Yukon and Northwest Territories each one seat on the Senate. Miscellaneous Statue Law Revision Act, 1977 A law which made some technical corrections and name changes to previous acts. Canada Act, 1982 Last act requiring the sign off of the Parliament of Great Britain From that time on, the British Parliament relinquished the power to affect any Canadian laws, including the Constitution. Constitution Act, 1982 (Part of the Canada Act, 1982) Incl udes the Charter of Rights and Freedoms. Includes the "Notwithstanding clause". This allows the governments to suspend parts of the Charter of Rights for a period of 5 years (at which time it must review the suspension). In December 1988, Quebec invoked the notwithsta nding clause related to Bill 178 (its language law). Bill 178 required signage outside stores to be French only even thought that violated Canada's Charter of Rights. (You could not have an English sign in Quebec). In 1993, a report that Bill 178 violated the International Covenant on Civil and Political Rights was released by a United Nations human-rights committee. Since then Quebec has allowed French/English signs as long as the French is predominant. The Act was signed by 9 of the 10 provinces. The Quebec government has never signed it. Despite this, the Act is legally binding in Canada. Why didn't Quebec sign? There is a strong, 'separatist' movement in Quebec, including a strong provincial party that usually makes up the majority of the government members. At the time, this party was in power and did not wish to sign the constitution of Canada (because they don't want to be part of Canada). Why do they want to separate? This movement wishes to be their own country, apart from Canada. The main issue is language and culture. They are concerned their French speaking culture is being overshadowed by the majority English speaking culture of Canada. In 1995, there was even a 'referendum' (vote of all the people) in Quebec about whether the people wished to separate. The vote to stay part of Canada won by a very small majority (50.56%). No one knows what would have happened if the majority had wanted to separate -- the vote simply reflected the wishes of the people and was not legally binding. However, in a Democratic country like Canada, the wishes of the people have great influence. Proclamation, bringing into force the Constitution Act, 1982 (Can.) The Document that the Queen signed at Parliament Hill making the Constitution Act, 1982, law. Constitution Amendment Proclamation, 1983 recognition of rights obtained under aboriginal land claims agreements. Committed all governments to invite aboriginal and territorial government representatives to conferences on issues related to them. Constitution Amendment, 1987 (Newfoundland Act) included rights and privileges of more denominational schools in Newfoundland. Constitution Amendment Proclamation, 1993 (New Brunswick Act) Amended the Charter of Rights and Freedoms to include the equality of the French and English communities in New Brunswick. Constitution Amendment Proclamation, 1993 (Prince Edward Island) Amends the Prince Edward Island Terms of Union to recognize that the province can levy tolls for the use of a, "fixed crossing joining the Island to the mainland."(Specifically, the Confederation Bridge.) Constitution Amendment Proclamation, 1997 (Newfoundland Act) Allows the Government of Newfoundland to take control of establishing and continuing denominational and nondenominational schools. Constitution Amendment, 1997 (Quebec) Gave Quebec the sole power to determine the system of education used there -- this allowed them to reorganize the school boards for separate French and English schools. Constitution Act, 1998 (Newfoundland Act) There is no mention of denominational schools, so a single school system can be established. Courses in religion are guaranteed, including religious observances at the request of parents. Constitution Act, 1999 (Nunavut) Allow Nunavut to be represented by one Senator and one Member of Parliament. Constitution Amendment, 2001 (Newfoundland and Labrador) Changed the name of the Province of Newfoundland to the "Province of Newfoundland and Labrador". Reproducing Canadian constitutional path instead of narrating the amalgamation of princely states into Indian Union and the linguistic division of states and union territories, is just to remind our colleagues who chat in street corners, as if by just a Delhi trip and presentation of memorandums, our goal of union territory could be realized. A powerful peoples movement must be built. Truth is bitter but let us struggle hard with sacrifices to march towards our goal.

Karaikal Union Territory Struggle Group succeeded in getting regional quota of 18% in professional colleges for the students of backward Karaikal enclave of Puducherry U.T. This was criticized in the U.T.Assembly by few legislators of the main enclave of Puducherry. KUTSG condemned those who spoke in the assembly against regional quota and Speaker of Puducherry Legislative Assembly in floor of the house said the immunity of MLAs in house should not be criticized outside house and ordered the arrest of the leaders of KUTSG. Subject: The order of Honble Speaker of Puducherry and its impact of Peoples freedom of Speech: Next 75 th Presiding Officers Conference urged to evolve guidelines to uphold peoples right to protest and speech regarding Introduction about us: We have been demanding separate UT status for Karaikal enclave of current UT of Puducherry since 2005. The economic backwardness of our region since independence drove us to demand separate UT status for our Karaikal, at the time when Puducherry is elevated to Statehood. We have cited the Goa precedent when Goa was made state, other enclaves were made UT, and stressed that same principle should be applied to us. Our call to defeat all 6 MLAs of our region who had not fought or sought for our regions rights, resulted in people heeding and defeating all 4 Congress MLAs of this region in last held assembly elections, while 2 DMK MLAs scrapped through in double digit vote difference. Ever since we demanded separate UT status, Congress Government of Puducherry had hiked budgetary allocations to our region, which till then was mere paltry pittance. Our region got District status, and these indicate the eagerness to resolve our grievance s of 5 decades. In 2006 the Parents Students Association and our Group joined hands and organized massive students processions, hunger strikes etc demanding regional allocation for our students in medical and engineering colleges. We demanded seats should be given in proportion to the population of the enclaves so that equitable chances are given to all 4 enclaves of current UT of Puducherry. Since then every year 18 percent of total seats i.e. 69 seats are given to students from Karaikal. Now we are demanding that budgetary allocations should be made in proportion to the population of the 4 enclaves instead to tiny enclaves garnering more than it is their due. MLAs Speech in Assembly and our Protest: Recently AIADMK MLA A.Anbazhagan, DMK MLAs S.P.Sivakumar, R.Siva and PMK MLA R.Anandharaman spoke in assembly that our hard won regional quota should be abolished. They as legislators have immunity to speak i n assembly. The DMK legislator from Karaikal Region Mr.V.M.C.Sivakumar, who was a former Speaker and Minister in Puducherry in the floor itself had refuted and said the opinions of 2 DMK MLAs is personal and not official line of DMK. Since our right is going to be sna tched away, Karaikal Union Territory Struggle Group organized a Protest Demonstration in Karaikal before Collectors office which is 160 kilometers away from where all these MLAs live. We put up posters condemning the demand of these 4 MLAs.

Our protest demonstration, with due police permission was conducted in peaceful manner and reported in SUN News apart from all English and Tamil dailies in Trichy and Chennai editions. Next day to our agitation, AIADMK legislator A.Anbazhagan raised the issue aft er zero hour on 23rd April Friday of 2010, and sought action against our posters and protest meetings. Speakers order sets bad precedent: Honble Speaker of Puducherry Assembly in the floor of the assembly ordered the Police to take appropriate action against us and on this issue we are writing to you and all Speakers of Legislative Assemblies in India. The AIADMK Member of the Assembly Mr.A.Anbazhgan did not follow the procedure for dealing the question of privilege as laid down in rules. [Rules 222 to 228 and 313 to 316] It is needless to say that members freedom of speech in embedded in clauses 1 and 2 of Art icle 105. This privilege was granted to the members of Indian legislatures for first time under the Montague-Chelmsford Reforms. Section 67 of the Government of India Act as set out in the Ninth schedule to the Government of India Act 1935. Thereafter a member of the legislature had immunity from any proceedings in any court in respect of his speech or vote. Section 28[1] of the Government of India Act 1935. On attainment of independence section 28[1] of the Government of India Act 1935 was adapted and remained in operation from August 15 1947 till the Constitution came into force. In the Government of India Act 1935 and in Constitution of India the position was stated beyond doubt by using the words anything said or any vote given. In Tej Kira Jain versus N.Sanjiva Reddy: AIR.1970 SC 1573, Supreme Court had stated the immunity is only subject to the discipline of the rules of Parliament, and good sense of the members and the control of proceedings by the Speaker. The Courts have no say in the matter and should really have one. Thus it is clear a member enjoys immunity but it should be within the good sense of members and control of the S peaker. In this case, an enclave of the UT neglected for 5 decades since independence had won a concession of a regional quota of 18 percent in medical/engineering colleges pool and enjoys since 2006. The member, who does not represent any of the constituencies in the enclave of Karaikal, wanted the quota to be done away with. For his speech he has immunity. But the question here is whether the people of the region who are enjoying this right have the freedom of speech to condemn the MLA for his move to snatch their quota or not. Nowhere is it said that a speech made in assembly or Parliament if it infringes peoples right, people have no right to protest. Even in dictatorships or martial law people will take to streets. Thus the MLA who has immunity claiming people have no right to assembly or no right to freedom of speech had put both into loggerheads. Yes Peoples Right to Freedom of Speech versus MLAs Right to Freedom of Speech. In a democracy citizen is supreme. Aringnar Anna used to say Makkal Kurale Magesan Kural which means peoples voice is gods voice in democracy. Former Vice President of India Late B.D.Jatti will receive at midnight a visitor, then Blitz Reporter and then Editor of Voice and Ebony Mr. Vincent Rao, and that too when Mr.Rao tells, go and tell the Governor that a citizen had come. Great people knew in democ racy citizen is supreme. As a representative of citizens members are chosen to assemblies and Parliament, and they are not Lords of the People but Servants of the People. In India unfortunately the right to recall does not exist, but in democracies such right is justifiable and not a draconian measure. Having said this, we assert that the MLA who had expressed his view can only claim immunity from Court cases. He cannot deny people the right to protest what he had said particularly when it robs a regional quota and an enclave and its population get affected if his view is endorsed. By protest we only drew the attention of the Government to stall such initiatives. Freedom of Assembly: Freedom of Speech Freedom of assembly, sometimes used interchangeably with the freedom of association, is the individual right to come together and collectively express, promote, pursue and defend common interests. The right to freedom of association is recognized as a human right, a political freedom and a civil liberty. Hence to assert this freedom a non-political forum came into existence in 2005 wherein all party-men and public spirited men, women, students, parents, traders, laborers joined Karaikal Union Territory Struggle Group, to win the rights of our region.

Freedom of assembly and freedom of association may be used to distinguish between the freedom to assemble in public places and the freedom of joining an association. Freedom of assembly, as guaranteed in the Canadian Constitution and the Constitution of th e United States, is interpreted to mean both the freedom to assemble and the freedom to join an association. The freedom of assembly is enshrined in the following human rights instruments: Universal Declaration of Human Rights - Article 20, International Covenant on Civil and Political Rights - Article 21, European Convention on Human Rights - Article 11 ,American Convention on Human Rights - Article 15 Examples of the national constitutions recognizing the freedom of assembly are: United States - First Amendment to the Constitution of the United States, Germany - Art. 8 GG ,Canada - S. 2 of the Canadian Charter of Rights and Freedoms which forms part of the Constitution Act, 1982 ,France - article 431-1 of the Nouveau Code Pnal ,Hong Kong - Basic Law Section 27 ,India- Fundamental Rights in India ,Republic of Ireland Guaranteed by Article 40.6.1 of the Constitution of Ireland ,Turkey - article 33 and 34 of the Constitution of Turkey guarantee the freedom of association and assembly. , Taiwan (Republic of China) - Article 14 guarantees freedom of assembly and association. It is needless to go global but we are forced to cite these examples to our Honble Speaker of Puducherry R.Radhakrishnan, wh o without applying his mind on just hearing an MLA orders Police to take appropriate action against us, the Karaikal Union Te rritory Struggle Group for exercising our right to assemble with due police permission, for protesting peacefully 160 kilometers away from the Legislati ve Assembly thereby in no way posing a threat to the MLA or to his peace and right to participate in the assembly. The Right given to citizens in all these constitutions keeps people at the helm of Constitutions. Democracies are for people, by people and Governance is for the people. Legislative assemblies and representatives chosen at peoples will dont have power to break the freedom of speech conferred to us under the Constitution of India. We are sorry, only one Speaker of a Legislative Assembly of UT of Puducherry had ignited a debate over Peoples Right versus MLAs might. Speakers Procedural Failure. In the book Practice and Procedure of Parliament by G.C. Malhotra, Secretary General of Loksabha in 2000, it is said: Speech and action in Parliament may be unquestioned and free. However this freedom from external influence or interferences does not in volve any unrestrained license of speech within the walls of the house. The right of freedom of speech in the House is circumscribed by the constitutional p rovisions [art 121] Quoting from same book page 294: A question of privilege may be raised in the house only after obtaining consent of the Speaker. This has been made obligatory so that the time of the house is not taken up by raising a matter, which on the face of it is not admissible Mr.A.Anbazhagan AIADMK MLA after zero hour suddenly raised the issue, and you can apply the above quote to evaluate what he had done is correct procedure or not. Quoting from above mentioned book page 295: The question whether a matter complained of actually is a breach or privilege or contempt of house is entirely for the House to decide, as the House alone is the master of its privileges. The Speaker, in giving consent to raising of a matter in the House as a question of privilege, considers only whether the matter is fit for further enquiry and whether it should be brought before the house. The House was not left to decide, a legislator suddenly raises, instantly Speaker orders the Police to take appropriate action. And this action of the Speaker of the Puducherry Legislative Assembly needs to be debated in the next Conference of All India Presiding Officers, to lay guidelines, as to whether a mere protest performed with due police permission over an issue raised by an MLA depriving a regions right, could fall under breach of privilege, hence this Memorandum to the Speaker of the Lok Sabha, Vice President of the Rajyasabha and to Speakers of all Legislative assemblies. Quote page 295: The Speaker before deciding whether the matter proposed to be raised as a question of privilege requires the intervention of the House and whether he should give his consent to the raising of the matter in the House may give an opportunity to the person incriminated to explain his case to the Speaker [Loksabha Debates: 4.4.1961, cc 9034-38 , 2.5.1961 cc 14904-08, 5.8.1966 cc 2980-81 and cc 2983-95, 3.3.1969 cc 225-26, 18.3.1969 cc 200Page 01, 9.4.1969 cc. 171-72 , 10.8.1971 cc 219, 8.5.1973 cc 186-87, 5.9.1973 cc 49, 23.4.1974 c 233, 22.12.1978 cc 314-25,]

We were not given an opportunity to place our views. The usual practice is to refer the matter of complaint to the Committee of Privileges, and the House defers its judgment until the report of the committee has been presented page 298. [Namboodiripads Case: Loksabha Debates: 27.11.1958 cc 1669-1756, Mathais case L.S.Debate: 10.2.1959 cc 140-72, Bhowmicks case L.S.Debates: 30.8.1960 cc 5652-54, Blitz case: L.S.Debates: 20.4.1961 cc 12659-70] Instant raising of matter and instant order of the Speaker to Police to initiate appropriate action against a protest meeting conducted with due police permission, that too not even calling for police reports about that meeting or neither giving the organizers a chance t o place their reply, jeopardizes the peoples freedom of speech granted by Indian Constitution. The term House of The People, indica tes House is custodian of People and their rights. House where peoples representatives get elected should not be made to take cudgels against people themselv es, making representatives immunity a shield to deprive people of their right to expression. Without application of mind Honble Speaker had spelt out an order directing the Police against Karaikal Union Territory Struggle Group for putting posters informing public about a Protest Mee ting on 22.4.2010 to condemn 4 MLAs of Puducherry main enclave demanding scrapping of the regional quota of 18 percent, students of Karaikal enclave were enjoying since 2006. At the very same time Honble Speaker of Puducherry was ordering the Police, all over Puducherry town people saw posters put up by a Muslim organization announcing blockade of the Chief Ministers residence on May 3 rd of 2010 with regard to their quota issue. Honble Spea ker of Puducherry belongs to the former Chief Ministers group and is not keen to come to the rescue of current Chief Minister of Pu ducherry Mr.V.Vaithialingam and that is why he has no orders to the Police. If an MLA is criticized Honble Speaker rushes to rescue, but if Honble Chief Minister faces blockade of his residence, he watches it as if it is not his concern. This is for Congress Party Chief Madam Sonia Gandhi to look into, we here are appealing to all the Speakers of India to lay guidelines to prevent such actions. Peoples Right versus MLAs right: "Everyone has the right to freedom of opinion and expression; the right includes freedom to hold opinions without interference and to seek and receive and impart information and ideas through any media and regardless of frontiers" proclaims the Universal Declarati on of Human Rights (1948). The people of India declared in the Preamble of the Constitution, which they gave unto themselves their resolve to secure to all the citizens liberty of thought and expression. This resolve is reflected in Article 19(1) (a) which is one of the Articles found in Part III of the Constitution, which enumerates the Fundamental Rights. The right to freedom of speech and expression is subject to limitations imposed under Arti cle 19(2).Public order as a ground of imposing restrictions was added by the Constitution (First Amendment) Act, 1951. Public order is something more than ordinary maintenance of law and order. Public order in the present context is synonymous with public peace, safety and tranqu ility. Our protest was peaceful, done with due permission and in no way public peace was affected. Article 19(1) (a) of Indian Constitution says that all citizens have the right to freedom of speech and expression. Freedom of Speech and expression means the right to express one's own convictions and opinions freely by words of mouth, writing, printing, pictu res or any other mode. It thus includes the expression of one's idea through any communicable medium or visible representation, such as gesture, signs, and the like. This expression connotes also publication and thus the freedom of press is included in this category. Free propagation of ideas is the necessary objective and this may be done on the platform or through the press. This propagation of ideas is secured by freedom of circu lation. Liberty of circulation is essential to that freedom as the liberty of publication. Indeed, without circulation the publication would be of little value. The freedom of speech and expression includes liberty to propagate not one's views only. It also includes the right to propagate or publish the views of other people; otherwise this freedom would not include the freedom of press. Explaining the scope of freedom of speech and expression Supreme Court has said that the words "freedom of speech and expression" must be Page broadly constructed to include the freedom to circulate one's views by words of mouth or in writing or through audiovisual instrumentalities. It

therefore includes the right to propagate one's views through the print media or through any other communication channel e.g. the radio and the television. Every citizen of this country therefore has the right to air his or their views through the printing and or the electronic media subject of course to permissible restrictions imposed under Article 19(2) of the Constitution. Freedom to air one's view is the lifeline of any democratic institution and any attempt to stifle, suffocate or gag this right would sound a death knell to democracy and would help usher in autocracy or dictatorship. Unfortunately the Speaker of Puducherry Assembly had es tablished a wrong precedent by directing the Police to take action against a Protest carried out with due police permission and without hindrance to publ ic in peaceful manner. Clause (2) of Article 19 contains the grounds on which restrictions on the freedom of speech and expression can be imposed:Security of State: Under Article 19(2) reasonable restrictions can be imposed on freedom of speech and expression in the inte rest of security of State. The term "security of state" refers only to serious and aggravated forms of public order e.g. rebellion, waging war against the State, insurrection and not ordinary breaches of public order and public safety, e.g. unlawful assembly, riot, affray. OURS IS NOT UNLAWFUL ASSEMBLY. OUR PROTEST IS TO PROTECT OUR EXISTING REGIONAL QUOTA and in no way it threatened the Security of the State. Since it was 160 kilometers away from where the MLA who raised the issue resides, it no way threat ened his security. In fact Puducherry people need protection from kangaroo courts that are run by land and liquor mafia. Hence in the 75 All India Conference of Presiding Officers, we urge all the Speakers to evolve guidelines to protect the righ ts of people from the arbitrary actions of some rarest or rare Speaker who had now put individual legislators freedom of expression against the Peoples right to free expression. It is necessary to clearly define that mere expunging the uncivilized words of legislators who seek the protective umbrella of immunity to split abuses on Ministers, yet get away with Speaker expunging remarks is not sufficient punishment. The total occasions and regularity of using unparliamentary words which any ordinary human being will never use in his lifetime must be compiled and extraordinary punishment meted out to such errant legislators, for which we urge necessary guidelines be framed. Date :4.11.2009 APPEAL TO ALL LEADERS, MEMBERS OF PARLIAMENT Respected Leader Subject: Karaikal people reiterate their demand for Union Territory status to Karaikal, in case of Statehood is granted to Puducherry on lines of precedent laid out in Goa, Daman, Diu and Dadra and Nagar Haveli regarding Media reports suggest that in this winter session a bill to make the Union Territory of Puducherry into a full-fledged State is likely to be introduced. You may be aware that Union Territory of Puducherry was never a contiguous area. During French rule it was knit together in spite of being enclaves separated by miles and miles. In Bengal too French had an enclave, which too would have remained with us, but fortunately Chandranagore merged with Bengal. The Union Territory of Puducherry comprises of four coastal regions viz- Puducherry, Karaikal, Mahe and Yanam. Puducherry and Karaikal are situated on the East Coast in Tamil Nadu, Yanam in Andra Pradesh. Mahe is in the West Coast in Kerala. Mahe which is 647 kms away from Puducherry covers an area of 9 Sq. kms with 36,000 inhabitants. Mahe is situated on the West Coast of the Indian Peninsula between 11 Degrees 42' and 11 Degrees 43' Northern Latitude, and between 75 Degrees 31' and 75 Degrees 33' Eastern Longitude, just between Badagara and Thalassery, 58 kilometers from Kozhikode, 24 kilometers from Kannur in Kerela State, Mahe with just 9 square kilometers and speaks Malayalam is

ruled by main enclave Puducherry. It should be noted that closer to Mahe, the Union Territory of Lakshadeep with a population 60595 of Malayalam speaking people exists. In the case of Puducherry main enclave becoming state Mahe has three options: 1]. To remain with Puducherry or 2] to have separate Union Territory Status for Mahe or 3] to join with Union Territory of Lakshadeep. It has to be decided by a referendum as per the wishes of people of Mahe. Yanam is one of the regions in the Union Territory of Puducherry. which is 870 Kms away from headquarters. It is situated on the East Coast of the Indian Peninsula at 16 degrees 42' northern latitude, and between 82 degree 11 Eastern longitudes bounded on all sides by the East Godavari District of Andhra Pradesh State. The town of Yanam lies on the spot where the River Coringa (Atreya) branches off from Gauthami into two parts. The entire region, consisting of Yanam town and six villages is treated as Municipality for purposes of local administration. Yenam covers an area of 30.0 Square kilometers has a population of 31,362 according to the 2001 census. The demand for statehood to UT of Puducherry is vehemently opposed by Yenams sole legislator who is in Cabinet of the Union Territory. Telugu media reports that this Minister who had taken oath under Constitution of India is so much upset with Puducherry becoming statehood collected 50000 signatures including children and went to France to submit a memorandum to French government unmindful of protocol or constitutional responsibility. This appeal to erstwhile colonial rulers exhibits his and Yenam peoples anger against Statehood for Puducherry. Whatever future status Yenam wants can be determined by a referendum. Whatever valid reasons the main enclave Puducherry advances to obtain statehood, is in no way endorsed by Karaikal enclave. Karaikal region is far away from main enclave by 150 kms. It has an area of 161 sq. km. and population of 1, 70,640 as per the 2001 census.Karaikal region is made up of the Communes of Karaikal, Kottuchcheri, Nedungadu, Tirunallar, Niravi and Tirumalarajanpattinam. This region since its merger with Indian Union and since it became a constituent of the Union Territory of Puducherry had received only step motherly treatment from the main enclave of Puducherry. Regional imbalances and continued neglect for five decades led to the birth of separate Union Territory status for Karaikal. Such grievances had even broken the State of Bihar into two states of Bihar and Jharkand. Hence it is needless to tell enlightened and eminent personality like you that to address the issue of regional resentment territories could be granted separate status. Now that Union Territory of Puducherry in the craze to have more powers for political masters has advanced a demand for elevating the UT into a State. To seek your support to de-link the enclave of Karaikal from the Statehood status, and to get the Union Governments nod for conferring Union Territory status to Karaikal enclave, a contiguous region, we are mailing this appeal to you. Let us all look at Goa precedent. Goa, a tiny emerald land on the west coast of India, the 25th State in the Union of States of India, was liberated from

Portuguese rule in 1961. It was part of Union territory of Goa, Daman & Diu till 30 May 1987 when it was carved out to form a separate State. At that time Daman, Diu and Dadra Nagarhaveli which has now a population of 1, 58,204 in 112 square kilometers were left to remain as separate Union Territory. Like that we demand that Karaikal be declared as Separate Union Territory while Statehood is conferred on Puducherry in this winter session of Parliament or later. Precedent exists. Other enclaves too can be made separate Union Territories if they seek or wish. But we from Karaikal region are clear in our goal. Yes we want Separate Union Territory Status for Karaikal. Enough with 5 decades of neglect and backwardness thrust on us. The number of union territories is dwindling with former union territories becoming states; hence there is historical necessity to

integrity of India. With this forethought in mind, Union Territories Act was envisaged. To give life to this Act, we urge Karaikal be delinked from Puducherry State and kept as separate Union Territory directly ruled by our President.
