California Sherman Law Regulations Protect


Medical Marijuana Patients From Contaminated Medicine
California medical marijuana users are informing dispensaries, growers and hydroponics stores
about California statutes known as the Sherman Law designed to protect consumers from contaminants, impurities, and pesticides in medical marijuana and other medicines.
The Sherman Law (in California Health & Safety Code Section 111255) states that any drug
or device is adulterated if it has been produced, prepared, packed, or held under conditions
whereby it may have been rendered injurious to health.
A recent court ruling proves the Sherman Law is being used to protect medical marijuana consumers. It happened when a judge ordered that marijuana samples from a Southern California
dispensary be tested for contaminants and impurities. The judge ordered the dispensary closed
after tests revealed the dispensarys medicine was contaminated with illegal pesticides.
Along with Section 111255 cited above, the Sherman Law (section 111260) also makes it illegal
to sell a drug if the methods, facilities, or controls used for its manufacture, processing, packing,
or holding do not conform to, or are not operated or administered in conformity with current good
manufacturing practice
to assure that the drug or device meets the requirements as to safety and has the identity and
strength, and meets the quality and purity characteristics that it purports or is represented to possess.
When medical marijuana users consume medicine that makes them cough and gag, their respiratory discomfort is most often caused by mistakes in how the medical cannabis was grown, what
inputs were used, and how well the crop was flushed and cured.
Its easy to see that the Sherman Law is a common sense attempt to protect drug consumers by
insisting that medical marijuana be of adequate quality and purity. Thats why medical marijuana
patients are asking dispensaries to comply with the Sherman Law by only providing safe, uncontaminated marijuana.
If you operate a medical marijuana dispensary, the law obligates you to ensure that the marijuana
you provide was grown using the safest materials and horticultural practices.
The bottom line is when growers and dispensaries abide by the Sherman Law, your medical marijuana will be smoother, tastier, safer, stronger and better for your health.
