To All Interested Parties: Please be advised that I have been assigned to mediate your case under the State of Nevada Foreclosure Mediation Program (FMP). The foreclosure mediation has been scheduled as shown in the enclosed Mediation Scheduling/Notice to Appear. The mediation will be held in accordance with the Foreclosure Mediation Rules (Rules) adopted by the Nevada Supreme Court. The Rules may be viewed/downloaded at: www.nevadajudiciary.us, click on the Foreclosure Mediation section. If the Lender fails to attend the mediation or to fully comply with the requirements of the Rules, the Lenders ability to proceed with the foreclosure may be denied, restricted or other sanctions may be imposed by the District Court. If the Borrower fails to attend the mediation, the Lender may be permitted to proceed with the foreclosure. Four (4) hours is reserved for the mediation session. Mediators Role The mediator is an unbiased, neutral third party, and will not give legal advice or opinions. The role of the mediator is to facilitate the negotiation process which may or may not reach a resolution to the foreclosure. The mediator only controls the process; the parties control the outcome. Borrower (Homeowner)/Lender Representation The Borrower may be represented at the mediation by an attorney licensed to practice in Nevada, a loan modification specialist licensed in the state of Nevada, or a HUD-approved counseling agency. A list of licensed loan modification companies is located at: www.mld.nv.gov. It is advised that the Borrower notify the mediator as soon as possible if she/he is being represented at the mediation. The Lenders representative must be authorized to participate in the mediation on behalf of the Lender, including the ability to fully negotiate the terms of a loan modification or alternative solutions. Pursuant to the Rules, please be advised of the following: No further action may be taken by the Lender to foreclose on the property until the conclusion of the mediation process. Afterwards, the FMP Manager may issue a Certificate to Proceed with Foreclosure. The Lender/Representative must be physically present (and/or by telephone if preapproved by the mediator). All required documentation must be provided by the Lender. See FMP Rule 11.4 for further information on the provisions. Not less than ten (10) days before the scheduled mediation, the parties must exchange with each other and provide the mediator the following documents: Lender: An appraisal or BPO on the property completed no more than 60 days prior to the mediation; Estimate of the short sale value of the property to possibly be considered; and, All required loan documents as per the FMP Rules dating March 1, 2011.

Borrower: A copy of the Financial Statement; and, A copy of the Housing Affordability Worksheet. Please provide the following documents to the lender and bring to the mediation: Most recent tax return; Two most recent bank statements; Proof of income (two current pay stubs); If self employed, a copy of the profit/loss statements for past six months; A hardship letter and other documents that may be required for government loan programs; and, Short sale information, if applicable. Please Note: If additional documentation is needed, please notify the party as soon as possible (at latest, 10 days before the mediation), and request the specific documents required to ensure proper preparation for the mediation. Plus, the parties must provide the following documents in writing only to the mediator: Lender: Evaluative methodology used in determining the Borrower eligibility for a loan modification; and, A confidential, non-binding proposal for resolving the foreclosure. Borrower: A confidential, non-binding proposal for resolving the foreclosure. The FMP Rules require that the parties mediate in good faith. Failure to abide by this requirement may result in the termination of the mediation process and the imposition of sanctions by the District Court. It is recommended that you contact me seven days before the mediation to confirm your presence and to ensure that all documents will be available at the mediation.
