Behavioral Sciences Regulatory Board Complaint Review Committee December 11, 2006 Minutes

The meeting was called to order at 10:05 a.m. Members present: Rich Maxfield, Wes Jones, Jean Hogan, Bill Meredith, and Bob Eades. Advisory members present: Phyllis Gilmore, Marty Snyder, and Roger Scurlock. The minutes for November 2006 were approved as written. The following docketed cases were reviewed: 02-CP-0045 The former licensee was a LCP. He was complained upon and the committee determined that he had violated the regulations. CAO negotiations were in progress but his license expired on 1130-06. The committee voted unanimously to inactivate/dismiss the complaint due to lack of jurisdiction. 06-LP-0052 The licensee is a LP and was alleged to have diagnosed a person relying only on statements from a client. The person was never a client of the LP. The committee voted unanimously to dismiss the complaint due to lack of jurisdiction. Case review. 06-CS-0055 The licensee is a LSCSW and the complainant is the mother of a child who was the client of the licensee. The allegations were that the licensee practiced incompetently, failed to comply with the requirements for record keeping, and failed to report suspected abuse. The committee voted to dismiss the complaint with a cautionary letter. Jean Hogan abstained. The cautionary letter was to strongly recommend that the licensee review her record keeping, take continuing education in professional liability including record keeping, and review the child abuse reporting law. The committee also directed that the licensee be informed that it was divided on whether she should have reported suspected child abuse in this incident. 07-LP-0005 The licensee is a L.P. and the complainant is the father of two children who were the licensees clients. The allegation was that the licensee failed to report suspected abuse. The committee

required further information from the licensee prior to making a decision. 07-BS-0022 The licensee is a LBSW and the complainant is the aunt of a child in SRS custody. The allegation was that the licensee violated the childs confidentiality. The committee voted to dismiss the complaint due to lack of jurisdiction. Jean Hogan abstained. Case review. 07-CS-0031 The licensee was a LSCSW and the complainant was the counselor of the licensees former client/partner. The allegation was that the licensee engaged in a sexual relationship with a former client. A CAO went into effect regarding a previous complaint on August 9, 2006. The CAO was for engaging in a sexual relationship with a former client. The licensee submitted her license for surrender. The committee voted unanimously to revoke her license. Other items discussed: 06-CS-0039 The licensee is a LSCSW and was issued a cautionary letter regarding the violation of adoptive parents confidentiality. The licensee disagreed with the cautionary letter on the grounds that it resulted from an issue of hearsay. The committee directed that a letter be sent to the licensee regarding this matter. 07-MS-0032 & 07-MS-0039 The licensee is a LMSW who is employed at Fort Riley. Her supervisor called regarding the complaints. He said that the complaints were the result of the licensees complaints on coworkers. He asked that the licensees employer be allowed to answer the complaints and that the complaints not be docketed. The committee determined that the complaints should be docketed and investigated. Discussed nurses signing documents as social service designees without being under the supervision of a social worker. Phyllis is to discuss this with the board of nursing and report at the next meeting. Marty gave an update on the following cases which had been referred for disciplinary action: 02-CP-0045 06-CS-0004 Ziglari Santiago Referred 05-14-03. His license expired on 1130-06. Case closed. Referred 01-09-06. Cautionary letter sent. Wait and see whether attorney sends objection. 2

Sunderland Referred 10-09-06. Censure mailed time expired case closed. Bolt Referred 10-09-06. Censure mailed time to expire on 12-13-06 close if no response. Hersh Referred 10-09-06. SPO mailed on 10-18-06 which suspended her license indefinitely. Work with attorney regarding response to notification. Reed Referred 11-13-06. Censure mailed 12-06-06. Waring Referred 11-13-06. Censure mailed 12-06-06.
