Solon seeks disclosure of terms of rental-purchase agreement


Consumers will soon be protected from unscrupulous businessmen in the proposed rentalpurchase agreement bill. Under House Bill 5711 authored principally by Rep. Marcelino Teodoro (1st District, Marikina City), a rental-purchase agreement shall disclose to the consumer the amount of the first payment and the total amount of fees, taxes or other charges which may be required at or before the date of consummation of the agreement. Teodoro said the bill aims to include disclosure of all costs under an agreement, as well as providing an enumeration of substantive rights available to consumers. Teodoro said the measure to be known as the Consumer Disclosure and Rental Purchase Agreement Act, will protect consumers from unfortunate transactions with devious businessmen. There are a great number of consumers engaged in rental-purchase transactions. Unfortunately, in many instances, these transactions have taken place without adequate disclosures and other protections to consumers who most of the time turn out to become victims of deceitful businessmen, Teodoro said. The rental-purchase agreement shall likewise disclose the amount and timing of rental payment, total number and total amount of rental payment necessary to acquire ownership of the property and a statement that the consumer will not own the property until the consumer has paid the total amount necessary to acquire ownership. The bill also provides a disclosure, to the extent applicable, that the total amount of payment does not include other fees or charges, such as delivery fee, initial processing fee, taxes or other fees or charges which may be payable under the agreement. Such fees and charges shall be separately identified in the agreement. Under the measure, the rental-purchase agreement shall also disclose a statement that the consumer may be responsible for the fair market value of the property if lost, stolen, damaged or destroyed; whether the property is new or used and the manufacturers suggested retail price. The agreement shall also stipulate a statement identifying the party responsible for maintaining or servicing the property while it is being rented; describing the responsibility for maintenance or service, date of consummation of the transaction and the identities of the merchant and consumer and the late fees for past due rental charges. Moreover, the bill provides that each rental-purchase agreements shall provide a statement of any obligation of the consumer and the merchant to repair any defect or malfunction of the property covered by the agreements. A merchant shall be required to provide a quarterly statement upon request by the consumer. A fine of not less than P5,000.00 shall be imposed on a merchant found guilty of violating the
