I.

RELIEF REQUESTED

COME NOW the Defendants, Pro-Se, JOAQUIN SAMPSON and MARTHA LILLIE, and
move the Court pursuant to CR l2(b)(6) and CR 8(a) for an Order dismissing Plaintiffs' Complaint

with prejudice as it applies to said Defendants on the grounds that plaintiffs have failed to state
claim upon which relief can be granted.

II.

AUTHORITY and ARGUMENT

CR 12(bX6) provides that a defendant may request dismissal of a claim by motion for
plaintiff's failure to state a claim upon which relief can be granted. Such
whenever
a dismissal

plaintiff can prove no set of facts, consistent with the

A plaintiff must plead factual allegations with specificity; vague and conclusory allegations of fact fail to state a claim for relief. Colburn v. Upper Darby Township,838 F.Zd 663, 666 (3'd Cir. 1988). While a Complaint attacked by a CR 12(bX6) motion does not need detailed factual
allegations, a plaintiff's obligation to provide the grounds of his entitlement to relief requires more
than labels and conclusions. A formulaic recitation of the elements of a cause of action

will not do.

citations omitted). Factual allegations must be enough to raise a right to relief above the speculative

level. Id. In Washington,

a Complaint failing to contain direct allegations sufficient to give notice

to the Court and opponent of the nature of a plaintiff's ciaim is proper for dismissal. Berg v.
Gorton,88 Wn.2d 757,56'l P.2d 187 (1977). CR 8(a) requires that a Complaint for relief "contain (1) a short and plain statement of the claim showing that the pleader is entitled to relief and (2) a demand for judgment for the relief to

which he deems himself entitled." The Complaint must "apprise the defendant of the nature of the

plaintiff's claims and legal grounds upon which the claims rest." Molloy v. Bellevue, 71 Wn. App.
382,85g P.zd 613 (1993), review denied, 123 Wn.2d 1024,875 P.2d 635 (1994). "A pleading is insufficient when it does not give the opposing parly fair notice of what the claim is and the ground
upon which

it rests." Dewey v. Tacoma School Dist. No. 10, 95 Wn. App. 18, 23, 974 P.2d 847

(1999), quoting Lewis v. Bell,45 Wn. App. 192, 197,724P.2d 425 (1986).

Plaintiffs' Complaint contains

a series

of disjointed allegations relating to several events and

involving several persons and entities. It cannot be gleaned from Plaintiffs' Complaint what,
anything, is alleged as a claim against Joaquin Sampson and Martha

if

Lillie.

The Complaint does not

allege any facts that can possibly rise to the levei of establishing a cognizable action upon which

relief can be based.

Furthermore, there is no prayer for relief in the Complaint. As such, it is impossible for the
Defendants to defend themselves, and it is impossible for the Court to fashion a remedy.

It

should be noted that on March

2I, 2Ol2 plaintiffs filed a pleading entitled "Motion

Amended Complaint 15 USC $1641 12 U.S.C. 2601 et se4 CFR $3500 Reguiation Z RCW 19.86
29 USC $ 216." Several defendants, including Randy Leonard, Portland Water, the City of Portland

Public Safety, Portland Police Bureau, Sam Adams, Steve S. Staul, and Ronald Frashour III, are no longer included in the case caption. Notwithstanding, the allegations made by plaintiffs remain
unclear, leaving Defendants unsure whether plaintiffs intend to continue to pursue claims against the Defendants in Cowlitz County Superior Court. The Defendants have previously been sued by

plaintiff, Roberta Kelly, and associates in the United States District Court for the District of Oregon
and Multnomah County Superior Court in a similar disjointed fashion. In each matter, plaintiffs'

claims were dismissed, prompting Chief Judge Ann Aiken of the United States District Court for the District of Oregon to enter a Pre-filing Order stating that all filings from Ms. Keliy "shall be

reviewed by this Court and ordered filed only

such filings are deemed not frivolous or repetitive.

Accordingly, the Defendants feel it is necessary to bring this Motion before the Court seeking an
Order of Dismissal notwithstanding the most recent filings.

the Court determines that the plaintiffs' pleading referenced above serves as a voluntary

dismissal of those Defendants no longer identified in the case caption, the Defendants request that

the Court enter an Order similar to that of Chief Judge Ann Aiken. The Defendants need some
protection from the haphazard filings of the plaintiffs.

CONCLUSION

Based upon the foregoing, the Defendants, Joaquin Sampson and Martha Lillie, respectfully

request that the Court enter an Order Dismissing plaintiffs' Complaint, as Defendants,

On March 2, 2012, this Court issued a Protective Order at the request of co-defendant,
Maxine Bernstein, and on March 23,2012, issued a Protective Order at the request of co-defendant,

Cowlitz PUD, to prevent a similar abuse of discovery. The Defendants named herein also need
protection from plaintiffs' antics.

BASIS FOR PROTECTIVE ORDER
