JOINT MOTION TO EXTEND THE TIME FOR APPLE TO RESPOND TO VIRNETX, INC.S MOTION TO COMPEL AND FOR VIRNETX, INC. TO RESPOND TO APPLE INCS SECOND SET OF INTERROGATORIES Complainant VirnetX, Inc. (VirnetX), Respondent Apple Inc. (Apple), and the Office of Unfair Import Investigations respectfully submit this joint motion for a fourth extension of time of seven (7) days until April 11, 2012, for Apple Inc. to respond to Complainant VirnetX, Incs Motion for an Order Compelling Production from Respondent Apple Inc. (Motion No. 818-002). The parties are seeking this extension in order to allow additional time to resolve this dispute without Court intervention. Specifically, since the last extension of the deadline, the private parties have exchanged additional information relating to this motion and have made some additional progress in narrowing the issues in dispute and resolving issues relating to the motion. The private parties agree that additional time is needed to evaluate the information exchanged and that it would be productive to continue to consider and discuss the issues in order to resolve this dispute. The private parties additionally seek an extension of time of eight (8) days until April 13, 2012, for VirnetX to respond to Apples Second Set of Interrogatories (47-130).
