Statement of facts 1. On or about September 12, 2011, Affiant delivered a Notice of Correction for Fraud, Notice of Tender for Setoff, Notice of Fiduciary Appointment, Copies of instrument numbers VRV1111212 VRV111121212 and Certificate of Mailing, by way of notary, certified mail, # 7010 1670 0000 1212 1212, pertaining to mortgage trust, # 12121212, from the Affiant for Respondents attention. On or about September 20, 2011, Affiant delivered a Second Notice of Correction for Fraud, Second Notice of Tender for Setoff, Second Notice of Fiduciary Appointment. Copies of instrument numbers VRV1111212- VRV1111212 and Certificate of Mailing, by way of notary, certified mail, # 7007 2560 0000 1212 1212, pertaining to mortgage trust, # 121212, from the Affiant for Respondents attention. On or about September 29, 2011 a notice of intent to default was sent via first class mail.

These notices plainly indicate that: the Affiant has tendered payment for the relevant mortgage account; the mortgage has been corrected for fraud; previous beneficiaries have been dismissed for fraud, the only rightful beneficiary to all property of the associated trust(s) is ALL CAPS, herein after beneficiary; Her Name, real party in interest is the paramount security interest holder in all property of ALL CAPS; Naomi is the fiduciary to settle the account(s) and transfer all relevant property to the beneficiary; no other person or entity has a claim to the property commonly known as 12121 12th Ave SW, Burien, WA, Her Name has, by tacit procuration, the power of attorney to settle any administrative duties for and on behalf of the fiduciary, in the event of default or failure to perform on the part of the fiduciary; the above-referenced notices and now default have created binding, enforceable obligations on the trustee for which the Affiant has procured the rights and remedies to execute as she determines. Naomi Feistel (Respondent and trustee) is in default in this matter. Any irrevocable indentures within the original mortgage are void for fraud. Affiant has exclusive right of possession and title of the subject property and this right is not challenged by any other party. Affiant reserves all rights for any future claims or counter-claims.

Duty Owed Respondent had a duty to discuss, negotiate and resolve any disagreements as a fiduciary to the mortgage trust. Respondent had a duty to handle any and all instruments provided with ordinary care. Respondent had a duty to notify all interested parties of the actions of the beneficiary, including any and all agents and/or principles of any and all associated accounts and trusts. This failure to respond, and now default, is as an operation of law, Respondents final admission and agreement to all statements and claims made by Affiant through tacit procuration pertaining to the above-mentioned notices have been stated, and the whole matter is res judicata and stare decisis and Respondent is in estoppel by Respondents failure to respond. Duty Breached Silence can only be equated with fraud when there is a legal and moral duty to speak or when an inquiry left unanswered would be intentionally misleading. Fraud destroys the validity of everything into which it enters. Respondent failed to discuss, negotiate and resolve any disagreements as a fiduciary to the mortgage trust. Respondent apparently failed to handle any instruments provided with ordinary care. Respondent apparently failed to settle the account(s) of the beneficiary, including notifying any agents and/or principles of such settlements.
