Contractual Brief
Definition
A media corporation signs an agreement to carry out a project to make a set product, in a set time scale, ith a set fee for them to be paid! "f any of the abo#e elements of the contract are breached by either the client or the media corporation commissioned to make the product, legal action could be taken against the accused party! $ometimes it is a genuine mistake on one of the parties parts, such as% lack of or too much pay or an added part to the brief, ithout gi#ing the corporation e&tra time! "n these cases, a negotiation 'mentioned later( ill be set up to sort out the issue and hopefully resol#e the problem raised! "t)s key that the contracts are read before they are signed, this is to ensure that the corporation don)t sign anything hich ill disad#antage or affect them in the long run! This could be to do ith the pre#iously mentioned pay, time scale or terms of contract!

A client produces a brief to gi#e to the media company hich they ha#e commissioned to make a specific product! All this brief does is establishes hat they ant them to make, the terms, like stated in the last section, ill come later during the negotiation section! The formal brief only contains the product the client ants producing, nothing more, any added information ill be discussed and then gained by the media company and later planned negotiation talks, here things like fees, time scales and terms of contracts ill be discussed! ,#en though this brief type does state information about a product, hich are then transferred bet een the t o companies and then agreed on, it is not a legal binding contract as of yet, this comes later at negotiations!

Advantages
The company commissioned to make the product isn)t pressed into actually making the product yet, due to it not been legally binding! $igning the contract before they)#e found out fees and time scales ould not be beneficial to the commissioned company, due to potential unfair terms been added by the client! Definition
This brief solely e&ists on a #erbal contract, hich no physical paper copy of the contract e&ists! "nstead of ha#ing it ritten out in terms of pay etc!, it is discussed bet een the client and the media company ho ha#e been commissioned to make the product! "n certain circumstances, due to it been an informal brief, a completion date might not be set! This maybe due to the company not anting the product straight a ay, or the client is substituting some of the fee in e&change for more time!

Advantages
This brief is rela&ed and doesn)t put masses of pressure on either side, due to a time limit sometimes not been set! This can ho e#er mean that the commissioned company take their time and keep the client aiting! -n the other hand, if this does happen, the client on)t gi#e any future business to this company, so it)s not in the media companies interest to take a long time!

Disadvantages
This contract is a risky one because it doesn.t ha#e a set contract, so either party could try and e&ploit the other out of money, time! This can sometimes get to the point of a la suit, especially if lost of potential money could be made by the client company for the product!

Co/-perati#e Brief
Definition
This brief is e&plicitly designed for t o or more companies and in#ol#es them getting hired by the client to design the same product, hich they ill ork together on! -ccasionally a disagreement occurs bet een the t o or more companies, hich ill ha#e to be resol#ed through a negotiation! The negotiation ould in#ol#e the companies hich aren.t happy about the brief, and dependant on the nature of the disagreement, the client may get in#ol#ed also! The result of the negotiation ill be a ne brief hich ill satisfy all the companies ithin the project! +or this reason it ould be beneficial for all the companies to be a the negotiation, so they can agree and disagree ith the ne terms, until e#ery term is complete!

Advantages
The more companies that are in#ol#ed, the faster you can finish the project 0ue to there been more than one company and the client, negotiation bet een the t o could get you more money, instead of the commissioned company being bullied by the client, ith the threat of losing the project!

Disadvantages

$imilar to the last brief type, if t o or more companies ha#e a disagreement, this brief ill be the resultant one that they all agree on! This ould mean a ne brief ould be created to please all parties in#ol#ed in the project, this time it ill in#ol#e the client, due to the brief, hich they created, been changed! This could entail the #isual style of the product, hich one company belie#e on)t sell! A change of content, as ell as making sure the gi#en product is still ithin ethical and legal boundaries, if one, or all the companies think the product is starting to drift do n the illegal or unethical path! "t is important for the companies to resol#e the issues *uickly and fairly, mainly for the clients sake, due to the continuation of the project after the negotiation has been completed!

Commission Brief
Definition
This type of brief in#ol#es a large media organisation contracting or hiring an independent media company to design and produce a media product for them! This therefore means an e&ternal client isn)t in#ol#ed in the first initial parts of the brief, so isn)t in#ol#ed in the negotiation of the brief due to this! 2o e#er, a client may come into the negotiations later on, if the large media company decide to sell their product on to e&ternal clients! This ould then mean that these negotiations ouldn)t in#ol#e the independent company, just the client and the large media company, unless other ise agreed in the pre#ious negotiation! -f course, a fee ill be paid to the independent company, for the product they ha#e pro#ided, but may not recei#e the products profits, unless they ha#e negotiated a cut ith the large company at the negotiation stages!

Advantages
This brief gi#es the smaller companies business, not just the big companies hich other briefs focus on! This brief needs one company in it to be small, due to a big company outsourcing ork to it, here as t o large companies ouldn)t ork like that! They ould either use this brief or produce products 4in house)! 5nlike the co/operati#e and negotiated briefs, this brief is bet een t o companies and therefore is less likely to breakdo n o#er unfair terms, due to the number of companies been lo ! ,#eryone is getting a financial fee j some ay! ,#en though it benefits some more than others, e#eryone is getting a fe of some sort!

Tender Brief
Definition
This kind of brief is uni*ue to all the others, and is slightly similar to a competition brief! This brief in#ol#es a client publishing an ad#ertisement, hether it be internet or poster form, that they need a product to be made! After this, a range of production companies ill design a proposal and a financial breakdo n of costs, hich ill then be pitched to the client! "f this client is a big and successful client, there might be a range of companies competing for this contract, due to the financial gain, hile a future contract may be a#ailable if they complete the task to a high standard! The final stage of this brief in#ol#es the client selecting the best proposal and offer from the production companies! 6hile the potential financial gain the client could earn, they also must think about the cost of the project, is it too near to the profit made7 "s this companies fee feasible and ill the project sur#i#e ith this company7

Advantages
This brief allo s the client to get a company that ill actually do the job, not just a company that they ha#e met for negotiation! This is due to all the other briefs not re*uiring independent or production companies to pitch their ideas, therefore, the client can)t be 899: certain they)#e got a reliable company! -n the other hand, a pitch doesn)t make a company reliable, it just makes them good sales representati#es!

Competition Brief
Definition
This brief type is an unusual and uni*ue brief, compared to e#ery other brief! The competition brief is open to all production companies to participate against one another for the one opportunity of making a product for the client! This brief, unlike the others, doesn)t re*uire just one company to make a product, e#ery company ho ants to participate makes one! After the entry stage, the client then re#ie s the products, in this case a media product, and judges one piece to be the inner! This competition is usually free to enter, due to the client anting a lot of entries for this competition! ,#en though some of the entrants maybe strong, the client only has to pay the inner of the competition brief, only if there as a financial incenti#e in place! $ometimes another perk is the reason for the competition, but if it)s not a great re ard, companies may decide to not enter and the client ill ha#e fe entries and little choice!

Advantages
"n the clients point of #ie , there is not an aspect in hich they are losing! They get to look at many ideas and could take some as their o n, due to them not been patented yet, as ell as getting a final product also! As for the financial loss, this type of brief doesn)t usually offer much if any re ard!

Disadvantages
The production companies ill only benefit if they are a small production company and not a large, big profit
